Please be advised that on several occasions the Building Department has asked you to move your shed
off the lot line. On June 4"' we observed a family member renovating theag rage without permits. On
Friday we placed a stop work order on the property for violation of the Massachusetts building code
renovation without permits.
780 CMR 5110.1 Permit Application. It shall be unlawful to construct, reconstruct alter, repair, remove
or demolish any detached one two family dwelling; or to install or alter any equipment for which a
provision is made or the installation of which is regulated by 780 CMR 51-99 without first filing a
written application with the building official and obtaining the required building permit and all other
required permits therefore. Exemption 5110.3 sheds less than 120 sq feet, Sheds over 120sq ft require
permititing
Also observed Chickens/farm animals in the back yard.
Town Zoning Bylaw in a Residential 4 District.
Article 4.122 - 6
b. On any lot of at least three (3) acres, the keeping of a total of not more than three (3) of any
kind or assortment of animals or birds in addition to the household pets of a family living
on such lot, and for each additional acre of lot size to five (5) acres, the keeping of one
additional animal or bird; but not the keeping of any animals, birds or pets of persons not
resident on such lot.
c. On any lot of at least five (5) acres the keeping of any number of animals or birds regardless of
ownership and the operation of equestrian riding academies, stables, stud farms, dairy farms,
and poultry batteries.
10.13 Penalty for violation
Whoever continues to violate the provisions of this bylaw after written notice from the building Inspector
demanding the abatement of a zoning violation within a reasonable time, shall be subject to a fine of three
hundred dollars ($300). Each day that such violations continue shall be considered a separate offence. You
have multiple violations observed.
Your farm animals are also in direct violation of the zoning bylaws and must be removed immediately.
Failure to remove the chickens will result in a fine not to exceed $300 per day until the violation is
corrected.
