Please be advised that the undersigned represents the Board of Trustees of the Meadow View
Condominium Association located in North Andover, Massachusetts.
The Board has been made aware of an e-mail that has been sent to the Building Department
relating to issues concerning code requirements in Ms. Zysk's bathroom and suggests that the managing
agent is unaware of code issues associated with the same.
First and foremost, we have enclosed hereunder an opinion letter which we sent to the Board
regarding this matter which clearly makes this a unit owner concern. When the unit owner indicated to
the Board that she was remodeling her bathroom and was required to have access to the common areas,
the Board at this juncture hired an engineer to design a specification in compliance with the code. It is
important to note that the bathroom was not a Board driven project nor did Ms. Zysk request permission
of the Board so that any allegations regarding lack of knowledge of the code are not applicable.
The Board continues to want to foster a good relationship with the Town and the Building
Department as it is in the midst of a deck renovation project.

Pursuant to your recent request for an opinion regarding the above -referenced matter, the
following is rendered.
It is our understanding that the Board has sought our counsel regarding the installation of
venting for unit owners that are renovating their own bathrooms at the Association. This
ventilation appears to be required by the Building Department of the Town of North Andover and
will involve placing venting in the common areas of the Association.
We also understand that the Board has developed specifications for the installation of this
venting which will be required to be followed by all unit owners.
As this is something the unit owner is requesting, it is clear that the Board has the ability
to pass this cost on to the unit owner as well as requiring the unit owner to comply with the
specifications of the venting. See generally, Section 6(b) of the Master Deed.

Estimate to affect repairs to Tracey Zysk bathroom caused by 2nd floor (unit directly above insured whose toilet valve failed.
Several of items to note:
• The walls and ceilings removed were plastered. Repair quote scope is to replace like kind property.
• There is a 5 sq ft. closet in the bathroom that shares a contiguous floor is the bathroom. This quote covers removal of tile,
tiling and grouting of bath and closet floor. Material cost is based on replace for small tile sheets (like kind property) which
are more expensive than 6x6 or 8x8 tiles.
• The wall 9' east wall in the bathroom (left wall) is a standalone wall. This wall is currently constructed of 2 x 3 HD studs.
Building code requires use of 2 x 4 studs for interior walls. Since wall is stand alone and can be upgraded without affecting
other parts of the structure upgrading to 2x4 studs is required.
• Electrical estimate includes electrical code upgrades to install:GFI receptacles and must move a heat sensor from the bath
to the hall.
• Plumbing Charge — Plumbing estimate includes installation of 3 emergency shut off values (pipes capped during mitigation
phase) and install the sink, toilet, and tub. In addition, unit requires a plumbing code upgrades and to install a bath fan and
vent to outside.
• Bathfitters — During the mitigation phase of the project a bathfitters surround from the tub area was removed and
discarded. We had Bathfitters come in and quote to install a new surround in the tub area and has been provided in the
quote. Note: Bathfitter price specifically excluded from the calculation of contractors 10 and 10.
