that the appeal period is over. The applicant must then get this recorded at the Registry of Deeds. One copy and proof of recording

Dear Mr. Decareau:
A review of plans submitted as part of a building permit request for parking lot construction
at 100 Willow Street(dated March 12, 2007)indicates the presence of wetland resource areas
on the subject property. A wetland delineation review was conducted by this department as
part of a Notice of Intent filed for construction proposed at 60 Willow Street That
delineation is part of DEP File #242-1439 and is reflected on an Existing Conditions Plan
dated August 1, 2008. The line was revised in the field,but confirms that there are no
wetland resource areas within 100 feet of the new construction at 100 Willow Street
However, a previous filing for work proposed at 60 Willow Street; DEP File #242-1374,
indicates a small B-series wetland connected by a swale to the larger A-series wetland (see
Plan of Land prepared for Rohm and Haas by Merrimack Engineering Services and dated
June 1,2006). After field review,it was determined that this area does not contain hydric soil
indicators and is not a jurisdictional resource area.
As such, the Conservation Department will not require a filing for the parking lot
construction detailed on the submitted plan. Please be aware that any additional work
performed within 100 feet of jurisdictional resource areas requires notification of the North
Andover Conservation Commission.

Dear Mr. Decareau,
According to the North Andover Zoning Bylaw Section 8.3.2.c.i, Waiver of Site Plan Review,your
request for a parking lot changes at 100 Willow St, will not require an application for Site Plan Review.
At the Planning Board meeting on September 17, 2008,the Board determined that the waiver request is
granted based on the following information:
The plan titled"Plan of Land, 100 Willow St.,North Andover,MA", dated September 4, 2008,
illustrates the creation of 4 new parking spaces and one accessible parking space,plus a new
retaining wall and handicap ramp. These changes are not associated with new construction or
new uses in the existing structure and are therefore not subject to Site Plan Review, according to
Seection 8.3.2.c.iii of the town's Zoning Bylaw.
