The North Andover Board of Appeals held.a public hearing at its regular meeting in the Town Ha 11 top floor
meeting room, 120 Main Street,North Andover,MA on Tuesday,December 9,2008 at 7:30 PM upon the
application of Sandra M.Beland, 16 Meadow Lane(Map 45.G,Parcel 44),North Andover,MA requesting a
Special Permit from Section 4,Paragraph 4.122.22 of the Zoning Bylaw in order to allow a Family Suite within the
existing footprint of a conforming single family dwelling on a conforming lot. Said premise affected is property
with frontage on the South side of Meadow Lane within the R-4 zoning district. Legil notices were sent to all
names on the abutter's list and were published in the Eagle-Tribune,a newspaper of general circulation in the Town
of North Andover,on November 24&December 1,2008.
The following voting members were present: Ellen P.McIntyre,Joseph D. LaGrasse,Richard J.Byers,Richard M.
Vaillancourt,and Thomas D.Ippolito. The following non-voting members were present: Daniel S.Braese and
Michael P. Liporto.
Upon a motion by Joseph D.LaGrasse and 2°d by Thomas D.Ippolito,the Board voted to GRANT a Special
Permit from Section 4,Paragraph 4.122.22 of the Zoning Bylaw in order to allow a Family Suite within the existing
footprint of a conforming single family dwelling on a conforming lot per:

With the following conditions:
1. The Family Suite shall not be occupied by anyone except Christopher P.Cesati or Kimberly A.
Cesati,granddaughter of Merinda A.and Samuel P.Caliento,the residing life owners of the dwelling
unit;
2. The Special Permit shall expire at the time that Christopher P.Cesati or Kimberly A.Cesati cease to
occupy the Family Suite;
3. The Special Permit shall expire at the time the premises are conveyed to any person,
partnership,trust,corporation or other entity;
4. The applicant,by acceptance of the Certificate of Occupancy issued pursuant to the Special Permit,
"rants the Building Inspector or his lawful designee the right to inspect the premises annually;
5. The applicant shall maintain the existing footprint and the existing floor-plan of 16 Meadow Lane,
approved by Building Permit#109 issued on 8/11/08 for the demolition of an existing garage in order
to construct an addition of a 2-stall garage,2 bedrooms,a living area.,and one full bathroom to an
existing single-family dwelling with the addition of the full kitchen as shown on Proposed Family
Suite/Secon Kitchen,S.Beland,16 Meadow;
6. The Special Permit may be modified to accept other family members per the Bylaw with Board
approval.
Voting in favor. Ellen P.McIntyre,Joseph D.LaGrasse,Richard J.Byers,Richard M.Vaillancourt,and Thomas D.
Ippolito.
The Board finds that the applicant has satisfied the provisions of Section 4,Paragraph 4.122.22 of the Zoning Bylaw
and that the granting of this Special Permit for Family Suite usage at 16 Meadow Lane(Map 45.G,Parcel 44)within
the footprint of an existing conforming single-family dwelling on a conforming lot is an appropriate location for a
Family Suite. The Board finds that this use of part of the existing 16 Meadow Lane,as developed by installing the
proposed full kitchen per the above building&site plan,will not adversely affect the neighborhood. There will be
no nuisance or serious hazard to vehicles or pedestrians since there is provision for the required four off-street
parking spaces. Adequate and appropriate facilities are provided to the existing residential dwelling by existing
utilities,Town water,and Town sewer and for the proper operation of a Family Suite. The Board finds that the
proposed addition of a second full kitchen for the Family Suite use will not be substantially more detrimental than
the existing single-family dwelling to the neighborhood.
Note: 1. This decision shall not be in effect until a copy of this decision is recorded at the Essex County Registry of
Deeds,Northern District at the applicant's expense. 2.The granting of the Variance and/or Special Permit as
requested by the applicant does not necessarily ensure the granting of a building permit as the applicant must abide
by all applicable local,state,and federal building codes and regulations,prior to the issuance of a building permit as
required by the Inspector of Buildings.
