Andover,MA
Dear Mr. &Mrs. Nassar,
As you are aware, the North Andover Conservation Department conducted a site inspection at the
above-referenced property relative to a building permit application. It is my understanding that you
are proposing to demolish the existing deck in order to construct a new deck. Based on the
information given in the building permit application,the deck will be built slightly larger than what
exists. Furthermore,your contractor will be utilizing the existing sonotubes and install a few more to
support the larger deck. As previously discussed, there is a jurisdictional Bordering Vegetated
Wetlands (BVW) that traverses beyond the fence / rear property line. Measurements were taken
from the approximate edge of the wetland resource area the location of the proposed deck. It was
determined to be approximately 80-feet from the edge of the BVW at its closest point. As such,the
Conservation Department had REJECT your building permit application as work is being
proposed within the jurisdictional 100-foot Buffer Zone. Furthermore,you will be required to file
under our`Small Projects Review'with the North Andover Conservation Department and
Commission. Please be aware that the Building Department will not issue you a building permit until
you have obtained all applicable departments.
You will be required to submit a written scope of work (prepared by you or your contractor),
including a plot plan with the proposed work and the approximate location of the wetland and its
distance from the proposed deck.This plan must be drawn to scale. In addition, there is a $25.00
filing fee that shall be made payable to the Town of North Andover. Once the Conservation
Department is in receipt of this proposal,either you or your contractor shall contact the undersigned
to schedule a pre-construction meeting to go over the project. Based on the information given at the
meeting, this department will prepare a letter of approval,which has to be ratified by the
Conservation Commission within 4 weeks from the submission date. The Conservation
Commission will be meeting on August 9th and 23`d. If we receive the above-mentioned information

by 12 noon Tuesday,August 8, 2006 it may be possible to schedule a pre-construction meeting and
have the Conservation Commission ratify the project at the August 9`h meeting.
