vices, as specified in Massachusetts State Building Code Section 116.2.2 and as related to the structural portions of the
work:
1. Reviewed for conformance to the design concept, shop drawings, samples and other submittals which are
submitted by the contractor in accordance with the requirements of the construction documents.
2. Reviewed and approved the quality control procedures for all code-required controlled materials.
3. Been present at intervals appropriate to the stage of construction,and complexity of the project,to become
generally familiar with the progress and quality of the work,and determine to the extent practical and pos-
sible the work was being performed in a manner consistent with the structural construction documents.
To the best of our information,knowledge, and belief,the structural work has been satisfactorily completed in substan-
tial compliance with the intent of the construction documents.

I_ Existing Building Summar
As you are aware, the existing building complex is a combination of a number of different buildings that were
constructed over time and are attached to one another in various ways. The subject area of this review is for the
Proposed Fulfillment Plus tenant space located on the first floor area of Building 30 (See Attached Locus Plan). Building
30 is the largest of the buildings on the site with approximately 535,000 gsf per floor. Building 30 is a steel frame and
concrete slab construction without fire rated assemblies protecting the floors and columns and is classified as a Type 2C
unprotected construction. The building is fully sprinklered and has a fire alarm system throughout the building. Building
30 has 2 floors and a mezzanine area on the second floor exiting into the second floor area.
The space proposed is to be used as office space,warehouse, and production area for a company that provides mail
order fulfillment. The total area of the proposed demised space is approximately 52,000 sf+-. It is my understanding
and belief that the existing space was used as electronic laboratories, offices, manufacturing and assembly areas, as well
as support operations and storage area for electronics parts and equipment manufactured on site by Lucent
Technologies.This use of building 30 was classified as a mixed use, B-Business, S-1 Storage, an F-1 Factory and
Industrial Use Group. In a similar manner the proposed use has office areas, manufacturing/production and warehouse
storage uses which are classified as the same use groups. Based upon the Massachusetts Building Code in Table 3403
Hazard Index, s-1 and F uses are each classified as a"3"for hazard index and the B-Business is classified as a"2"for
hazard index which is at or less than the other occupancies. Therefore, there is no change of use or an increase in the
Hazard index for the proposed areas, and is a continuation of the same uses.
The code states that all repairs, alterations, and changes of Use to this building be subject to the requirements of 780
CMR 34, Repair,Alteration,Addition and Change of Use of Existing Buildings. The existing building is not changing its
Use and is not changing to a more hazardous use. Therefore Section 3404.0 " Requirements for Continuation of the
Same Use Group or Change to a Use Group Resulting in a change in Hazard Index of One or Less"will apply to this
project. Attached is a copy of this code section.

II. Building Code Requirements:
As part of this code evaluation we are using the Massachusetts Building Code 780 CMR—6th Edition—"Chapter 34
Repair,Alteration,Addition,and Change of Use of Existing Buildings" This evaluation is for the construction of
the demising walls and exits for the Fulfillment Plus tenant,and is not a code review for the interior use of their space. A
separate permit and construction documents is to be provided by Fulfillment Plus.
3404.4 Alterations and repairs: Alterations or repairs to existing buildings which maintain or improve the
performance of the building may be made with the same or like materials, unless required otherwise by 780 CMR 3408.
Alterations or repairs which have the effect of replacing a building system as a whole shall comply with 780 CMR 3404.3
Compliance:The interior occupancy will be defined in a specific area; the existing building was generally one
tenant and was generally open without demising partitions between the spaces. The proposed occupancy will
have demising partitions defining the perimeter of the space and defining the edges of exit ways from other
parts of the building and other tenants. All existing exists from the space demised are to be maintained and
upgraded where shown on the attached plans as required. The code for new construction would not require
corridors and tenant separation walls to be fire rated based on Section 1011.4,Table 1011.4 and 1011.4.1 based
upon the fact that the building is fully sprinklered. However, since Building 30 is very large and the exit travel
distances are not in compliance with the 250'travel distance for sprinklered buildings, we have proposed that all
demising and corridor partitions be 1-hour fire rated. This will allow for rated exit enclosures to extend into the
interior of the building as various tenants lease space. As well as provide tenant separation assemblies if there is
any future change of use proposed for future tenants.The proposed demising walls will be 1 hour fire-rated
construction and this will be an improvement to the exit conditions that previously existed.
3404.5 Number of Means of Egress: Every floor or story of any existing building shall provide at least the number of
means of egress as required by 780 CMR 3400.4 and which are acceptable to the building official.
Compliance: There are a number of stairways and doorways from this floor to the exterior and to horizontal
exits. The total area of the Fulfillment Plus space is approximately 52,000 sf+-. The space can be broken down
into smaller occupancy groups and locations of the exits from these areas need to be determined by the architect
designing their space. The code requires occupancy of B Business and Industrial Use to be at 1 person per 100
sf of area, and Storage areas to be 300 sf per person.
Office and Industrial Areas= about 30,000sf/100 sf=300 people possible in the office and industrial areas.
Storage Areas= about 22,000 sf/300 sf=73 people possible in the storage area
Totals= 373 people possible in the Fulfillment area.
Therefore, Table 1010.2 requires a minimum of 2 exits from the space where occupancy is less than 500
occupants. There are a minimum of 3 exit doors from the proposed Fulfillment Plus space which is greater than
what is required.
3404.6 Capacity of exits: All required means of egress shall comply with 780 CMR 1009.0. Existing means ofegress
may be used to contribute to the total egress capacity requirement based on the unit egress widths of 780 CMR 1009.0.
Compliance: Approximately 373 people are possible in the space; dividing this number in half, 187 people
travel to one exit and 187 to the other(assuming 2 exits only where three are provided). This calculation
defines the minimum exit widths for doors stairs and hallways.Therefore all stairs, doors and hallways will need
to have a capacity of 132 or greater.
Stairs: Stairs a minimum of 44"wide(44"/0.2" per person= 220)will provide for this capacity where
the width of a stair is 3'-8" minimum. The existing stairs are wider than this in width, the capacity of the
stairs are in compliance.
Hallways: Hallways are approximately 5'-0"to 8'-0" in width. (60"/0.15" per person = 400)A 5'-0" (60
inch) hallway provides for approximately 400 people. An 8'-0"width (96"/0.15"per person = 640)
hallway provides for approximately 800 people Therefore the proposed hallways are in compliance.
Doors: Doors are new 6'-0" double doors and a T-0" single door. (36"/0.15" per person = 240 people)
A 36"door will provide capacity for 240 people.Therefore the three doorways are adequate exits from
the space and some are double doors.
Ramps: Ramps at the Northwest entrance are approximately 9'-0"(108"/0.15"per person = 720)the
existing ramps are capable of supporting exits for 720 people. Therefore the ramp areas are in
compliance. The ramp does not meet the Accessibility code requirement for slope, width,or handrails.

Therefore based upon the above information the two proposed exits including stairs, doors, ramps, and hallways
are adequate and in compliance with the code for the proposed tenants.
3404.7 Exit signs and Lights: Exit signs and lighting shall be provided in accordance with 780 CMR 1023.0.
Compliance: The lighted exits signs are provided by luminescent signs which require a separate light source to
charge the signs. These signs are allowable by code if they comply with section 1023.0 and UL-924. They do
not in our opinion meet this requirement since the locations of these lights are not directly located by lights that
stay on at all hours a building is occupied since the lights require approximately 1 1/2 hours to fully charge the
luminescent surface and cannot meet the requirements of 1023.4 . Therefore the exit signs are to be replaced
with lighted exit signs. This will also provide a higher degree of safety in this area as the signs will be
significantly brighter than the luminescent signs. We propose to phase this replacement of exit signs over time
as the building is occupied for the exits proposed for the spaces being occupied.
3404.8 Means of egress lighting: Means of egress lighting shall be provided in accordance with 780 CMR 1024.0.
Compliance:The existing floor area has emergency light ballasts in the ceiling lighting. The existing
emergency lighting is in compliance. The system should be reviewed and all bulbs checked for proper operation.
New work within the proposed tenant area is to be powered by their own lighting circuits and not part of this
evaluation.
3404.9 Height and Area limitations: The height and area requirements of 780 CMR 5shall apply to existing buildings
when such existing buildings are modified byaddition and/or change in use. Modifications to the height and area
requirements as provided in 780 CMR 504.0 and 506.0 are permitted.
Compliance: Not Applicable- No change to the Area or Height are proposed.
3404.10 Existing Fire and party walls: No More compliance is required with 780 CMR 707.0.The height above the
roof of existing fire, party and exterior walls need not comply with 780 CMR 3404.0
Compliance: Not applicable - no fire walls are proposed in this scope of work.
3404.11 Fire protection Systems: Fire Protection Systems: Design, installation and maintenance of fire protection
systems should be provided in accordance with 780 CMR 3404.3 and 780 CMR 3404.12 as applicable.
Compliance:There is a fully functioning fire sprinkler and alarm system in the building. Additional heads may
be required as part of the demising of the space and constructing the new exit hallway. The interior of the Fulfillment
Plus sprinkler work is not part of this evaluation.
3404.12 Fire protection systems are required for the following cases:
1. Additions where required by 780 CMR 9.0 for the specific use group.
Z. For existing buildings and additions to existing buildings,where required by 780 CMR 9 or where required by
780 CMR 506 to satisfy height and area requirements.
3. Existing buildings,or portions thereof which are substantially altered or substantially renovated,and where
otherwise required by 780 CMR 9.0 for the specific use group.
Compliance: There is a fully functioning fire sprinkler and alarm system in the building. Modifications to this
existing system are required to demise the tenant space, all interior modifications within the tenant space is to
be provided by the tenant's construction drawings.
3404.13 Enclosure of stairways: Open stairways are prohibited except in one-and two-family dwellings or unless
permitted by 780 CMR 10. There shall be no minimum fire resistance rating required for an existing enclosure of a
stairway. Partitions or other new construction which in order to fully and solidly enclose a stairway shall provide a
minimum fire resistance rating of one hour. All doors in the enclosure shall be self-closing and tight-fitting with approved
hardware. All doors in those portions of the stairway which are fire resistance rated shall comply with the applicable
provisions of 780 CMR 9.
Compliance: One of the proposed exits from the Fulfillment space is through an enclosed stairwell, the stairway
does not appear to be fully fire rated doors, however, based upon the building code the doors are not required
to be changed. It is the intent that the doors will be replaced as part of the stairwell and ramps renovations that
are planned for the future with code complying doors.

3404.14 Assembly Use Groups: Notwithstanding the provisions of 780 CMR 3404, Assembly Use Groups shall comply

3404.17 Fire hazard to adjacent buildings: Any proposed change in the use or occupancy of an existing building

3404.18 Accessibility for Persons with Disabilities: Accessibility requirements shall be in accordance with 521 CMR
as listed in Appendix A. 521 CMR requires all renovations and construction that costs 100,000 or more, that the facility
needs to provide an accessible entrance, and accessible toilet rooms,telephones and drinking fountains where they are
provided. (521 CMR Section 3.3.1.b.) The MAAB requires that at each public toilet room at least one sink and one toilet
are required to be accessible, or a unisex handicapped toilet is to be provided. (521 CMR section 30.1.a)
Compliance:The proposed tenant space is required to be in compliance with CMR 521, the existing toilet rooms are
not in compliance and the proposal is to provide a unisex Handicapped toilet in the adjacent area of the toilets located at
the Northeast entrance, or to renovate the bathrooms and provide accessible toilets within the existing toilet rooms.
The entrance ramp by the Northwest entrance is not in compliance since it is too wide and too steep, and the doors are
not wide enough. The building is being made accessible from other entrances and this space will be accessible from the
parking lots in the front and later on the Southeast side of the building.
3404.19 Energy Conservation: Energy conservation requirements shall be in accordance with 780 CMR 3407.0,

This letter constitutes a summary of code issues relative to the tenant fit-out for Lucent
Technology at 1600 Osgood Street in North Andover, MA. The tenant space includes
portions of buildings 20, 30 and 70.
Introduction
All repairs, alterations, and changes of use to this building are subject to the
requirements of 780 CMR 34, "Repair, Alteration, Addition, and Change of Use of
Existing Buildings". The requirements of this chapter are based on existing and
proposed changes in use. The subject buildings currently house offices (Use Group B),
manufacturing (Use Group F-1), assembly spaces (Use Group A-3) and storage (Use
group S-2). Certain hazardous materials used in manufacturing processes are stored
appropriately in amounts below the exempt level for their hazard classification (Use
Group S-1). While the subject tenant (Lucent Technology) previously occupied the
entire facility with the above uses, this tenant is now reducing its space requirements,
and the newly vacant areas will be leased to new tenants. This report will address only
the tenant space for Lucent Technology. A full building Chapter 34 report anticipating
Chapter 34 issues for future tenancies has been prepared for the building owners.

Existing open stairways not permitted to be open by the code for new
construction, such as stairs that are required exits, must be
fully enclosed. Existing stair enclosures are not required to meet any fire
resistance rating. Any new construction is required to have a 1-hour fire
resistance rating.
3404.18 Accessibility for Persons with Disabilities
All new work in areas constituting "public use" must be accessible. 521
CMR defines "public use" as "interior or exterior rooms or spaces that are
made available to the general public. Public use may be provided at a
building or facility that is privately or publicly owned" (521 CMR 5.63). 521
CMR 3.4 also states that "when the use of a building changes from a
private use to one that is open to and used by the public, an accessible
entrance must be provided, even if no work is being performed. When a
portion of a building changes use from a private use to one that is open to
and used by the public, then an accessible route must be provided from
an accessible entrance even if no work is being performed". Only portions
of the building where a service or product is offered and where a member
of the public may enter are required to comply with 521 CMR (521 CMR
11.1).

Massachusetts Architectural Access Board Regulations (521 CMR). For

existing building alterations the requirements of 521 CMR are based on
the cost of the proposed work:
A. If the cost of the proposed work is greater than $100,000 then all new
work must comply and the existing building must include an accessible
public entrance, toilet room, telephone and drinking fountain (if public
phones and drinking fountains are provided) (521 CMR Section
3.3.1(b)).
B. If the cost of the proposed work is greater than 30% of the full and
fair cash value of the existing building, the entire building
is required to fully comply with 521 CMR (521 CMR Section 3.3.2).
The cost of all work performed on a building in any 36 month period must
be added together in determining the applicability of 521 CMR (521 CMR
Section 3.5).
In determining whether the cost of the proposed work exceeds 30% of the
existing building value, the 100% equalized assessed value of the existing
building as recorded in the Assessor's Office at the time the building
permit is issued must be used (521 CMR Section 5.38). An appraised
value for the building can only be used if no assessed value exists or the
assessed value is more than three years old (521 CMR Section 5.38). A
request to substitute the appraised value must be submitted to the
Architectural Access Board by a certified appraiser and must be submitted
prior to obtaining a building permit for the project (521 CMR Section 5.38).
Given that many tenant alterations have or will be performed, this issue
should be further investigated.
When an owner or an owner's representative thinks that full compliance
with the code is impracticable they may appeal to the Board for a variance
from 521 CMR. A variance applicant must demonstrate that compliance is
structurally infeasible or that the cost of compliance would be excessive in
proportion to the benefit provided for people with disabilities.
Conclusion:
Height and Area- The property at 1600 Osgood Street in North Andover consists of
numerous buildings, formerly occupied by a single tenant. This report deals specifically
with the proposed leasing of portions of buildings 20, 30, and 70 to a single tenant.
These buildings are separated by existing fire walls and connected through fire doors
and tunnels. The construction type of the main manufacturing building (Building 30) and
adjacent buildings (70 and 71) is Type 2C (noncombustible/unprotected). Because the
tenant will not be changing the use of these buildings or increasing the hazard index the
requirements for height and area limitations do not apply to this project.

Egress- Stairs that are unenclosed create unprotected floor openings that can facilitate
the spread of smoke and fire. If a stair is required for egress it will be enclosed and
provided with a code compliant exit discharge. Exit access travel will be within the
maximums allowed for the applicable use group as per 780 CMR Table 1006.5 (see
below):

existing building not changing use, a rated wall or smoke partition is not required to
separate the tenants (780 CMR Table 602). Therefore, there are no requirements that
require the wall to be a full height wall that is continuous from floor to ceiling.
