The following is the long history of Kevin Stack's attempts to build a home on the Lot 3,
Berry Street, North Andover, Massachusetts. Lot 3 is a vacant lot containing 20,000 square feet of
land. The property has been in Mr. Stack's family since 1962. Kevin acquired the property from
his father in December of 1983 with the intention of building a single family home on the o ert
for his family. p p Y
When Kevin Stack approached the Town for a building permit in 1985, he was informed that
he could not build a single family home because his property has been rezoned for industrial use b
the Town in 1972. In late 1985, Kevin Stack petitioned the Town of Andover to rezone his y
from industrial use to residential use, and in May, 1986, at the annual Town Meeting, it was voted
to rezone Kevin Stack's property for residential use.

Dear Mr. Brooks and Mr. Brown:
Relative to the subject please be advised that this firm has conducted a property line survey
of the site first in April 1995 for Ms. Natalie Ross and subsequently for Nathan Brooks in
August of 2008.
Prior to beginning the survey for Natalie Ross, we conducted research at the Town Hall to
obtain copies of Assessors Maps and other records. We subsequently obtained copies of
deeds of record for the Ross land and all of the lots located between Berry Street and the
Salem Turnpike. As part of that research, we obtained copies of the plans which depicted
the property lines of those sites from the Registry of Deeds and other sources.
Of those Registry plans, Plan #10701,, #10582, #11892 depicted the land located south of
the parcel from which the "Ross" lot was subdivided while plan #10143 depicted the land
located north of the subdivision site. Those plans clearly identified adjacent parcels as
being bounded by stone walls, coincidental, as did the Assessors Maps.
Two other Registry plans, #11203 prepared on August 11, 1988 and 412356 prepared on
November 18, 1993 defined the property lines of Parcel 1 and Parcel 2 [a/k/a lot 1 & 2] as
well as lot 3 that were subdivided from the property from which the Ross lot was
subdivided.

Further, we were provided, on April 18, 1995, an unrecorded plan of lot #4 prepared by
James Curran, PLS of Appleton Land Survey, Inc., of parcel #4, the lot next to the Ross
property. That plan referenced and depicted the information shown on the above Registry
of Deeds plans.
Reviewing the deeds for the Brooks and former Ross property, as well as the adjacent lots,
it is clear that the points of beginning are referenced form the Conroy property, or lots 1 and
2 shown on a subdivision sketch plan that was unrecorded. For example, the Ross (Brooks)
land begins "200' from land of Conroy"; the land to the north or right of the Ross land
begins "200' from land of Ryan, being lot 3". Clearly the intent is to allow for lot 4 and 5
to have a combined 200' of frontage.
By fixing the point of beginning to the Conroy land, the distances along Berry Street are
fixed and the distance of the remainder land is not fixed. Therefore, any error in the
frontage is provided for in the unsubdivided portion of the lot. It then becomes essential to
determine the location of lot 1 and lot 2 (the Conroy land) to ascertain the point of
beginning of the Ross (Brooks) land. Given the plans of record previously referenced it
appears that those plans, prepared by other surveyors, agree on the location of the Conroy
land and thus the point of beginning of lot 5 [the Ross/Brooks) land].
In the absence of further evidence, it is my opinion that the Ross (Brooks) land, also known
as lot 5 Berry Street, consists of a lot 100' wide, 200' deep, located without gap or gore
adjacent to lot 4, which is located adjacent to lot 3, which is in turn located adjacent to the
"Conroy" property. Further, based upon the above, the lot is correctly marked on the
ground in accordance with the monuments found by this firm in the field that mark the
property lines of the Conroy property, and lot 3 and lot 4. It is my opinion that lots 6 and
subsequent have the frontage set forth in their deed, without conflict with lot 5.

Dear Board Members:
The above referenced is an existing non -conforming lot. It was created prior to the
existing zoning. It contains 20,000 square feet of area and 100 feet of frontage. The
current zoning requires 43560 square feet of frontage and 150 feet of frontage. The
property is further encumbered by wetlands.
As you are aware North Andover wetlands regulations require that all houses be
built 50 feet from wetlands. The house shown on the attached plan meets that
requirement but at the expense of reducing the front yard and side line setbacks to 10 feet
from the required 30 feet. The proposed house will be serviced by a sewer ejector station
and a well.
We have submitted a similar plan to the Conservation Commission and they are
supporting this application for a zoning variance so that the wetlands regulations can be
met. The relief sought is clearly a result of the hardship on the land caused by the
wetlands.

ARTICLE 1. CONTRACT DOCUMENTS
1.1 The contract documents consist of this agreement, general conditions, construction documents,
specifications, allowances, finish schedules, construction draw schedule, all addenda issued prior to
execution of this agreement and all change orders or modifications issued and agreed to by both parties.
All documents noted herein shall be provided to the Contractor by the Owner. These contract documents
represent the entire agreement of both parties and supersede any prior oral or written agreement.
ARTICLE 2. SCOPE OF WORK
2.1 The Owner agrees to purchase and the Contractor agrees to construct the above mentioned
structure and fixtures attached thereto in N. Andover, MA according to the construction documents,
allowances, finish schedules, all addenda, change orders, modifications and specifications set forth in the
specification booklet.
ARTICLE 3. TIME OF COMPLETION
3.1 The projected completion date shall be approximately 90 days from the first day of construction,
however any change orders and/or unusual weather might delay or otherwise effect the completion date.
Barring inclement weather or owner related delays. The contract execution date shall be TBD.
ARTICLE 4. THE CONTRACT PRICE
4.1 The purchase price of the project shall be set at the sum of Two Hundred and Seventeen
Thousand Dollars, ($217,000.00), subject to additions and deductions pursuant to authorized change
orders and allowances. Closing costs shall be paid by the Owner. As well as any impact fees, or town
fees associated with the Lot or Home.

ARTICLE 5. PROGRESS PAYMENTS
5.1 The Owner will make payments to the contractor pursuant to the attached construction draw
schedule as work required by said schedule is satisfactorily completed. Owner shall make draw payments
to contractor within 10 days after request by contractor. Should the owner fail to make payment,
contractor may charge a penalty of 1.5% annually upon the unpaid amount until paid.
5.2 If payment is not received by the Contractor within 30 days after delivery of payment demand for
work satisfactorily completed, contractor shall have the right to stop work or terminate the contract at his
option. Termination by Contractor under the provisions of this paragraph shall not relieve the Owner of
the obligations of payments to Contractor for that part of the work performed prior to such termination.
Termination by Owner under the provisions of this paragraph shall not relieve the Owner of the
obligations of payments to Contractor for that part of the work performed prior to such termination.
ARTICLE 6. DUTIES OF THE CONTRACTOR
6.1 All work shall be in accordance to the provisions of the plans and specifications. All systems
shall be in good working order.
6.2 All work shall be completed in a workman like manner, and shall comply with all applicable
national, state and local building codes and laws.
6.3 All work shall be performed by licensed individuals to perform their said work, as outlined by
law.
6.4 Contractor shall obtain all permits necessary for the work to be completed.
6.5 Contractor shall remove all construction debris and leave the project in a move in clean condition.
6.6 Contractor shall furnish lien waivers or release forms for all work performed and materials
purchased.
ARTICLE 7. OWNER
7.1 The Owner shall communicate with subcontractors only through the Contractor.
7.2 The Owner will not assume any liability or responsibility, nor have control over or charge of
construction means, methods, techniques, sequences, procedures, or for safety precautions and programs
in connection with the project, since these are solely the Contractor's responsibility.
ARTICLE 8. CHANGE ORDERS AND FINISH SCHEDULES

8.1 A Change Order is any change to the original plans and/or specifications. All change orders need
to be agreed upon in writing, including cost, additional time considerations and signed by both parties.
50% of the cost of each change order will be paid prior to the change, with the final 50% paid upon
completion of the change order. A 5% fee shall be added to all change orders and overages in excess of
initial allowances. Additional time needed to complete change orders shall be taken into consideration in
the project completion date.
8.2 Completed Finish Selection Schedules shall be submitted to the Contractor as follows:

8.3 Any delays or changes in finish selection schedules will delay the projected completion date.
ARTICLE 9. INSURANCE
9.1 The Owner will keep in force a Builder's Risk Insurance Policy on the said property to protect
both owner's and contractor's interest until construction is completed.
9.2 The Owner will purchase and maintain property insurance to the full and insurable value of the
project, in case of a fire, vandalism, malicious mischief or other instances that may occur.
9.3 The Contractor shall purchase and maintain needed Workman's Compensation and Liability
insurance coverage as required by law and deemed necessary for his own protection.
ARTICLE 10. GENERAL PROVISIONS
10.1 If conditions are encountered at the construction site which are subsurface or otherwise concealed
physical conditions or unknown physical conditions of an unusual nature, which differ naturally from
those ordinarily found to exist and generally recognized as inherent in construction activities, the Owner
will promptly investigate such conditions and, if they differ materially and cause an increase or decrease
in the Contractor's cost of, and/or time required for, performance of any part of the work, will negotiate
with the Contractor an equitable adjustment in the contract sum, contract time or both. There is an allow
budget of $20,000 for the sewer and $25,000 for the site work included in this price.
ARTICLE 11. ARBITRATION
11.1 Any dispute that arises which cannot be settled otherwise between the parties, will be resolved
with binding arbitration. Notice shall be served in writing to the other party stating the grievance and
naming a person to act as an arbitrator. The other party shall then name an arbitrator, and these two
arbitrators shall select a third. The decisions of any two of said arbitrators shall be binding and conclusive
to all parties.
ARTICLE 12. WARRANTY

12.1 At the completion of this project, Contractor shall execute an instrument to Owner warranting the
project for One against defects in workmanship or materials utilized. The manufacturers warranty will
prevail.
ARTICLE 13. TERMINATION OF THE CONTRACT
13.1 Should the Owner or Contractor fail to carry out this contract, with all of its provisions, the
following options and stipulations shall apply:
13.1.1 If the Owner or the Contractor shall default on the contract, the non -defaulting party may
declare the contract is in default and proceed against the defaulting party for the recovery of all
damages incurred as a result of said breach of contract, including a reasonable attorney's fee. In
the case of a defaulting Owner, the Earnest money herein mentioned shall be applied to the
legally ascertained damages.
13.1.2 In the event of a default by the Owner or Contractor, the non -defaulting party may state
his intention to comply with the contract and proceed for specific performance.
13.1.3 In the case of a defaulting Owner, the Contractor may accept, at his option the earnest
money as shown herein as liquidated damages, should earnest money not cover the expenses to
date, the Contractor may make claim to the Owner for all work executed and for proven loss with
respect to equipment, materials, tools, construction equipment and machinery, including
reasonable overhead, profit and damages applicable to the property less the earnest money.
ARTICLE 14. ACCEPTANCE AND OCCUPANCY
14.1 Upon completion, the project shall be inspected by the Owner and the Contractor, and any repairs
necessary to comply with the contract documents shall be made by the Contractor.
14.2 The Owner shall not occupy the property until final payment has been received by the Contractor
and a Certificate of Occupancy has been obtained.
14.3 Occupancy of the project by the Owner in violation of Article 14.2, shall constitute unconditional
acceptance of the project and a wavier of any defects or uncompleted work.

Enclosed is the Building Permit for the construction of a single family dwelling on the
above -referenced property.
As you know, Attorney Robert Minasian (who represents Mr. Joseph Russo) has verbally
asserted a claim of adverse possession to a portion of your property and he has written to me
challenging the validity of your surveyor's opinion as to the location of the boundary between
your property and Mr. Russo's property. To my knowledge those claims have not been
adjudicated in a court of law.
I recommend that prior to constructing your house you consult with your legal counsel as
to the potential effect of such claims (if the claims are adjudicated against you) upon (1) your
lot's compliance with the Town's Zoning Bylaw, (2) the validity of any permits issued by the
Town and (3) the risks you face if the house is constructed.

I met with Mr_ Curran this morning of Cyr Engineering regarding a serious dispute as to
approximately .fifteen feet of frontage. Mr. Curran is going to take his crew back out to the site, and
he is going to re do all of his estimates on Monday.
The real issue is that there is a pin at the subject premises that Mr. Stapinske has disregarded.
He is essentially moving the lot line approximately eleven feet. All of the engineers have measured,
their frontages on a straight Line as opposed to meandering along the curvature of Berry Street.
Consequently, my engineer's position is that all of the frontages are off, and Mr. Brooks is trying to
take from us eleven feet of our property which includes our driveway, propane tanks, and a site
where there formerly was a garage on our premises.
Keep in mind, this house was constructed in 1962. Propane was the only source of fuel.
These tanks have been there since 1962. The slab for the storage shed/garage has been there since
the early sixties, and our driveway has always been there. The pin in question has been at the
premises for many years. I have spoken to Tom Casey, and he has also identified the location of that
pin. Mr. Stapinske is disregarding the pin as a frontage bound. Once we recertify all of our figures
we will have a meeting with Mr..Manzi and Mr. Stapinske in an effort to resolve the dilemma.
To carry forward the logic of Mr. Stapinske, the last lot (Lot 8) is, instead of having one
hundred feet of frontage, going to be short fifteen to seventeen feet of frontage. All of the engineers
have disregarded the measurements along the way, that is, they have used straight lines as opposed

I did meet with. Steve Stapinske and we discussed and compared field
survey information along with currant deeds and plans of record

Further, we were provided, on April 18,1995, an unrecorded plan of lot #4 prepared by
James Curran, PIS of Appleton Land Survey, Inc., ofpareel #4, the lot next to the Ross
property. That plan referenced and depicted the information shown on the above Registry
of Deeds plans.
Reviewing the deeds for the Brooks and former Ross property, as well as the adjacent lots,
it is clear that the points of beginning are refer+enccd ;form the Conroy property, or lots 1 and
2 shown on a subdivision sketch plan that was unrecorded. For example, the Ross (Brooks)
land begins "200' frozen land of Conroy", the land to the north or right of the Ross land
bcgins "200' .from. land of Ryan, being lot 3". Clearly the intent is to allow for lot 4 and 5
to have a combined 200' of frontage.
By fixing the point of beginning to the Conroy land, the distances along Berry Street are
fixed and the distance of the remainder larld is not fixed. Therefore, any error in the
frontage is provided for in the unsubdivided portion of the lot. It then becomes essential to
determine the location of lot 1 and lot 2 (the Conroy land) to ascertain the point of
beginning of the Ross (Brooks) land. Given the plans of record previously referenced it
appears that those plans, prepared by other surveyors, agree on the location of the Conroy
land a>td thus the point of beginning of lot 5 (the Ross/Srooks)'land].
In the absence of further evidence, it is try opinion that the Ross (Brooks) land, also known
as lot 5 Bent' Street, consists of a lot 100' wide, 200' deep, located without gap or gore
adjacent to lot 4, which is located adjacent to lot 3, which is in turn located adjacent to the
"Conroy" pmperty. Further, based upon the above, the tot is correctly marked on the
ground in accordance with the monuments found by this firm in the Meld that mark the
Property lines of the Conroy property, and lot 3 and lot 4. It is my opinion that lots 6 and
subsetluer t have the frontage set forth in their deed, without couflict with lot 5.

Relative to the subject please be advised that this firm has conducted a property line survey
of the site first in April 1995 for Ms. Natalie Ross and subsequently for Nathan Brooks in
August of 2008.
Prior to beginning the survey for Natalie Ross, we conducted research at the Town Hall to
obtain copies of Assessors Maps and other records. We subsequently obtained copies of
deeds of record for the Ross land and all of the lots located between Berry Street and the
Salem Turnpike. A,s part of that research, we obtained copies of the plans which dcpicted
the property lines of those sites from the Registry of Deeds and other sources.
Of those Registry plans, Plan #10701, #10582, #11892 depicted the land located south of
the parcel from which the "Ross" lot was subdivided while plan #10143 depicted the land
located north of the subdivision site. Those plans clearly identified adjacent parcels as
being bounded by stone walls, coincidental, as did the Assessors Maps.
Two other Registry plans, #11203 prepared on August 11, 1988 and #12356 prepared vn
November 18, 1993 defined the property lines of Parcel 1 and Parcel 2 [a/k/a lot 1 & 2] as
well as lot 3 that were subdivided from the property from which the Ross lot was
subdivided.

Please be advised that this office represents Mr. Joseph Russo who owns property at 213
Berry Street in North Andover. It has been brought to our attention that a Nathan Brooks is
constructing a home at Lot 5, which would legally be 219 Berry Street.
As you well know, Berry Street is a private way and has not been accepted by the Town
of North Andover. The Mass General Laws only permits construction of a home along a public
way, and in the absence of same, Mr. Brooks would have to apply to the Zoning Board for
permission to construct something, and he must comply with the zoning setbacks and area size
for the Town of North Andover. I am also advising you that there is a serious dispute as to the
location of his lot, the size of his lot, and his ability to comply with the setbacks. Consequently, I
would suggest that you issue a Cease and Desist Order to Mr. Brooks, until there is a resolution
of the lot size, lot location, and sideline requirements, and until he obtains permission from the
Zoning Board to construct his home.

input and consideration in this matter.

Dear Mr. Brooks:
Enclosed is the Building Permit for the construction of a single family dwelling on the above -
referenced property.
As you know, Attorney Robert Minasian (who represents Mr. Joseph Russo) has verbally asserted
a claim of adverse possession to a portion of your property and he has written to me challenging
the validity of your surveyor's opinion as to the location of the boundary between your property
and Mr. Russo's property. To my knowledge those claims have not been adjudicated in a court of
law.
1 recommend that prior to constructing your house you consult with your legal counsel as to the
potential effect of such claims (if the claims are adjudicated against you) upon:
A your tot's compliance with the Town's Zoning Bylaw,
➢ the validity of any permits issued by the Town and
the risks you face if the house is constructed.
As always, please call the Building Department if you have any further questions.
