The parcel totals approximately 40,521 sq. ft. with frontage on Turnpike Street. This Special Permit was requested by C&C Auto Corporation,268 Raleigh Tavern Lane,North Andover,Ma 01845. The application was filed with the Planning Board ori or about November 13,2015. The public hearing on the above referenced application was opened on December 15, 2015,with additional hearings on January 5, 2016,January 19, 2016,February 2, 2016, and closed by the North Andover Planning Board on February 16,2016. The applicant submitted a complete application,which was noticed and reviewed in accordance with Section 8.3, 10.3 and 10.31 of the Town of North Andover Zoning Bylaw and MGL C.40A,See.9. The Planning-Board makes the following fmdings as required by the North Andover Zoning Bylaws Section 8.3 and 103: FINDINGS OF FACT: I) The specific site is an appropriate location for the project as it is the construction of an auto repair facility with an attached pizza/sub restaurant in a General Business District(GB), and includes changes to the stormwater management system that will improve the drainage on the lot, as well as landscaping that will provide a buffer to Route 114 existing properties. 2) Based on input received from both the Planning Board and the Planning Board's stormwater peer review consultant Eggleston Environmental, the applicant has provided sufficient stormwater management facilities to mitigate flow of stormwater by providing a combination of porous pavement a surface inffitration basin, and an existing drainage pipe. (See L. Eggleston memo dated January 14, 2016, Haight Engineering, PLLC review response memo dated January 29, 206, Eggleston Environmental response email comments dated February 1, 2016, and February 12,2016) 3) The Traffic Assessment submitted by the applicant(and referenced in this document)concludes that the redevelopment is anticipated to have no significant overall traffic impact. 110 analysis indicates that the proposed use does not meet or exceed any MEPA thresholds and that the accesses are sufficient and adequate for the intended uses. 4) There are no7 changes required to the accesses to accommodate the new uses. The proposed Project will utilize the existing, shared 26' wide driveway (with the abutting lot) off of Berry Street and the main 29'wide entrance off of Turnpike Street. 5) The property is currently serviced by an onsite subsurface disposal system.This system will be abandoned and the now building will be connected to municipal sewer and water. 6) The redeveloped building will be constructed within the existing building envelop thereby maintaining current building setbacks to property lines. 7) The use as developed will not adversely affect the neighborhood and there will be no nuisance or sdrious hazard to vehicles or pedestrians. 8) Finally the Planning Board finds that this project generally complies with the Town of North Andover Zoning Bylaw requirements as listed in Section 8.3.5,but requires conditions in order to be fully in compliance. SPECIAL CONDITIONS 14) PRIOR TO THE START OF SITE WORK OR CONSTRUCTION A. Three (3) copies of the signed, recorded decision and the recorded plans must be delivered to the Planning Department. B. In consultation with the Town Planner, the Applicant shall designate an independent construction monitor. The monitor shall read, sign, and return to the Town Planner the Letter of Agreement for Independent Monitors. The monitor shall make weekly inspections of the project,provide monthly reports to the Planning Department,and detail any areas of non-compliance and corrective actions. The monitor will also provide reports following heavy rain events. The monitor must also be available upon notice to inspect the site accompanying a Planning Department designated official. C. A detailed construction schedule shall be submitted to the Planning Staff for the purpose of tracking the construction and informing the public of anticipated activities on the site. D. Confirmatory test pits shall be required in each proposed infiltration location. E. Evidence of a MassDOT access permit allowing access to shut off the existing water at the main must be submitted to the Planning Department. F. A bond in the amount of fifteen thousand dollars ($15,000,00) shall be posted for the Purpose of insuring that the site is constructed in accordance with the approved plan and that a final as-built plan is provided, showing the location of all on-site structures. This bond shall be,in the form of a check made out to the Town of North Andover. This check will then be deposited into an interest bearing bond account. G. All stormwater management best practices shall be maintained as specified in the Stormwater Operations and Maintenance Plan that was submitted with the application. H. All applicable erosion control measures must be in place and reviewed and approved by the Planning Department. These measures must include erosion control to protect all existing and proposed catch basins and oil traps on the site or on the streets adjacent to the project I. If the development chooses to include automobile sales,a modification to the Site Plan Special Permit must be applied for through the Planning Deparment. 15)DURING CONSTRUCTION A. u D st mitigation must be performed weekly, or more frequently as directed by the Town Planner,throughout the construction pros. B. Any stockpiling of materials (dirt, wood, construction material, etc) must be shown on a Plan and reviewed and approved by the Planning Staff Any approved piles roust remain covered at aH times and fenced off to minimize any dust problems that may occur with adjacent properties. C. It shall be the responsibility of the developer to assure that no erosion from the construction site shall occur which will cause deposition of soil or sediment upon adjacent properties or public ways,except as normally ancillary to off-site construction. Off-site erosion will be a -basis for the Planning Board making a finding that the project is not in compliance with the Plan;provided,howeva that the PlanningBoard shall give the developer written notice of my such finding and ten days to cure said condition. 16)PRIOR TO A CERTIFICATE OF OCCUPANCY A. The applicant must submit a letter from the architect and engineer of the project stating that the building, landscaping, lighting and site layout substantially comply with the plans referenced at the end of this decision as endorsed by the Planning Board and that the stormwater management structures are functioning as designed. Altema6vely,the applicant and/or property owner may provide a bond,determined by the Planning Board,to cover the full amount of the landscaping materials and installation if weather conditions do not permit i the completion of the landscaping prior to the use of the building. B. All stormwater structures shall be cleaned, in accordance with the approved Stormwater Operation&Maintenance Plan, C. All signage shall conform to the signage regulations contained within the North Andover Zoning Bylaw,Section 6. 17)PRIOR TO THE FINAL RELEASE OF ALL SECURPPY AND ESCROWED FUNDS A.
