Regular Meeting - 1 Hearing
The BOARD OF APPEALS held its regular meeting on Monday evening, February 14,
1972 at 7:30 P.M. ~.u the Town Office Building with the following members present
and voting: J. Philip Arsenault, Esq., Chairman; Kenneth E. Pickard, Vice Chair-
man; Arthur R. Drummond, Frank Serio, Jr. and Associate Member James A. Glynn, Jr.,
Esq., who sat in place of regular member Dr. Eugene Beliveau.
There were l0 people present for the meeting.
1. HEARING: Dr. WilliamJ. Patterson.
Chairman Arsenault read the legal notice upon the application of Dr. William J.
Patterson who requested a variation of Section 7.22 of the Zoning By-Law so as to
permit the erection of a single family dwelling on the premises located at the west
side of Highland Terrace at the corner of Wilson Road.
Dr. Patterson spoke in his own behalf and explained that he needs a variance for
setbacks in order to properly place the house on the "L" shaped lot. There are
sewerage facilities on the street. He feels that the lot is of adequate size;
other homes on the street have 20 feet frontage or less. This will be the last
buildable lot in the neighborhood. Many of the other structures in the area do not
conform; some are closer to the lot lines than what he is asking. He said the last
three dwellings built in the area are on lots smaller than his. There is 156 feet
frontage on the street. The character of the neighborhood is village residential.
He needs a 20 foot front setback and 15 foot sideline setback and this will be a
single family house.
No one else spoke and there was no opposition.
Mr. Pickard made a motion to take the petition under advisement; Mr. Drummond
seconded the motion and the vote was unanimous.
The Board then discussed the merits of the petition. Mr. Glynn made a motion to
GRANT the variance for a single family residence and the condition that part of the
garage shown on the plan be razed. Mr. Pickard seconded the motion and the vote was
unanimous. The Board found that the lot was unique in that it was irregularly shaped
and that it would be difficult for the petitioner to so position the bu!ldd_ng on the
lot to comply with the setback and sideline requirements. Allowance of the variance
would not substantially derogate from the requirements of the By-Law nor be detri-
mental to the area in that there are a number of lots in the neighborhood that have
less than the required number of square feet and on which lots ~!ldlugs are placed
closer to the lot lines than the By-law requires. Therefore, the Board finds that
the general building scheme of the neighborhood would not be disrupted.
BUILDING INSPECTOR POSITION:
The Board discussed the matter of making recommendations to the Selectmen
regarding the position of a full-time Building Inspector. A meeting had been held
by the Selectmen with various town boards and officials relative to makingithe
position full-time and the Selectmen had asked each of them to report to the Selectmen
making recommendations and listing duties, etc. of that position. The Board dis-
cussed several duties the Building Inspector performs for the Board of Appeals, such

Investigations and reports of gravel and earth removal permits.
3. He has to investigate when au application is made for a building permit to
see whether or not the person has to go to the Board of Appeals.
~. He handles all complaints ~ade to the Board of Appeals and his office of
alleged violations of the Zoning By-Law.
The entire Board feels that there should be a full-time Building Inspector. There
is alot of work to be done and it is necessary that he be given enough time to
properly perform his duties and for the protection of the town.
Chairman Arsenault will compose a rough draft for the next meeting, to be discussed
further.
DAVIS & FURBEENACHINECO~ANY:
Several people from the Water Street area were present and asked the Board
several questions regarding the petition of dividing the Davis & Furber houses on
Water Street because they want to buy them.
Chairman Arsenault expl, lued the vote of the Board; that two of the members thought
it was in the best interests of everyone concerme~ to wait until after Town Meeting
to see what action was taken. The vote to file the decision was 2 in favor, 2
against and i abstaining.
Mr. William Bamford asked what assurance they would have that it would pass at
Town Meeting. Barbara Eldredge asked what happens if it doesn't pass Town Meeting.
Chairman Arsenault explained that one of the conditions was that
zoned to residential. He can't speak for the other members, but
that if it does not pass Town Meeting, the variance would not be

Atty. John J. Lynch also spoke and said that the conditions were agreed to and then
after the people left it was changed.
Chairman Arsenault tried to explain that nothing was changed, there is a misunder-
standing.
The meeting adjourned at 8:30 P.M.
