Dear Mr. &Mrs. Castricone,
This letter has been prepared as a follow up to my phone conversation with you and your
contractor,Gary Liss regarding your building permit for the above-referenced property.As you may
know, the North Andover Conservation Department REJECTED your building permit
application for the construction of a 72'x38' addition associated with an existing single-family
house and two (2) decks. During my site inspection on May 17,2006,I observed a jurisdictional
stream that traverses along the western (rear) portion of your property.Please be aware any work
proposed within 100-feet of jurisdictional wetland resource areas must be preceded by a Request for
Determination of Applicability (RDA) or Notice of Intent (NOI) application (whichever is
appropriate) before the North Andover Conservation Commission (NACC),per MA Wetlands
Protection Act-M.G.L. c.131, §40 and the North Andover Wetlands Bylaw (C.178 of the Code of
North Andover).Additionally,under the provisions in the North Andover Wetlands Protection
Regulations,the NACC enforces a 25'No Disturbance Zone and a 50'No Build Zone from the
edge of a wetland resource. Currently,your addition is proposed approximately 45' from the banks
of adjacent stream.
Due to the extent of the work and the proximity of the wetland to your proposed project,you will
be required to file Notice of Intent(NOI)with the NACC.This will require you to hire a
Professional Wetland Scientist to delineate stream bank and any other jurisdictional wetland
resources within 100-feet of the proposed project In addition,a Professional Civil Engineer or
Registered Professional Land Surveyor would need to prepared a plan showing all proposed
activities;the wetland boundary and its associated Buffer Zone (25'No Disturbance Zone,50'No
Build Zone,and 100'Buffer Zone),and a limit of work defined by an erosion control line (trenched

be doing any grading or landscaping the existing lawn. If you intend to do so,please incorporate any
proposed grading into your application and reflect it on the plan.You will also be required to file a
waiver as you are proposing work within the 50'No Build Zone and potentially within the 25'No
Disturbance Zone.

The Board finds that 31 Court Street may be granted a Special Permit from 9.2 in order to extend a pre-
existing,non-conforming structure on a pre-existing,non-conforming lot in order to add a 2nd unit,within
the addition's extension and that a 2nd unit is in harmony with the general purpose and intent of this Bylaw.
The Board finds that the 2n'unit is 1337.3 sq.ft.,and is less than the maximum 1500 sq.ft.and that the
proposed addition's roof shall be lower than the main roof and shall be at the same pitch. The Board finds
that the 2nd unit is contained within the main unit's shell,requiring no additional Variance for the second
unit. The Board finds that 31 Court Street,as developed into a 2family dwelling,will not adversely affect
the neighborhood nor will there be nuisance or serious hazard to vehicles or pedestrians. Adequate and
appropriate facilities will be provided for the proper operation of the proposed use because water,sewer,
and electricity are provided to Court Street and the Plan of Land shows a 2-stall garage and 2 off-street
parking spaces ftuther than 10'from any lot line. The Board finds that this Special Permit is consistent
with the Master Plan.The Board finds that 31 Court Street is an appropriate location for a second unit. The
Board finds that 3 2-family units are direct abutters to 31 Court Street;and 3 other 2 family units are in the
immediate neighborhood,as shown by the Assessor's tax maps and property cards of the Court Street area
submitted by the applicant to the April 11,at the Board's request during the March 14,2006 meeting. The
Court Street area contains a variety of architectural styles for single and 2-family dwellings;the proposed 2
family dwelling is similar to existing dwellings on Court Street. The Board finds that there was no written
or spoken opposition during the March 14 or the April 11 hearings.
Note: The granting of the Variance and/or Special Permit as requested by the applicant does not
necessarily ensure the granting of a building permit as the applicant must abide by all applicable local,

Based on the evidence and testimony presented at the March 14,2006 hearing,the Board finds that the existing
single-family dwelling has a conforming south side setback and a front setback of 13.8' from Court Street,and
that the average setback for 250' on each side of 31 Court Street is 16'. According to the submitted application,
the parcel was purchased by the petitioner May 25,2005 from Mario Castricone,and is recorded in the Northeast
Registry of Deeds,Book 3238,Page 271. The Board finds that owing to circumstances relating to the topography
(the land drops downwards to the rear lot line)determined the location of the existing structure,especially
affecting 31 Court Street but not affecting generally the R-4 zoning district in which it is located,a literal
enforcement of the provisions of 7.3 and Table 2 would involve substantial hardship,financial or otherwise,to the
petitioner. The Board finds that the north abutters wrote that they had no objection to relief on the front entryway
and the south side abutters wrote that they did not oppose the request to come within 12 feet of their property line
that there was no written or spoken opposition during the March 14 hearing. The Board finds that the specific
reason. The Board finds that desirable relief may be granted without substantial detriment to the public good,that
the applicant has made provision for the required 2 parking spaces per dwelling unit without nullifying or
substantially derogating from the intent or purpose of the North Andover Bylaw.
Note: The granting of the Variance and/or Special Permit as requested by the applicant does not necessarily
ensure the granting of a building permit as the applicant must abide by all applicable local,state,and federal
building codes and regulations,prior to the issuance of a building permit as required by the Building
Commissioner.

Design dated 12/26/05 for general structural conformance to the Massachusetts State
Building Code 780 CMR, Sixth Edition. Our general review included the foundations and
structural framing as shown on Drawing Sheets 8 and 9. Additionally, we specifically
reviewed and performed calculations (see attached) for the engineered wood beam and
steel beam shown on the Drawings.
Based on the items reviewed above we conclude that the structural design as shown on
