You recently granted other sign permits at this location. The sign which is the subject of this application, like the last,was previously approved by the North Andover Planning Board. The following sign is proposed for installation: Wall Sign: The proposed wall sign is located on the front wall of the building, as indicated on the approved Site Plan (see attached Exhibit A). It consists of the words, "Convenience Store" (black letters with white background), and is depicted on the Site Plan. The sign is 54 square feet(s.f.), which is significantly less than the maximum size sign permitted under section 6.6(D)(1)of the bylaws. I have also reviewed the Zoning Bylaw as it pertains to the existing gasoline station improvements as well as the proposed project. Accordingly,I have made the following zoning determinations. Existing Gas Station/Convenience Store Improvements 1. Since the existing gasoline station/convenience store improvements were constructed prior to the enactment of the CDD 3 provisions of the Zoning Bylaw in May,2008,those existing improvements constitute pre-existing lawful nonconforming structures and uses in conformance with the provisions of Section 9.1 of the Zoning Bylaw,and which may continue to be operated. 2. The fact that the proposed Project will tie into the existing Title 5 septic system current serving the existing improvements and will result in associated grading would not constitute a change,extension or alteration of the preexisting lawful nonconforming use and structure within the meaning of Section 6 of Chapter 40A,or Sections 9.1 and 9.2,of the Zoning Bylaw,so that no relief would be required from the Zoning Board of Appeals for such tie-in and associated grading. Proposed Storage/Office Building I have also reviewed the plans and accompanying application for the proposed project which includes the construction of new 16,527 s.f.building including 4,127 s.f. of second floor office space,28 new parking spaces;and,associated landscaping,lighting,stormwater and other improvements shown on the site plans,and I have determined the following: 1. The entire 6.1-acre property is located entirely within the CDD Zoning District as a result of the rezoning which occurred in 2008. 2. The uses of proposed building for warehousing/storage and office use is permitted within the CDD 3 Zoning District under Section 16.4 of the Zoning Bylaw.
