Witnesseth, that the Contractor and the Owner for the considerations named agree as follows: Article 1. Scope of the Work The Contractor shall furnish all of the materials and perform all of the work as described in the Specifications below and attached hereto as it pertains to work to be performed on property at 38 Monteiro Way, N. Andover Ma. Article 2. Time of Completion The work to be performed under this Contract shall be commenced within two weeks of receipt of the building permit and shall be substantially completed in 4-6 weeks. Time is of the essence. Article 3. The Contract Price The Owner shall pay the Contractor for the material and labor to be performed under the Contract the sum, of THIRTY NINE THOUSAND ONE HUNDRED THIRTY SIX dollars ($39,136.00), subject to additions and deductions pursuant to authorized change orders. Article 4. Progress Payments Payments of the Contract Price shall be paid in the manner following: Payment # 1- At contract signing- $5000.00 Payment # 2- Receipt of permit- $ Payment # 3- After Demo -$5000.00 Payment # 4- Substantial completion of rough frame -$7000.00 Payment # 5- Substantial completion of siding-$ Payment # 6- At rough electrical & plumbing inspection -$5000.00 Payment # 7- Substantial completion of wall board -$5000.00 Payment # 8- Substantial completion of kitchen cabinets- $5000.00 Payment # 9- Substantial completion of trim work -$2500.00 Payment #10 -Substantial Installation of flooring - $3500.00 Payment #11- Final completion- $1136.00 Article 5. General Provisions 1. All work shall be completed in a workman -like manner and in compliance with all building codes and other applicable laws. 2. To the extent required by law all work shall be performed by individuals duly licensed and authorized by law to perform said work. 3. Contractor may at its discretion engage subcontractors to perform work hereunder, provided Contractor shall fully pay said subcontractor and in all instances remain responsible for the proper completion of this Contract. All contractors & subcontractors must be registered by the administrator and any inquires relating to a registration should be directed to the administrator. 4. Contractor shall furnish Owner appropriate releases or waivers of lien for all work performed or materials provided at the time of final payment. 5. All change orders shall be in writing and signed both by Owner and Contractor, Mitchell Design & Const. Inc shall not be liable for any implied or oral statements made by any subcontractor or representative that is not in the written project scope or signed change order. M# & 6. Contractor agrees to remove all debris and leave the premises in broom clean condition. All excess materials not incorporated into the job remain the sole property of MITCHELL DESIGN & CONSTRUCTION INC. 7. In the event Owner shall fail to pay any periodic or installment payment due hereunder, Contractor may cease work without breach pending payment or resolution of any dispute. In the event that a payment is not made on the due date, interest shall accrue at a rate of 1 '/2 percent per month along with collection costs and attorney fees. 8. : All disputes hereunder shall be resolved in the Commonwealth of Mass. In the court of Middlesex County. 9. Contractor shall not be liable for any delay due to circumstances beyond its control including strikes, casualty or general unavailability of materials. If any delay is realized as described it is understood that the contract completion date will be extended equally. 10. Contractor warrants all work for a period of 12 months following substantial completion. Warranty is null and void if last payment is not made IN FULL. 11. The contractor shall exercise care in performing all work, but shall not be responsible for stress cracking of plaster, loosening, or nail/screw popping of existing walls & ceilings. Should any repairs be made the contractor will not be responsible for repainting or refinishing. The contractor is not responsible for accidental damage caused to landscaping, sidewalks, and/or asphalt paving caused by implementation of said work. 12. The contractor shall match existing conditions as best as possible where applicable. (Sometimes it is impossible to match color and/or texture such as stucco, plaster, siding, roof shingles, etc.) 13. The owner shall provide sanitary facilities for the workers during construction. 14. The owner shall provide electrical power for lighting and equipment to perform said work. 15. Should a permit or financing for this project be unobtainable, the deposit shall be refunded less reasonable contractor costs. 16. The contractor may place a sign on the property during, construction advertising his name, telephone and abilities. 17. The owner has the right to cancel this agreement provided the contractor is notified in writing by mail posted, or by delivery not later than the 3`d business day following the signing of this agreement. 18. Contractor shall obtain all necessary permits for the work to be performed. The fee for said permits shall be in addition to the contract price in article #3 19.
