Service Bury,LLC is requesting confirmation from you,in accordance with Section 7 of M.G.L.c.40A,that the existing gasoline station/convenience store,as well as the proposed new building and related uses and activities as described in the attached application and site plans are permitted under the Town of North Andover Zoning Bylaw. The Property Service Bury LLC (the"Applicant") is the owner of an existing parcel of land known and numbered as 1503 Osgood Street. The site contains approximately 264,609 square feet (6.075 acres)of land and is designated on the Town Assessor's Maps as Map 34,Lot 7(the"Property"). The Pro Property is located on the souther] side of Osgood P h' Y g Street. The Property currently includes an existing 3,791 s.f.convenience store including a Dunkin Donuts drive-through,a 5-dispenser refueling facility with overhead canopy,along with a total of thirty(30)parking spaces,of which seven(7)spaces are land-banked (the"Existing Improvements"). The entire Property was rezoned to Business 2(B-2)as defined under Section 4.127 of the Zoning Bylaw when the 2005 Annual Town Meeting voted to adopt Article 41 of the North Andover Town Warrant. After the Property was rezoning, the Existing Improvements were constructed. After the Existing Improvements were constructed, the 2008 Annual Town Meeting voted to adopt Articles 37(Creation of New CDD 3 District) and 38 (Amended Zoning Map to include CDD 3 District)which rezoned the entire Property,along with other properties along this particular area of Route 125, to Corridor Development District 3 (CDD 3) as defined under Section 16 of the North Andover Zoning Bylaws. The Existing Improvements were constructed in 2007. Zoning Concerning the Existin Gas Station Improvements After the construction was complete,the Property was rezoned to CDD-3 at the May,2008 Annual Town Meeting. Section 9.1 of the Zoning Bylaw provides that any non-conforming building,structure,or use which Iawfully existed at the time of passage of the particular Zoning Bylaw may be continued in the same kind and manner and to the same extent as at the time is became lawfully nonconforming. Since the Existing Improvements were constructed prior to the enactment of the CDD 3 provisions of the Zoning Bylaw,we request that you confirm that the Existing Improvements constitute pre-existing lawful nonconforming structures and uses which may continue to be operated. We also note that the proposed Project will tie into the existing Title 5 septic system current serving the Existing Improvements,and request that you confirm that such tie-in to the Title 5 system and associated grading related to the proposed Project would not constitute a change,extension or alteration of the preexisting lawful nonconforming use and structure within the meaning of Section 6 of Chapter 40A, and Sections 9.1 and 9.2 of the Zoning Bylaw,so that no relief would be required from the Zoning Board of Appeals for such tie-in and associated grading. The Proposed Project Service Bury LLC proposes a redevelopment of the rear of the Property to include the following: (a)construction of new 16,527 s.f.building,including 4,127 s.f.of second floor office space;(b)construction of 28 new parking spaces;and, (c)landscaping,lighting,stormwater and other improvements shown on the site plans (the"Project"). The Project would be used for warehousing/storage as it relates to proposed uses,along with associated office uses. The Property is located entirely within the CDD 3 Zoning District. Zoning Concerning the Proposed Project As you know,the Applicant has filed an application for Site Plan Review with regard to the proposed Project. To this end,we are requesting zoning confirmation with respect to the following matters: P g 1. Wall Sign: The proposed wall sign is located on the front wall of the building, as indicated on the approved Site Plan. It consists of the Dunkin' Donuts logo, and is depicted on the attached plan as the "Stacked" Configuration with 12" Letters. The sign is 17.36 s.f., which is less than the 25 s.f. sign depicted on the approved plan, and significantly less than the maximum size sign permitted under section 6.6(D)(1)of the bylaws. The proposed sign will be externally illuminated by two "witch hat"fixtures mounted on gooseneck extensions, as depicted on the approved plans,portions of which are attached in Exhibit D,which 'results in light, "directed solely at the sign", as required by section 6.5(1)of the bylaws. 3. Directional Signs- There i ns:There are three proposed directional signs designed to facilitate organized traffic flow around the site and to maximize site safety. First,there is a, "Welcome Back" sign which is designed to help direct incoming vehicles to the appropriate side of the driveway. There is also a, "See You Tomorrow" sign designed to direct outgoing vehicles. Finally there is a, "Drive Thru" sign proposed to be located at the beginning of the drive-thru aisle. Each proposed directional sign is only 2.98 s.f., and therefore each is significantly less than the maximum sign permitted under section 6.6(D)(9) of the bylaws. Section 6.6(D)(9) allows for, "traffic control orientational and guidance signs" to be up to 4 s.f. in area. There is no illumination proposed for any of the directional signs. Based upon our review of the bylaws, it appears that all the proposed signs are consistent with the approved plans, are permitted by right and therefore do not require further relief. The site contains 264,609 square feet(6.1 acres) of land and is designated on the Town Assessor's Maps as Map 34, Lot 7 (the "Property"). The Property is located at the corner of Osgood Street and Orchard Hill Road on the easterly side of Osgood Street and across the street from the former Lucent Facility now known as Osgood Landing. The Property is located within the Business 2 (B-2) Zoning District. The Applicant has owned the Property since 2003. There are three separate sign applications: the first is the application for the proposed ground sign(attached as Exhibit A),the second is for the proposed wall sign (attached as Exhibit B), and the third is for the proposed directions signs (3) (attached as Exhibit Q. There are two other signs indicated on the approved plans, but there has not yet been a tenant selected. Future application(s) will follow. The following signs are proposed for installation: 1. Ground Sian: The proposed ground sign consists of a typical "Shell" identification sign. Underneath the "Shell" sign,there are two price signs and a Dunkin' Donuts identification sign. Altogether,this sign, as proposed, is 43.68 square feet (s.f.), which is below the 50 s.f. maximum size permitted in section 6.6(D)(7). Furthermore, in compliance with section 6.6(D)(7) of the bylaws,the "Shell" sign comprises 60%of the total freestanding ground sign. The sign is proposed to be externally illuminated with eyebrow lighting located at the top of the sign, which is, "directed solely at the sign", as required by section 6.5(1) of the bylaws. Furthermore, as indicated on the approved plans, portions of which are attached in Exhibit D,this sign is proposed to be located 10 feet from all property lines,therefore conforming with section 6.6(A)(2) and 6.6(A)(6) of the bylaws.
