Regular Meeting -1 Hearing
The BOARD OF APPEALS held its regular meeting on Monday evening, June 12, 1972
at 7:30 P.M. in the Town Office Building with the following members present and
voting: Kenneth E. Pickard, Acting Chairman; Dr. Eugene A. Beliveau, Clerk;
Arthur R. Drummond and Frank Serio, Jr. Chairman J. Philip Arsenault was unable to
at t end.
There were 7 people present for the meeting.
1. HEARING: Joseph & Nancy Mulvey.
Joseph & Nancy Mulvey petitioned to request a variation of Sec. 4.04& 7.3 of
the Zoning By-Law so as to permit the erection of a one car garage, 17' x 30',
nearer the lot line than is allowed at ll Saunders Street.
Nancy Mulvey explained that the surveyor was tunable to have the proper plans ready
for the meeting and requested that the hearing be postponed indefinitely until the
plans have been prepared.
Mr. Serio made a motion to postpone the hearing indefinitely; Dr. Beliveau seconded
the motion and the vote was unanimous.
2. GILBERT REARENEWALOF PERMIT.
Atty. Harold Morley, Jr. and Gilbert Rea appeared before the Board. A letter
had been submitted requesting renewal of the earth removal permit and a continuous
bond in the amount of $20,000.
Mr. Serio made a motion to renew the earth removal permit; Mr. Drummond seconded
the motion and the vote was unanimous.
3. SILVIO MARTINOLI:
This hearing had been continued from the May 8, 1972 meeting.
and three abutters were present.

After some discussion, Mr. Serio made a motion to GRANT the variance for the pro-
posed addition to the house; Dr. Beliveau seconded the motion and the vote was
unanimous.
Mr. Serio also made a motion to DENY the erection of the garage as shown on the
plan; Mr. Drummond seconded the motion and the vote was unanimous. The Board feels
that a variance is not necessary for the garage since it can be placed on the lot
and properly meet the setback requirements in the residential portion of the lot.
The Board found no hardship, financial or otherwise, requiring the Board to grant
a variance with respect to the garage. The Board found that the residence was
unusually small and that a hardship would result to the Owner if he were not
permitted to make the proposed addition to the house. The neighborhood would not
be adversely affected and the addition would not result in a substantial change
in the character of the lot.
The meeting adjourned at 8:00 P.M. in order that everyone might attend the Special
Town Meeting at the High School.
