CJS oven hereinafter called owner, witnesseth: o 1 E- qS - 5'73 f C 9Pi8-g4's-LIQ 9y That K & H for consideration hereinafter recited agrees with the owner to perform the following specified work in accordance with the attached specification sheet which is incorporated by reference and made a part of this agreement and further to furnish and install a swimming pool on owner's property in accordance with the specifications. In addition the following terms and conditions shall apply to this agreement: A. Contractor will backfill and return yard to rough grade, but will accept no responsibility for damage to grass, lawns, shrubbery, trees, driveways or patios. The Owner shall be responsible for the pool location being within his property lines and clear of setbacks. The Owner will provide access to the pool site for power excavating equipment and trucks. Grading around pool to be left in an orderly manner free of construction debris, but not seeded. B. This contract is based on normal excavation conditions. The contract price herein stated does not include any additional expense involved in the removal of hard formations by the use of blasting or power equipment, the filling of cavities or drainage areas because of such formations or otherwise, the correction of conditions by the use of fill, shoring, or otherwise due to underground or surface water, inadequate soil bearing qualities or other conditions requiring same. Therefore, if such conditions occur during or after excavation, the contractor shall notify the Owner of same and the Owner shall immediately notify the contractor in writing whether or not to continue. If work is stopped by the Owner, the Owner shall pay the contractor on billing for all work performed and materials furnished. If work is continued by order of the Owner, the Owner shall pay the contractor on billing any extra costs incurred due to such conditions plus 15% thereof. Owner agrees to pay any additional costs of machine time and trucking over and above the normal excavation time C. Should contractor meet any underground or overhead pipes or wiring, such as water, gas, sewers, cesspools, septic tanks, leaching fields, electrical or telephone, Owner agrees to pay cost of rerouting same. A K&H shall obtain all necessary permits at the owners cost prior to the start of the work and shall be responsible for the work being done within his property lines and clear of -2 - easements or setback restrictions and for the adequacy of utilities. Contractor shall provide pool plans necessary to secure permits. Owner shall arrange for any necessary land surveys or plot plans, and provide needed water to fill pool, at his cost. E. K & H guarantees all workmanship and materials for one year from the date of completion of the pool. F. It is mutually agreed between the parties that pool accessories such as filter, ladder, diving board, light and vacuum are not fixtures and remain the property of K & H until such time as final payment is made. G. K & H shall not be responsible for damage or discoloration of pool walls due to neglect, unforeseen chemical reaction, nor shall contractor be responsible for damages to any part of the swimming pool or around said pool, or resulting from any natural cause or act of God, including earthquakes, fires, ground swells, inundation's and/ or hillside motion, landslides or any natural or accidental cause of peril. H. Use of the pool prior to the connection of the filter and placement of coping shall render the K & H `s warranty void. L It is understood and agreed that One Thousand and 00/100 ($1,000.00) Dollars deposit tendered in accordance with this contract to K & H shall be non-refundable after the expiration of three (3) days from the execution of this contract. It is further understood and agreed that the One Thousand and 00/100 ($1,000.00) Dollars deposit shall be retained by K & H not as liquidated damages but as actual damages incurred as a result of commencing work, ordering supplies, laying out the job, and otherwise as part and incidental of the contract itself. In the event that the Owner fails to make further payments beyond the One Thousand and 00/100 ($1000.00) Dollars and cancels the work hereunder, then the One Thousand and 00/100 ($1000.00) Dollars shall be retained by K & H.
