The ESA included a records review and database file search,a reconnaissance of the Subject Property Area,alimited subsurface investigation(including test boring and monitoringwell installations, soil and groundwater sampling and well survey) and ESA evaluation and reporting. 1.1 Summary of Findings I I The data and observations made during this assessment, in conjunction with site files and records collected and reviewed during this ESA of the Subject Property, located at 1429 Osgood Street in North Andover,Massachusetts indicates that limited past releases of oil or hazardous materials did occur at the property but at this time no further actions under federal or state law are necessary at the Subject Property. The following environmental observations are made regardingthe 1429 Osgood Street property: • The Subject Property consists of approximately 1.99 acres of land occupied by one building structure as described on the Town of North Andover, MA Assessors Listing as Map 34 Lot 20; • One concrete brick frame, slab concrete foundation building,reportedly built in the early 1970s is located on the Subject Property lot; • The Subject Property building is currently vacant and has been reportedly not occupied since 2000; • The current owner of record for the Subject Property is Technical Training Foundation Trust. The property has been unoccupied and not in use since 2000. From 1970 to 2000 MRC Realty,was listed as the p rop erty owner and the property was utilized between 1972 -2000,as a manufacturing/preci i n machining facility of electronic metal components for radar and microwave devices; • Site reconnaissance of the property during this ESA did not indicate any significant surficial staining or stress vegetation around the outside of the Subject Property building and adjacent land; Phase 1/Stage 1/2 Level Two Environmental Site Assessment - 1429 Osgood Street-North Andover,MA May 10,2010 HYDROTERRII F_NVIRONMENDIL SFR VICES Aa 1-2 Formerly three septic leachfields and a dry well were located on the Subject Property. Currently the property is serviced with Town of North Andover water and is heated with an oil fire burner; • Groundwater was encountered at depths of 1 to 3 feet below ground surface on the Subject Property. Local groundwater flow across the Subject Property is expected to be to the northwest. The Subject Property is not within an aquifer protection zone or a mapped potential productive aquifer. No areas of critical environmental concerns, such as fish habitats or threatened or endangered species were mapped within 500 feet of the Subject Property; • No significant storage of chemicals or hazardous materials was currently observed on the Subject Property. Historical data indicates that several hazardous materials storage areas existed within and immediately outside of the property building. The chemicals stored were associated with machining of electronic metal components for radar and microwave devices; • No visual indication of underground storage tanks (USTs)(such as vent pipes or manhole tank covers)were observed on the property. No Subject Property UST records were available at the North Andover Fire Department. Two 275-gallon above ground storage tanks (ASTs) containing No. 2 fuel oil were encountered in the southeast interior edge of the Subject Property building, • File review data indicated several local sites on state and federal environmental databases. Based upon distance away from the Subject Property and topography, none of these sites are believed to represent a potential risk to the environmental conditions on the Subject Property; In 1985,the owner of the Subject Property received a Notice of Responsib>lrty from the Commonwealth of Massachusetts concerning the release of hazardous materials into the soils and groundwater via dry well discharges. An LSP Evaluation Op inion concerning the release was submitted on May 9, 1995. The LSP opinion indicated that a reportable release has or may have occurred at the site, but that response actions completed prior to the date of the opinion meet the requirements of a Response Action Outcome; • No sources of PCBs were observed inside or directly outside of the Subject Property building. No asbestos appearing insulation was observed, however no testing for ACMs was performed during this ESA. No testing for lead, asbestos or PCBs in building materials was p erformed during this ESA; Phase 1/Stage 1/2 Level Two Environmental Site Assessment - 1429 Osgood Street-North Andover,MA May 10,2010 HYDROTERRA F_NVIRONMENTAL SERVICES 1-3 • Subsurface soil samples collected from the Subject Property borings indicated that Volatile Organic Compounds (VOCs) ,Total Petroleum Hydrocarbons(TPHs)and RCRA metals were below Massachusetts Contingency Plan (MCP) Reportable Concentrations (S1-RCs); • No RCRA metals, VOCs, or TPHs were detected above MA - MCP Reportable Concentrations (GW-1 RC)in the groundwater samples collected from the Subject Prop erty. The following environmental recommendations are made regarding current environmental conditions at the 1429 Osgood Street property: • Removeany miscellaneous debris,old unused equipment and damaged wooden sheds from the Subject Property building and outside property; • Maintain proper security and inspection of the Subject Property to prevent any future disposal and dumping of any hazardous materials on the exterior lots and within the storage building;and • Decommission, and close the damaged former industrial water supply well. Phase 1/Stage 1/2 Level Two Environmental Site Assessment - 1429 Osgood Street-North Andover,MA May 10,2010 HYDROTERRA F_NVIRONMENTAL SERVICES 2-1 2.0 INTRODUCTION HYDROTERRA was contracted by Mr. Justin Belliveau of Windover Development, LLC to conduct a Phase 1, Stage 1/2,Environmental Site Assessment (ESA) at the approximate 1.99-acre property located at 1429 Osgood Street in North Andover,Massachusetts(Subject Property). The Subject Property location is shown on Figure 1. The boundaries,abutting properties and layout are shown on Figures 2 and 3. Photos of the Subject Property are included in Appendix A. 2.1 Purpose The purpose of this ESA is,to the extent feasible,to recognize any current environmental conditions in connection with the Subject Property. Recognized environmental conditions mean the presence or likely presence of any hazardous substances or petroleum products on a property that indicate an existing release, a past release,or a threat of a release of any hazardous substances or petroleum products on the property grounds,groundwater,orsurfacewater. This ESA is intended to update and supplement the Phase EnvironmentalAssessment and Massachusetts Continency Plan(MCP) Site Release Conditions Information (RTN # 3-0075) completed in 1995 by New England Environmental Technologies Corporation(MEET)(portions of that report are included in Appendix B). 2.2 Work Scope and Methodology This ESA was composed of the individual tasks described below. 1. Records Review and Database File Search; 2. Reconnaissance of the Site Area; 3. Limited Subsurface Investigation; and ♦ Test Boring and Monitoring Well Installation; ♦ Soil and Groundwater Sampling;and ♦ Well Survey 4. Evaluation and Reporting Phase 1/Sta e 1/2 Level Two Environmental Site Assessment - 1429 Osgood Street-North Andover,MA May 10,2010 8 8 Y HYDROTERRA ENVIRONMENTAL SERVICES 2-2 2.2.1 Records Review The purpose of the records review was to obtain and review records that would aid in the identification of recognized environmental conditions in connection with the subject property. Standard environmental record sources were searchedby Environmental Data Resources,Inc.(EDR) of Southport, Connecticut utilizing a computer search methodology of relevant Federal and State government databases. The computer search of available environmental records was conducted in accordance with the specific requirements of ASTM Standard Practice for Environmental Site Assessments, E1527-97. The computer search included the following databases and search radii: Federal ASTM Records: 1. CERCLIS-Comprehensive Environmental Response,Compensation,and Liability Information System; 2. ERNS-Emergency Response Notification System; 3. NPL-National Priority List;and 4. RCRIS-TSD -Resource Conservation and Recovery Information System; State of Massachusetts ASTM Records 1. MA CERCLA- State Superfund(0.5 Miles); 2. MA Landfill- Solid Waste Facility Database/Transfer Stations (0.5 miles); 3. UST -Registered Underground Storage Tank Listing(0.5 Miles); and 4. LUST -Leaking Underground Storage Tank Database(0.5 Miles) A more detailed description of these databases is contained in the EDR report (Appendix C). In addition to the computer database search outlined above,HYDROTERRA contacted the following local sources in reference to recognized environmental conditions at and adjacent to the Subject Property. 1. MADEP Hazardous Waste Spill and Natural Resources Files (Wilmington, MA Office); 2. North Andover Fire Department 3. North Andover Board of Health and Building Department 4. North Andover Engineering Department;and 5. North Andover Tax Assessor's Office Phase I/Stage 1/2 Level Two Environmental Site Assessment - 1429 Osgood Street-North Andover,MA May 10,2010 HYDROTERRA ENVIRONMENTAL SF,RY/CES 2-3 HYDROTERRA reviewed historical aerial photographs from 1977, 1985, 1986,1991, 1998, and 2006 showing the area on which the Subject Property is located, to establish the physical setting of the property,and historical uses oftheproperty andthe surrounding area. Thesemaps are included in Ap p endix C. The file review indicated that there were no Sanborn Insurance Maps for the subject property. 2.2.2 Reconnaissance of the Site Areas I The objective of the reconnaissance of the site area was to obtain information indicating the likelihood of identifying recognized environmental conditions in connection with the Subject Property. Site inspections of the Subject Property and surrounding area were conducted on April 2, 7, and 9, 2010. HYDROTERRA personnel visually and physically observed the Subject Property. The property boundaries are shown on Figures 2 and 3. Photos of the Subject Property are included in App endix A. 2.3 Previous Site Environmental Investigations Completed An initial ESA(Phase I)subsurface investigation was undertaken by NEET at the Subject Property in January 1995. Portions of this investigation report are included inAppendixB. The purpose of this investigation was to develop aLicensed Site Evaluation Opinion,relative to past discharges of industrial wastewater at the site. The discharges were to a dry well at the site, and were stopped in 1985. The following is a summary of the findings/conclusions of the 1995 Phase I Investigation: ► Oil and hazardous materials were used and stored at the site. Prior to 1985 no hazardous waste manifests were available. Manifests after 1985 indicate proper disposal of the spent chemicals; ► Low levels of VOCs were detected in each of the monitoring wells at the site. 1,1,1- Dichloroethylene and Vinyl Chloride in MW2 exceeded the MCP's Reportable Concentrations for RCGW-2 groundwater. These compounds did not exceed their applicable GW-3 standards; ► Potential sources for the VOCs include residual contamination related to the former dry wellat the Subject Property, or poor practices related to the use ofOHM prior to 1985; ► No VOCs were detected in the industrial water supply well at the site, or in the stream on the site; Phase 1/Stage 1/2 Level Two Environmental Site Assessment - 1429 Osgood Street-North Andover,MA May 10,2010 HYDROTERRA ENVIRONMENTAL SERVICES 2-4 ► Low levels of metals were detected in 3 monitoringwells but the levels did not exceed the M CP standards;and ► Low levels of metals near the former dry well location did not exceed the M CP RCS- 1 Reportable Concentrations. 2.4 Supplemental Limited Subsurface Investigation Test Boring and Monitoring Well Installation HYDROTERRA oversaw the drilling of six(6)test borings and the installation of six(6)monitoring wells at the Subject Property. The locations of the borings/wells are shown on Figure 3. Borings were drilled using a truck mounted geoprobe drill rig. Soil samples were collected and visually inspected and classified in the field by a field geologist for geologic classification and evidence of contamination. Observations were recorded on Test Boring/Monitoring Well Installation Logs(see App endix D). In addition to visual classification, boring soil samples were screened for total ionizable volatile organic vapors usinga Photovac MicroTip HL-2000 photoionization detector(PID)equipped with a 10.6 eV lamp. Soil samples were placed in glass jars and allowed to equilibrate for approximately 15 minutes prior to screening. The PID was then employed to measure the concentration of ionizable volatile organic vapors which have collected in the headsp ace of the jars. Soil PID readings are included on the Test Boring/Monitoring Well Installation Logs (Appendix D). The monitoring wells were constructed using 1" I.D., flush threaded,machine slotted, schedule 40 PVC well screen (0.010" slot size) flush threaded to the matching PVC riser. The wells were installed such that the observed water table intercepts the screened interval of each well. All monitoringwell installation details were documented ontheTest Boring/M onitoringWellInstallation Logs(AppendixD). Table 1 summarizes the Subject Property monitoring well construction details and groundwater elevation measurements. Soil and Groundwater Sampling HYDROTERRA collected soil and groundwater samples from the test borings/monitoring wells during this limited subsurface assessment. Based upon field screeningof soil samples from the test boring soils,selected composite soil samples were submitted to Alpha-Woodshole Labs for analyses of: 1. Total Petroleum Hydrocarbons (HT-1 -5 and HT-6)T to 6'bgs; 2. RCRA Metals (Method 6010b/7471a) (HT-1 -5 and HT-6) T to 6'bgs; and 3. Volatile Organic Compounds (VOCs) (Method 8260b)(HT-1-5 and HT-6)T to 6'bgs. Phase 1/Stage I/2 Level Two Environmental Site Assessment - 1429 Osgood Street-North Andover,MA May 10,2010 HYDROTER21 ENVIRONMENTAL SERVICES 2-5 Groundwater samples were collected from the three newly installed monitoringwells(HT-1 (TPH), HT-2(VOCs and RCRA Metals),HT-3 (VOCs,TPH, RCRA Metals,HT-4(TPH),HT-5(TPH), and HT-6 (VOC,TPH and RCRA M etals)on the Subject Property. Refer to Figure 3 for locations. The groundwater samples were preserved with the appropriate preservatives and stored on ice until delivery to the laboratory. The Chain of Custody and Laboratory Report for the samples collected are included in Appendix D. Well Survey HYDROTERRA surveyed the elevations of the top of the PVC monitoring well casings. All elevations were referenced to an assumed elevation(111.00'). On April 9, 2010, HYDROTERRA collected depth to groundwater measurements in the wells on the Subject Property. All depth measurements were referenced to the top of the PVC well casing so that the elevation of the groundwater table could be computed to determine groundwater flow direction. Table 1 summarizes the Subject Property groundwater elevation measurements. The location of the Subject Property is shown on the Subject Property Location USGS Map,Figure 1. The Subject Property consists of approximately 1.99 acres of land occupied by one building structure. The land is developed by a one story brick,wood and concrete floor slab,and contains no basement. Small wooden add-on storage structures are located along the rear eastern portion of the Subject Property building. Records indicate that the original portion of the building may have been constructed in 1970,with additions added over time. The remainder of the Subject Property is mostly paved. Currently thebuildingis vacant. Reportedly the area on the south side of the building had been used as an employee parking lot, and the area on the north side of the building had been used for incoming and outgoing shipments of products and supplies. Figure 2 (Subject Property Abutters Sketch)shows theboundaries of the Subject Property and surrounding properties. Figure 3 (Subject Property Sketch) shows the boundaries and current layout of the Subject Property, as well as ESA sampling locations. The property is zoned manufacturing. The subject neighborhood is characterized primarily by open land property and a landscap ingequipment staging area within 1/4 mile(see Figure 2 for abuttingprop erties). City tax information for the Subject Property is included in Appendix C. 3.1 Physical Description and Layout The Subject Property is relatively flat with land surface elevations between 10 and 112 feet above mean sea level, slop ingto the northwest (see Figure 1). Osgood Street borders the property to the west. Further west across Osgood Street is open land(buffer areas for the Lawrence Airport and a landfill). Directly to the east and south are undeveloped wooded lots and farm land. To the north is Peter Breen Landscaping business and further north are residential homes and commercial businesses. Abutting properties are shown on Figure 2. No significant environmental complaints or violations were on file with the Town ofNorth Andover Health,BuildingDepartment or Fire Department. Fire Department records are included inAppendix C. Site reconnaissance performed by HYDROTERRA on April 2,7 and 9, indicated no significant staining or stress vegetation alongthe outside portions of the property,including the loading bays, air vent/ducts,roof drains and dump ster locations(see Site Photos-AppendixA). Insp ection of the interior of the Subject Property building revealed storage of various metal staging equipment, bathrooms/sink area and office space(see Site Photos -Appendix A). The concrete floor was in good condition with the exception of an area of broken floor which exposed underlying soil observed around the compressors located in the northeast corner of the building. The Subject Property is serviced by municipal drinking water supplied by Lake Cochichewick located approximately 4,200 feet south and upgradient of the site. The building formerly utilized a drilled well for its supply of industrial water(see Figure 3). When occupied,the Subject Property was serviced by three septic leachfield systems for disposal of sewage. The older system is located on the east side of the building. The second is located under the parking lot on the southwest side of the property near the main entrance and the third is located along the northwest edge of the Subject Property building(see Figure 3). Electric power is provided to the Subject Property via overhead electrical lines. A portion of the electric service for the site is directed below ground at a p oint on the north side of the p rop erty,with the electric line running underground from a utility p ole on the north side of the site, to an electrical transformer located in an alleyway adjacent to the building. 3.2 Subject Property Hazardous Materials The Subject Property building is currently heated by an oil fired burner located along the southeast interior edge of the the Subject Property building(see Figure 3). Two 275-gallon, No. 2 fuel oil Above Ground Storage Tank(ASTs)are located in a storage room adjacent to the burner(see ASTs Photos -Appendix A). No visual indication of underground storage tanks(USTs)was observed on the property.The Town of Andover Fire Department reports no record of underground storage tanks on or adjacent to the site(see Appendix Q. Former Release ConditionslViolations In 1985,Microwave received a Notice ofResp onsibility from the Commonwealth of Massachusetts concerning the release of hazardous materials into the soils and groundwater at the site. The cleaning and brightening process at the facility generated wastewater that was acidic and contained metals including lead, copper, and chromium, as well as nitrates, fluorides, oil and grease. Samples of this wastewater were analyzed and found to contain lead and chromium. Notice of Responsibility information is included in Appendix B. No Response Action Outcome Statement (RAO)was submitted although the box indicated on the LSP opinion clearly stated that one was necessary. The LSP Opinion and RAO Submittal information is included in Appendix B. Air Discharzes Several small vents were noted on the Subject Property building(see buildingphotos-AppendixA). These vents were not in use during the April 2010 site visits and no odors were noted at the vent locations. Polychlorinated Biphenyls (PCB) An electrical transformer was noted in a small alleyway along northern side of the Subject Prop erty (see Figure 3). This transformer appears in good shape with no evidence of leaks and is not likely to contain PCBs. No other sources of PCBs were observed inside or directly outside of the Subject Property building during the April 2010 site inspections. Asbestos Containing Materials (ACM) No asbestos,asbestos containing materials (ACM s) or asbestos appearing building materials were noted in either the outside or inside the Subject Property building during the April 2010 site inspections,however no testing for ACM s was performed during this ESA. Lead Containing Materials No lead containing building materials were noted during the April 2010, site inspections,however no testing for lead in the onsite building was p erformed during this ESA. 3.3 Surrounding Property Land Use The surrounding properties and uses are shown on Figure 2. Table 2 summarizes the uses of the properties surroundingthe Subject Property. Lawrence Airport and landfill) Surface water and groundwater are likely to flow away fromthe Subject Property 3.4 Property Ownership and Use The current owner of record for the Subject Property is Technical Training Foundation Trust(Essex Registry of Deeds, Northern District - Book 05901, Page 0156. Deed information is included in Appendix C. City assessor information and property deed information obtained during this ESA indicatedthat this ownerhas owned the property since October 26, 2000 andthat theproperty has been unoccupied and not in use since 2000. From 1970 to 2000 MRC Realty, was listed as the propertyowner. Basedupon file review and historical photographs,the property was undeveloped land prior to 1970. The Subject Property was utilized between 1972 -2000, as a manufacturing/precision machining facility of electronic metal components for radar and microwave devices.Figure 4 includes the layout of the former manufacturing footprint and building uses during the facility operations. Material Safety Data Sheets of the common chemicals and hazardous materials used during facility operations are included in Appendix C. Phase 1/Stage 1/2 Level Two Environmental Site Assessment - 1429 Osgood Street-Noah Andover,MA May 10,2010 HYDROTERRA ENV/RONMENTA/_SF,RVICES 3-5 3.5 Identified Environmental Receptors 3.5.1 Residential Population Estimate A Subject Property vicinity inspection indicates that the residential population within one half mile of the Subject Property is estimated to be between 1,000 and 1,200 people. The closest residential property is located north of the Subject Property (see Figure 2). 3.5.2 Natural Resource Areas Accordingto the Massachusetts GIS environmental database(see MA GIS Map Figure 5),no areas of critical environmental concerns, such as fish habitats or threatened or endangered species were mapped within 500 feet of the Subject Property. The following potential sensitive receptors in the vicinity of the Subject Propetry include: ► Lake Cochichewick, located approximately 4,200 feet south and upgradient of the site; ► Town of Methuen municipal water supply wells,located approximately onemile west and downgradient to crossgradient of the site; and ► An unnamed brook flows past the site and could be subject to discharge of groundwater from the site. The Subject Property does not lie within a mapped groundwater protection zone or a productive aquifer. The subject and neighboring properties are serviced by the Town of North Andover municipal water supply. No public water supplies are mapped within 1/2 mile of the Subject Property and no private water supply wells are mapped with 1/4 mile of the property (see Figure 6). The Subject Property does have an industrial water supply well located along the northeastern edge of the property as shown on Figure 3,formerly used for machiningprocess water. The Subject Property does not lie within a aquifer protection zone or ap otential productive aquifer. The Subject Property does not lie within a mapped groundwater protection zone or a productive aquifer. Phase 1/Stage 1/2 Level Two Environmental Site Assessment - 1429 Osgood Street-North Andover,MA May 10,2010 HYDROTERRA ENVIRONMENT11L SERVICES 3-6 3.6 Limited Subsurface Investigation Summary The following sections describe the findings of the subsurface investigation conducted during this ESA. 3.6.1 Hydrogeology Top�raphy/Draina According to the USGS Topographic Map of the Lawrence,MA Quadrangle(1993) (see Figure 1), the elevation of the Subject Property is between 110 and 112 feet above mean sea level with topography sloping to the northwest. Surface water drainage alongthe western paved parking area of the Subject Property is sheet flow in a southwest direction towards a small stream located at the southern edge of the Subject Property. As shown on Figure 3, this stream flows northward under Osgood Street via an underground culvert. Drainage across the eastern portions is immediately eastward from the building structure to a small wetland along the eastern edge of the Subject Property. These wetlands drain northward and southward alongthe edge of the property. Surface water drainage alongthe remaining portions of the property is from an eastward flowing sheet flow, and from parking storm drains that flow towards a small drainage basin located alongthe eastern side of Osgood Street. The Subject Property is not within the 100-year flood zone. Subsurface Geology Soil sampling observation from test borings drilled as part of this ESA (see test boring logs - AppendixD)�indicated that soils at the Subject Property consisted of sandy till. Bedrock led�was not drilled at the Subject Property but regional geologic information reviewed during this ESA suggest that bedrock ledge is between 10 and 15 f eet below grade at the Subject Property. Bedrock is reportedly mapped as a Silurian aged intrusive,Eugeosynclinal Deposit (Se). Groundwater Flow As shown on Table 1, groundwater was encountered at depths of 1 to 3 feet below ground surface on the Subject Property with local groundwater flow across the property expected to be to the northwest discharging to the northwest flowing small stream. It is HYDROTERRA's opinion,based upon distance away from the Subject Property and topography these sites do not represent a possible risk to the Subject Property if a release were to occur. US T/LUS T:A List of Underground Storage Tanks was obtained fromthe M ADEP. These sites have the potential to effect environmental conditions on the Subject Property. One(1)Underground Storage Tank(UST)and no Leaking Underground Storage Tank(LUST) sites were listed within 1/4 mile of the Subject Property (see Figure 7 and the EDR report in Appendix Q. It is HYDROTERRA's opinion,based upon distance away from the Subject Property and topography, the registered USTs identified represent little or no risk to the environmental conditions on the Subject Property. Dry Cleaners: A List of dry cleaners was obtained from the MADEP. These sites have the p otential to effect environmental conditions on the Subject Property. No dry cleaners were identified within 1/4 mile of the Subject Property. S olid Waste/Landfill Sites:A List of Solid Waste Disposal Site Storage Tanks was obtained from the MADEP. These sites have the potential to effect environmental conditions on the Subject Property. One(1)Landfill Site was listed within 1/4 mile of the Subject Property (see Figure 7 and the EDR report in Appendix Q. It is HYDROTERRA's opinion,based upon distance away from the Subject Property and topography, the landfill represents little or no risk to the environmental conditions on the Subject Property. Phase I/Stage 1/2 Level Two Environmental Site Assessment 1429 Osgood Street-North Andover,MA May 10,20 10 HYDROTERRA F.NURONMENTAL SERVICES 5-1 5.0 CONCLUSIONS AND RECOMMENDATIONS HYDROTERRA Environmental Services LLC (HYDROTERRA) was contracted by Mr. Justin Belliveau, Esq. of Windover Development,LLC to conduct a Phase 1,Stages land 2,Environmental Site Assessment ESA at the property located at 1429 Osgood Street in North Andover, (ESA) p p Y 1� Massachusetts. The ESA included a records review and database file search,a reconnaissance of the Subject Property Area, a limited subsurface investigation(including test boring and monitoring well installations, soil and groundwater sampling and well survey) and ESA evaluation and reporting. 5.1 Summary of Findings The data collected, and observations made duringthis assessment,in conjunction with site files and records collected and reviewed during this ESA of the Subject Property, located at 1429 Osgood Street in North Andover, Massachusetts indicates that limited past releases of oil or hazardous materials did occur at the property but at this time no further actions under federal or state law at the Subject Property are necessary. The following environmental observations are made regarding the 1429 Osgood Street property: • The Subject Property consists of approximately 1.99 acres of land occupied by a single building structure as described on the Town ofNorth Andover,MA Assessors Listing as Map 34 Lot 20; • One concrete brick frame, slab concrete foundation buildingis located on the Subject Property lot. It was reportedly built in the 1970s; • The Subject Property building is currently vacant and records indicate that it has not been occupied since 2000; • The current owner of record for the Subject Property is Technical Training Foundation Trust. The property has been unoccupied and not actively used since 2000. From 1970 to 2000 MRC Realty,was listed as the property owner and the property was utilized between 1972 - 2000,as a manufacturing/precision machining facility for electronic metal components for radar and microwave devices; • Site reconnaissance of the property during this ESA did not indicate any significant surficial staining or stress vegetation around the outside of the Subject Property building and adjacent land; Phase I/Stage 1/2 Level Two Environmental Site Assessment - 1429 Osgood Street-North Andover,MA May 10,2010 HYHROTERRA F_NIQRONINEA'TAL SF.RIgCES � 5-2 • Formerly three septic leachfields and a dry well were located on the Subject Property. Currently the prop erty is serviced with Town of North Andover water and is heated with an oil fire burner; • Groundwater was encountered at depths of 1 to3 feet below ground surface on the Subject Property. Local groundwater flow across the Subject Property is expected to be to the northwest. The Subject Property is not a zone of contribution/recharge for a water supply well. No areas of critical environmental concerns, such as fish habitats or threatened or endangered species were mapped within 500 feet of the Subject Property; • No significant storage of chemicals or hazardous materials was observed on the Subject Property duringthis investigation. Historical data indicates that hazardous materials storage areas existed both within and immediately outside of the property building.The chemicals stored were associated with the machining of electronic metal components for radar and microwave devices; • No visual indication of underground storage tanks (USTs)(such as vent pipes or manhole tank covers) was observed on the property. No Subject Property UST records were available at the North Andover Fire Dep artment.Two 275-gallon above ground storage tanks (ASTs) containing No. 2 fuel oil were identified inside the southeast interior corner of the Subject Property building; • File review data indicated several local sites on state and federal environmental databases. Based upon distance away from the Subject Property and topography, these sites are not believed to represent a potential risk to the environmental conditions on the Subject Property; In 1985,the owner of the Subject Property received a Notice of Responsibility from the Commonwealth of Massachusetts concerning the release of hazardous materials into the soils and groundwater via dry well discharges. An LSP Evaluation Opinion concerning the release was submitted on May 9,1995.The LSP opinion indicated that a reportable release had or may have occurred at the site, but that response actions completed prior to the date of the opinion meet the requirements of a Response Action Outcome; Phase 1/Stage 1/2 Level Two Environmental Site Assessment - 1429 Osgood Street-North Andover,MA May 10,2010 1 HYDROTERRA ENI MONMENTAL SERVICES 5-3 • No sources of PCBs were observed inside or directly outside of the Subject Property building. No asbestos appearing insulation was observed, however no testing for ACMs was performed duringthis ESA. No testing for lead, asbestos or PCBs in building materials was performed during this ESA; • Subsurface soil samples collected from the Subject Property borings indicated that Volatile Organic Compounds (VOCs),Total Petroleum Hydrocarbons (TPHs)and RCRA metals were below laboratory detection limits and below MCP Reportable Concentrations (S1-RCs); • No RCRA metals, VOCs, or TPHs were detected above MA - MCP Reportable Concentrations (GW-1 RC) in the groundwater samples collected from the Subject Prop erty. The following environmental recommendations are made regarding current environmental conditions at the 1429 Osgood Street Street property: • Remove any miscellaneous debris,old unused equipment and damaged wooden sheds from the Subject Property building and outside property; • Maintain proper security and inspection of the Subject Property to prevent any future disp osal and dump ing of any hazardous materials on the exterior lot and within the storage building and • Decommission, and close the damaged former industrial water supply well. Project Schedule Initial investigation work began on this project on February 26, 2010. Based on a building permit being issued by the City on August 23, 2010 the project will be substantially complete and ready for use by October 15th, 2010. Payment Terms A schedule of values will be prepared and approved by the Technical Training Foundation prior to the first billing. Windover will requisition for periodic payments on a monthly basis based on percent complete of each trade in the schedule of values. Requisitions for payment will be submitted on the I"day of each month and due on the 15h of the same month. Prior to submitting the final payment, Windover will prepare a report of all costs to date with backup as required by the Technical Training Foundation. Any savings as described above will be credited back via change order. 5% retainage will be held on each payment for the first 50% of the project after which no additional retainage shall be withheld. Retainage will become due and payable with the final requisition with the exception that the Technical Training Foundation may elect to withhold a value of 150% of any outstanding punch-list items. Retainage may be reduced at any time with the consent of both parties. Changes in the Work Any changes in the scope of work and approved by the Technical TrainingFoundation will adjust this agreement by change order. For any increase in the scope of the project with a corresponding increase in construction costs, the construction manager's fee shall be adjusted by 10% of the cost of the change. For any decreases in the scope of the work, the construction manager's fee will remain unchanged. (ATC) of Woburn, Massachusetts was retained by Windover Construction to perform a Hazardous Materials Inspection of the vacant industrial/warehouse buildings located at 1429 Osgood Street, North Andover, Massachusetts. The limited survey included an inspection of accessible building sections, common areas, offices, mechanical rooms and storage rooms to determine the presence of Asbestos Containing Material(ACM), Lead Containing Paint(LCP),and Other Hazardous Materials(OHM). 1.1 Asbestos Section 2.0 discusses the asbestos-containing materials (ACM) survey and sampling methodology. This survey involved a visual inspection, bulk sampling and inventory of suspect ACMs, including locating, quantifying and assessing the condition of the identified ACM. The asbestos survey was performed by Massachusetts Division of Occupational Safety (DOS) certified Asbestos Inspector Mr. Robert Verdi (AI-021621), on March 5, 2010. A total of sixty one (61) samples of suspect ACM were collected, with forty three (43) analyzed to determine asbestos content. The remaining eighteen (18) samples were not analyzed but are considered ACM since the samples are homogeneous to other samples that were analyzed and determined to be ACM. The ATC inspector performed both the visual inspection and bulk sampling in the building according to methods outlined in the U.S. Environmental Protection Agency (EPA) guidance document titled, "Guidance for Controlling Asbestos-Containing Materials in Buildings" (Document No. 560/5-85-024). Please find the ProScience Analytical Services, Inc. Polarized Light Microscopy(PLM)bulk sample results included as Appendix A. The estimated cost to remove all identified ACM is approximately$66,000. Note that the cost estimate does not include the cost of asbestos project monitoring services which typically add approximately 10% -20%to the cost of abatement. 1.2 Lead Containing Paint Determination ATC performed a visual inspection of representative painted surfaces buildings to note areas where damage was present. Testing of damaged surfaces was performed to determine the lead content in the existing paint. The lead determination was performed by Mr. Harold Springer, a Massachusetts licensed Lead Inspector/Risk Assessor(license#M 3041). The testing was performed using an X-Ray Fluorescence(XRF) Analyzer— RMD LPA-1. Results of the lead determination indicate that damaged paint containing lead is present on various plaster ceilings and walls, wood, metal door frames and structural steel components. Results of the lead testing ranged from <0.0 mg/cm2 to 0.4 mg/cm2. Damaged paint in occupied areas that contains higher concentrations of lead could be repaired when financially feasible. Since the building is not considered a residential facility, lead abatement is not required under state/federal regulations, unless a daycare facility is present. Note that contractors performing work in the buildings where the painted surfaces will be impacted must comply with the Occupational Safety and Health Administration (OSHA) 29 CFR 1926.62 Lead in Construction. Additional waste disposal requirements is ma apply in accordance with EPA and MA DEP regulations. Table 111, found in Section 3.2 presents the findings of ATC's lead determination. ATC Project No. 060.39952.0001 Page i Windover Construction March 19, 2010 Limited Hazardous Materials Survey 1429 Osgood Street,North Andover, MA 1.3 PCB-Containing Electrical Equipment/Light Ballast and OHM Survey On March 5, 2010 ATC performed a hazardous materials survey within accessible areas of the structures designated for demolition/renovation located at 1429 Osgood Street, North Andover, Massachusetts. The structure included in the scope of work consists of a vacant warehouse/manufacturing area and vacant office spaces. The building is reportedly scheduled for demolition and/or renovation. The survey was performed by Mr. Madan Vlahovich. The objective of the hazardous materials survey was to evaluate the presence of polychlorinated biphenyl (PCB)-containing ballasts and electrical equipment, mercury-containing electrical and building components, and other potential hazardous materials including large chemical containers, refrigerants, and aboveground storage tanks that are integral components of the building that will require removal and disposal/recycling prior to the proposed demolition and/or renovation activities. Note that electrical cabinets containing electrical switches, breakers, and other electrical equipment were located in the Property building. Due to safety and logistical reasons, the cabinets were not opened during the OHM survey. However, there are typically no hazardous materials or components containing hazardous materials located within these types of electrical cabinets. Various fluorescent light ballasts,fluorescent light bulbs/tubes,mercury containing thermostats,rechargeable batteries, fire extinguishers,motors/pumps with lubricating oil, a transformer,an emergency generator,air conditioning compressors,and above-ground storage tanks were observed within the surveyed areas.The inspection and results are discussed in Section 4.0.This survey is representative only of items present as of the date of the survey. The total estimated cost for transport and disposal of the identified items is$13,308.00 as detailed in the table in Appendix B. Care should be taken when handling the inventoried materials. The materials should be disposed in accordance with applicable local, state,and/or federal regulations. 1.4 Limitations Our professional services have been performed, our findings obtained and our recommendations prepared in accordance with customary principles and practices in the field of environmental science and engineering. Bulk samples, representing individual homogenous areas of suspect materials, were collected in a randomly distributed manner, in accordance with the EPA methods outlined below where feasible. Building materials exist in the form of thermal systems insulation(TSI), surfacing materials and miscellaneous materials. The following generally illustrates the sampling strategy employed by ATC where feasible: (a) Surfacing materials—In a randomly distributed manner, collect bulk samples of surfacing materials,representative of each homogeneous area,and not assumed to be ACM. (1) Collect at least three bulk samples from each homogeneous area that is less than or equal to 1,000 ft2. (2) Collect at least five bulk samples from each homogeneous area that is greater than 1,000 ft2,but less than or equal to 5,000 ft2. (3) Collect at least seven bulk samples from each homogeneous area that is greater than 5,000 ft2. (b) Thermal systems insulation. (1) In a randomly distributed manner, collect at a minimum, three bulk samples of thermals systems insulation material representative of each homogeneous area, and not assumed to be ACM. (2) Collect, at a minimum, one bulk sample of patched thermal systems insulation, representative of each homogeneous area, and not assumed to be ACM, providing the section of patch was less than 6 linear or square feet. (3) Collect, at a minimum, three representative bulk samples of each insulated mechanical system not assumed to be ACM, including, but not limited to cementitious material used on pipe fittings such as tees, elbows or valves. Representative sampling was conducted in a manner sufficient as to identify whether each homogeneous area is either asbestos or non-asbestos containing. (4) Bulk samples are not required to be collected from any homogeneous area where the accredited asbestos inspector has determined that the thermal systems insulation is a non-suspect material (i.e. fiberglass, foam glass, rubber or any other non-ACM). (c) Miscellaneous materials — Collect, at a minimum, two representative bulk samples of each miscellaneous material not assumed to be ACM, including but not limited to ceiling tiles, floor tiles, associated floor mastic, etc. Representative sampling was conducted in a manner sufficient as to identify whether each homogeneous area is either asbestos or non- asbestos containing. Appropriate efforts were made in representative areas of the building, to identify multiple layers of flooring systems, as well as any suspect materials located within wall cavities, chases, plenums and above suspended ceiling systems. Note that ATC did not disassemble mechanical equipment or electrical gear that may have suspect ACM internal components, or perform an inspection below grade on foundation walls. The following table presents a list of the identified, confirmed ACM at 1429 Osgood Street located in North Andover Massachusetts. Note that an ACM is defined by the US EPA as any material or product containing more than one percent asbestos by weight, or one percent or greater according to the Massachusetts DEP. By using the PLM/DS method, a trained microscopist is able to identify and distinguish between asbestos group minerals and other fibrous materials such as cellulose (paper), mineral (rock), wood or glass fiber. The quantity of each of these substances is estimated on a weight basis and recorded as a percentage. Only the asbestos content, if any, is recorded in the bulk sample `Report of Analysis' (Appendix A). If a material contains greater than or equal to 1% asbestos in Massachusetts, it is considered to be asbestos-containing material. Upon client request, or at the recommendation of the analyst, the `Point Counting Method' may be used to verify the presence/absence of asbestos when a sample contains less than 10%asbestos by visual estimate. ProScience is certified by Massachusetts DOS (certification#AA 000 156)to perform all types of asbestos analysis. ProScience, is also accredited by the EPA National Voluntary Laboratory Accreditation Program (NVLAP). The PLM/DS analytical method is modeled after 40 CFR Part 763, Subpart F, Appendix A: "Interim Method for the Determination of Asbestos in Bulk Insulation Samples." 2.4 Consideration for Hidden Materials ATC did not perform exploratory demolition of chases, plenums, exterior wall cavities and below grade on the foundation, in an attempt to identify hidden ACM. Additional suspect materials may be present in these or other inaccessible areas,hidden areas,within mechanical equipment, etc.,that were not identified during the time of the survey. ATC recommends that if a suspect material has not been positively identified, but is similar in mode of occurrence or physical properties as other identified ACM, it should be considered asbestos-containing. Only through further sampling and analysis should a suspect material be identified as non-asbestos. ATC Project No. 060.39952.0001 3 Windover Construction March 19, 2010 Limited Hazardous Materials Survey 1429 Osgood Street North Andover MA 3.0 LEAD-CONTAINING PAINT DETERMINATION ATC performed a visual inspection of representative interior and exterior painted surfaces for evidence of damaged paint. Based on the visual inspection, a lead determination was performed on the damaged painted surfaces in the building. The lead determination was performed by Mr. Harold Springer, a Massachusetts licensed Lead Inspector/Risk Assessor (license # M 3041). The lead paint testing was performed using an X-Ray Fluorescence (XRF) Analyzer — RMD LPA-1 in accordance with the manufacturer's guidelines. 3.1 Summary of Findings Table 4 presents the results of the lead determination that was performed in the building. Results of the lead determination indicate that lead is present on various damaged painted surfaces and ranged in content from-0.0 to 0.4 mg/cm2. The surfaces with the highest lead content are generally window and door components. If the Facility wishes to prep these surfaces for repainting/refinishing, then the contractor performing this work must comply with OSHA's Lead in Construction Standard. Unless a daycare is resent at the Facility, lead Y p Y� abatement is not required. 3.2 Regulatory Implications and Regulations The implications of LCP existing in a non-residential building are related to the need to impact these painted surfaces during the renovation/demolition processes. The Occupational Safety and Health Administration (OSHA) does not acknowledge any quantitative threshold for a lead-based paint. Paint with a detectable amount of lead, regardless of the level, is recognized as a lead-containing paint. The possible exposure hazard to workers impacting these coasted surfaces should be assessed and contractors and their employees must adhere to OSHA Lead in Construction standard found at 29 CFR 1926.62. Although OSHA does no recognize negative XRF results as proof that paint does not contain lead, the use of XRF is an efficient real time screening technique for identifying lead-containing paints. To comply with OSHA requirements, a negative XRF result would have to be confirmed by other approved methods. Positive XRF results do not need to be confirmed. Regardless of analytical results, OSHA still requires that personal exposure monitoring be conducted when appropriate to determine lead exposure, even for zero results as determined p ed by any method. To fully comply with EPA regulations, sampling of demolition debris waste streams may be required, depending on the requirements of the receiving facility. ATC Project No. 060.39952.0001 5 Windover Construction March 19, 2010 Limited Hazardous Materials Survey 1429 Osgood Street,North Andover, MA OSHA recognizes that construction type work on surfaces coated with lead-containing paint has a potential to expose workers to hazardous levels of lead and requires that appropriate safety and health measures be followed as stated in 29 CFR 1926.62. OSHA states that until the employer performs an exposure assessment and documents that employees are not exposed above the permissible exposure limit (PEL) of greater than 50 micrograms per cubic meter (µg/m3) of air, the employer must treat employees as if they were exposed above the PEL for the following operations: • Manual renovation and demolition of structures,manual scraping, manual sanding and use of heat gun where lead-containing coatings or paints are present; • Abrasive blasting; • Power tool cleaning; • Lead burning; • Using lead-containing mortar or spray painting with lead-containing paint; • Abrasive blasting, rivet blasting or welding, cutting or burning on any structure where lead- containing coatings or paint are present; • Cleanup activities where dry expendable abrasives are used; and • Any other task the employer believes may cause an excess of the PEL. Work precautions include providing respiratory protection, protective work clothing and equipment, change areas,hand washing facilities,biological monitoring and training until an exposure assessment has determined that the work activity will result in an exposure below the PEL. Additional requirements under this standard include a written compliance program as well as record keeping. The survey consisted of an inspection of accessible portions of the Site,which included all of the Site building consisting of a vacant warehouse/manufacturing area and vacant office spaces. 4.1 Objective The objective of the hazardous materials survey was to evaluate the presence of polychlorinated biphenyl (PCB) containing ballasts and electrical equipment, mercury-containing electrical and building components, and other potential hazardous materials including large chemical containers, refrigerants, and aboveground storage tanks that are integral components of the building, which may require disposal as part of the future renovation or demolition of the building. 4.2 Scope of Work During the survey inspection, each accessible room/area was inspected for the presence of hazardous materials that will need to be properly disposed prior to renovation or demolition. Any inaccessible areas are noted in Section 4.4. The survey included containers of chemicals and built-in, integral building fixtures/appliances that could contain hazardous materials (such as refrigerant-containing air conditioners, PCB-containing transformers mercury-containing g fluorescent light bulbs). Any hazardous materials in containers or potential hazardous materials in building fixtures/appliances found during the survey were inspected and the contents,volume, condition, quantity, and area location were noted. The survey did not include hazardous materials associated with underground structures, underground tanks, oil/water separators,or materials behind finished walls/ceilings/floors of the surveyed areas. 4.3 Results A comprehensive list of potentially hazardous materials or items suspected to contain hazardous materials, as observed during the survey, is included in the table in Appendix B. A summary of the estimated costs associated with disposal of containers of hazardous materials or items suspected to contain hazardous materials is also included in the table in Appendix B. Certain white goods observed during the survey are not suspected to contain hazardous materials, such as fluorescent light fixtures (without ballasts). In addition, certain electrical components such as resistors, capacitors, and small dry-type transformers do not contain large quantities of liquid hazardous materials but do contain some metals such as lead and cadmium and therefore their recycling is encouraged by government agencies. These types of electrical components are present in minor quantities. Larger white goods and electrical components should be recycled per applicable local, state, and federal regulations. ATC Project No. 060.39952.0001 8 Windover Construction March 19, 2010 Limited Hazardous Materials Survey 1429 Osgood Street,North Andover, MA In some instances, ATC may not have been able to determine whether certain building components contained hazardous materials. In situations such as these, ATC has taken a conservative approach and assumed that the items do contain hazardous materials. A summary of several main categories of items containing hazardous materials is included in the following subsections. 4.3.1 Fluorescent Light Ballasts Fluorescent light fixture ballasts manufactured prior to 1979 may contain small quantities of PCBs. Recently manufactured fluorescent light ballasts do not contain PCBs and those manufactured between 1978 and 1998 were required to have "No PCBs" labels. Light ballasts that do not have "No PCBs" labels, unless known to be manufactured since 1998, should be treated as PCB-containing and handled/disposed of accordingly. Alternatively for light ballasts that do not have"No PCBs" labels, the manufacturer may sometimes be contacted to ascertain the presence of PCBs. ATC visually inventoried fluorescent light fixtures at the Site. The ballasts of representative fluorescent light fixtures within the surveyed areas were inspected, when accessible. "Representative" light fixtures were identified based on their similarity in shape, size, construction, and appearance to other fixtures within the same area. The results of the fluorescent light ballast inspections are included in the table in Appendix B. ATC inspected several representative light ballasts and observed "No PCBs" labels on the inspected light ballasts. No inspected ballasts were observed to be leaking at the time of the survey. 4.3.2 Fluorescent Light Bulbs/Tubes Fluorescent light 1 t contain g bulbs/tubes bs/ubes co tan small amounts of mercury, and therefore must be properly handled/disposed and/or recycled. An inventory of fluorescent light bulbs in the buildings was conducted. The bulbs were observed in-use in light fixtures as well as in storage boxes or loose. The result of the fluorescent light bulb inventory is included in the table in Appendix B. 4.3.3 Other Potential PCB-Containing Equipment Electrical cabinets containing electrical switches, breakers, and other electrical equipment were located in various closets and areas in the inspected areas. Due to safety and logistical reasons, the cabinets were not opened during the hazardous material survey. However,there are typically no hazardous materials or components containing hazardous materials located within these types of common small electrical cabinets. A large electrical transformer was observed on the north exterior side of the building. Dielectric fluid used in transformers prior to 1978 often contained PCBs. Based on the assumed age of the building; the Site transformer could contain dielectric fluid with PCBs. However, it is likely that the transformer is owned by the local electrical utility company, who would typically be responsible for maintenance and repair of the transformer. While removal and/or replacement of the transformer would most likely be paid for by the electrical utility, ATC has nonetheless included an estimated cost for disposal of the transformer in the table in Appendix B. The results of the other PCB-containing equipment inspections are included in the table in Appendix B. 4.3.4 Mercury-Containing Electrical Equipment Thermostats, thermometers, and pressure gauges sometimes contain mercury. In addition, mercury- containing switches were sometimes used on older heating boilers. Due to the non-destructive nature of ATC's inspection, thermostats/switches were not always dismantled during the survey. The covers of certain thermostats/switches that could be removed without significant effort were removed and the thermostat/switch inspected for the presence of mercury. Mercury-containing equipment such as thermostats and switches are inventoried in the table in Appendix B. 4.3.5 Other Hazardous Materials Various containers of hazardous materials (such as paint, cleaners, etc.), along with pieces of equipment or building components that could potentially contain hazardous materials, were observed during the survey. Any air conditioning compressors and window-mounted AC units observed during the survey are assumed to contain refrigerants such as freon or halon that needs to be drained and recycled before the units themselves can be disposed of as solid waste. Most rechargeable batteries were found in active emergency lighting fixtures, or emergency exit signs. Five stand-alone rechargeable batteries were observed stored in Area 8. One children's battery powered toy vehicle was observed in Area 8 as well, and likely contains a rechargeable battery. The inventory of other hazardous materials is provided in the table in Appendix B. 4.3.6 Storage Tanks Two aboveground storage tanks were observed at the rear of the main building. The tanks were approximately 500-gallons in size and were between one-quarter and half full based on gauges on the tanks. There was a small to moderate amount of oil staining on the concrete underneath the tanks. The inventory of storage tanks is provided in the table in Appendix B. Note that all storage tanks are listed in the {G miscellaneous itemsff section at the bottom of each table. 4.4 Access Limitations There were no inaccessible spaces in the surveyed buildings. ATC's inspection did not include 4.5 Conclusions Various fluorescent light ballasts, fluorescent light bulbs/tubes, fire extinguishers, rechargeable batteries, thermostats containing mercury, motors/pumps with lubricating oil, a transformer, an emergency generator, air conditioning compressors, above-ground storage tanks, and miscellaneous items were observed within the surveyed areas. Some materials and items may have been moved since the survey took place or may be moved in the future from the locations where they were observed. This survey is representative only of items present as of the date of the survey. Care should be taken when handling the inventoried materials. The materials should be disposed of in accordance with applicable local, state, and/or federal regulations. The total estimated cost for transport and disposal of the items identified in the table in Appendix B is$13,308.00 as detailed in the table in Appendix B. The costs provided are estimates only and a specific waste characterization may need to be completed for each item containing hazardous materials before final waste disposal costs can be determined.
