Pursuant to this statute,an employee is defined as"...every person in the service of another under any contract of hire,• express or implied,oral or written." An employer is defined as"an individual,partnership,association,corporation or other legal entity,or any two or more of the foregoing engaged in a joint enterprise,and including the legal representatives of a-deceased employer,or the receiver or trustee of an individual,partnership,association or other legal entity,employing employees.. MGL chapter 152,§25C(6)also states that"every state or local licensing agency shall withhold the issuance or renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has not produced-acceptable evidence of compliance with the insurance coverage required." Additionally,MGL chapter 152,§25C(7)states"Neither the commonwealth nor any of its political subdivisions shall enter into any contract for the performance of public work until acceptable evidence of compliance with the insurance requirements of this chapter have been presented to the contracting authority." Areas to be created in unfinished basement CONTRACTOR SHALL supply all new materials needed to erect and or change framing according to State and Local Building Codes; to build and or change as needed all walls along exterior walls and partition walls required to create and finish areas as designated on scale drawing. The areas are as follows. ➢ Family Room /Home Entertainment Area ➢ Utility/Furnace (unfinished interior)(louvered bifold door) ➢ Under Stairs Storage closet(finished interior)(hinged door) ➢ Electrical closet(unfinished interior)(hinged door) ➢ Storage Area (unfinished interior)(hinged door) 2. Soffit Preparation ❑ Soffit (duct enclosures) shall be fabricated with OSB plywood and structural lumber to suppor the weight of new drywall to State Codes. 3. Wall Structure ➢ Contractor shall make wall alterations as indicated (approximately, as needed) on scale drawing. All wall structure shall be built according to state & local building requirements. 4. Insulation ➢ All exterior walls shall be insulated so that all living areas and spaces are insulated according to code (as needed). The insulation value is R-13. ➢ Electrical Work ➢ A Massachusetts Licensed Master Electrician shall perform all electrical work. This project shall include the following. ❑ Up to 20-6 inch recessed lights in living areas. ❑ Up to 6 switches to control all recessed lights. ❑ Utility type lights shall be used in furnace / storage rooms. These light(s) shall be separately switched. ❑ GFCI power outlet shall be placed, as instructed by homeowner to power a refrigerator. ❑ Up to 2 cable/broadband wall connections. ❑ Up to 1 telephone wall connections. ❑ Speaker wires will be run by contractor. All speaker wire shall be supplied by homeowner. Speaker wire must be rated for "in-wail" use. ❑ Heating shall be electrical baseboard heating controlled by wall mounted thermostat. Baseboard shall be sufficient to properly heat living space. ❑ Electrical outlets through living area per code. Both sets shall be 60 inches in width. ➢ Support Column Enclosure ➢ Contractor shall fabricate a paneled looked for one support column as indicated in pictures sent to homeowner. There is no charge allocated to this task. ➢ Baseboard, Door Casing 0 ➢ Contractor will supply and install new baseboard, door casings, as needed, for all finished areas. Baseboard is described as 3 '/4 inch Colonial Standard Baseboard. Casings is described as 2 '/4 Colonial Molding ➢ Materials Supnlied by Contractor ➢ Contractor will supply and install all materials and fixtures. A Flooring No flooring is supplied by way of this agreement. ➢ Paintin No painting is supplied by way of this agreement 15.Stairway ➢ Contractor shall finish concrete wall at mid-point landing of staircase. At the client's decretion, contractor shall fabricate a shelf — like projection to appear as a shelf. ➢ Contractor shall create an angled wall on left hand side of lower stair case. ➢ Contractor shall finish area under landing and step. ➢ The staircase shall be reface, both risers and rough unfinished threads to properly accept carpeting. 16.Cabinetry & Shelving Contractor shall fabricate and install the following cabinets: ➢ A cabinet, approximately 39 inches wide and as tall as the ceiling will allow. This cabinet shall be approximately 15 inches deep. The lower section shall be enclosed with 2 doors, as described above. The upper section will be open shelving. Height of lower section shall be dictated by homeowner's personal preference. ➢ A home entertainment center(HEC), which is approximately 10 feet wide and as tall as will be allowed so not to obstruct windows. The lower section shall have 6 doors as described above and shall be approximately 15 inches deep. The upper section shall be approximately 12 inches deep and shall have open C shelving and an area for a TV. The size of said TV shall be dictated by the homeowners. This cabinet shall be powered electrically for TV and accessory electronic equipment. It shall also be connected with cable. If possible, the center section of the HEC shall be deeper than the left and right section of the HEC. Homeowner acknowledges, that custom features as "arched moldings and angled cabinet structures" are not part of this agreement and all parties will work together to create a suitable HEC All cabinets shall be custom fabricated with cabinet grade plywood and finished with either clear pine or poplar. All doors shall be constructed of MDF composite materials for stability and are flush by design. All cabinets shall be sanded, nail holes filled and ready for paint. It is recommended that all cabinets be primed with oil based primer. ➢ Contractor shall supply and install White Wire Shelving at the following described locations: 1) 2 shelves as wide as possible on wall adjacent to foundation wall in under stairs closet. 2) 2 shelves as wide as possible on wall adjacent oil tank in the under stairs closet. 3) 2 shelves as wide a possible on concrete wall with window in the storage room adjacent to bulkhead. 16B. Fire Sprinklers Contractor will engage a licensed Fire Sprinkler Contractor to provide the necessary fire protection tasks. These tasked will include removing and re- installing new concealed sprinkler heads in finished area. The homeowner shall be allowed to seek alternate sprinkler contractor. This cost shall be paid by the homeowner directly to the Fire Sprinkler_ Contractor. Estimated cost of this task is approximatelt $1750 to $2000. 17. Scale Drawing ➢ Scale drawing attach shall be construed as an integral part of the proposal and agreement. All measurement are approximate and homeowners acknowledge the changes may be required due to building codes and obstacles in the unfinished basement. 18 Permitting —All permittingLees shall be billed back to homeowner as an additional charge. The requirement is for 2 permits on this proiect, one ,dor Building and one for Electrical. C 19. Provisions ➢ Homeowner acknowledges the following and hereby agrees to abide by these provisions: 1) Reasonable access must be made to the premises during working hours. 2) Working hours are from 6:30 AM through 5 PM on weekdays(Monday thru Thursday). Contractor may request the option of working on Friday and Saturday with homeowner's approval. Said approval shall not be unreasonably withheld. 3) The basement area is a construction site, therefore, children and pets should not be allowed in this area. 4) All ' personal property must be removed from construction site and contractor shall not be held responsible for this property, or stowed in areas that will not be finished. Bulkhead entry, electrical panel, water main shut- off, and sprinkler system may not be obstructed with personal property. Every effort will be made to protect homeowner's personal property, however, contractor cannot not be responsible for any personal property left in the basement area. 5) Quite often, communications concerning the project and questions regarding the project will be done via "E-Mail". Homeowner agrees to reply immediately and acknowledges that these communications shall become a part or a change to this agreement. 6) Homeowner authorizes the reasonable use of bathroom facilities. 20.Entire Agreement: Homeowner acknowledges that this agreement is the entire agreement between all parties. Any changes to this agreement must be done in writing or memorialized by an email. Changes to this agreement may result in additional charges.
