CHAPTER 34 REPORT
The original part of the building was constructed in 1833 with additions added to the side at later dates.
There is a basement under the original building with crawl spaces under part of the additions and part of the
additions being a slab on grade. The first floor has a main access at the front with a stair hall and two doors
opening off the stair hall to spaces on the first floor; there is door in the rear accessing an unenclosed porch
and few steps down.to grade. Part of the first floor is a single room accessed only by a single door at the
Great Pond Road side of the building and not connected to any other spaces in the building. The second
floor is accessed by an interior stair leading up from the main entry door at the first floor;there is a door at
the rear leading to an unenclosed stair and platform down to grade;there is a door leading out to an
enclosed area shared with residential unit in the adjacent building,this leads to a door to an unenclosed
exterior stairway along the side of the building down to grade.
The building wood frame with a mix of heavy timber and dimensional framing. It would be classified as
combustible construction,un-protected or Type VB construction under the 7h Edition of the Building Code.
There is no consistent rated assemblies for any wall,floor,ceiling or structural element in the building. The
occupancy would be classified as a nonseparated mixed use Business(B)and Restaurant Assembly(A-2r).
As a nonseparated mixed use,the building would not meet the current requirements for Height in Table 503
of the Code.

(3400.3) Applicability
1. Change in use group with a hazard index which results in a change in hazard index
of 1 or less as determined by 3403.0 shall comply with 3404.0.
The building will continue to be used as a mixed B and A-2r occupancy.There is no proposed change
in use; therefore the change in hazard index is zero.

(3404.0) Requirements for Continuation of same use group or change to a use group resulting in
change of hazard index of 1 or less.
(3404.1) Requirements of 3404.0 and applicable provisions of 3408.0 shall apply to all repairs and
alterations to existing buildings.
(3404.2) Requirements Exceeding Those Required for New Construction.
(3404.3) New Building Systems are required to conform to the requirements for new construction.
(3404.4) Alterations and Repairs to existing buildings which maintain or improve the performance
of the building maybe be made with same or like materials.
(3404.5) Means of egress at every story to provide at least the number of means of egress required
by 3400.4 and acceptable to the Building Official.
(3404.6) Capacity of Exits. All required means of egress shall comply with 10.00. Existing means
of egress may be used to contribute to the total egress requirement based on the unit
egress widths of 10.0.
(3404.7) Exit signs and lights shall be provided in accordance with 10.00.
(3404.8) Means of egress lighting shall be provided in accordance with 10.00.
(3404.9) Height and area limitations of Chapter 5 shall apply when existing building change use.
Modifications to the height and area requirements as provided in 504.0&506.0 are
permitted.
Building does not meet the current 71 Edition of the Building Code for height,but does meet
standard for area for a nonseparated mixed use B and A-2r occupancy.
(3404.10) Existing Fire Walls/Partitions—no further compliance is required with Chapter 7. The
height above the roof of existing fire partitions and exterior walls need not comply with
3404.0.
(3404.11) Fire Protection Systems shall be provided in accordance with 3404.3 and 3404.12 as
applicable.
(3404.12) Fire Protection systems are required for specific cases.
None of the specific cases are applicable.
(3404.13) Enclosure of stairways—open stairways are prohibited except in one and two family
dwellings. There is no minimum rating for and existing enclosure of a stairway.
(3404.14) Assembly Use Groups shall comply with 3400.3,item#6.

(3404.16) Residential Use Groups.
Not applicable
(3404.17) Fire Hazard to Adjacent Buildings.Any proposed change in use or occupancy which has
the effect of increasing the fire hazard to adjacent buildings.
Building is not changing in use or occupancy.
(3404.18) Accessibility for Persons with Disabilities shall be in accordance with 521 CMR.
9.2.1 of 521 CMR exempts conversions to residential use from Group 1 type unit applicability.
3.9 of 521 CMR Historic Buildings allows for a varience by the Board to allow alternate accessibility.
Proposed work would be to provide acess to the first floor with the addition of an exterior ramp at
the front door and the creation of accessible toilet rooms on the first floor. Currently there is no
handicap access to any part of the interior of the building.
(3404.19) Energy Conservation. Comply with 3407.
(3404.20) Carbon Monoxide Alarms. Carbon monoxide alarms are required and shall be selected in
accordance with 527&248 CMR and Chapter 9.
(3407) Energy Provisions
No alteration of existing Building Envelope,walls,ceilings or windows is being performed.
(3408) Structural Requirements
No alteration of existing structural elements is being performed. All work involves non-structural
partitions.
