AGREEMENT: That the HOMEOWNERS currently own a house described as 42 Penni Ln. North Andover, Massachusetts, .herein after referred to as the HOUSE and are desirous of building a two story addition, the type and specifications of which are contained in the plans (with some changes agreed upon by both parties) drawn by Joseph Saia Jr. Registered Architect, specification sheets, allowance sheet, payment schedule, and notes sheets attached. This agreement will take first precedence in the case of any discrepancies between the house plans and this agreement. The CONTRACTOR shall build the addition for the sum of $157,000.00 (one hundred fifty seven thousand dollars) which payment shall include some materials and labor. What the price does and does not include is specified in the plans and specification sheets. The CONTRACTOR and HOMEOWNERS both agree that any changes in the plans and specification sheets must be made with the consent of both the CONTRACTOR and the HOMEOWNER with a signed change order. The CONTRACTOR and the HOMEOWNERS both agree that any extras will be paid in full and in advance. If any disagreement occurs during the project, the HOMEOWNERS agree to pay the CONTRACTOR for all labor and material costs incurred by the CONTRACTOR until that point, and the CONTRACTOR will be freed of all obligations to the HOMEOWNERS. The CONTRACTOR will be responsible for liability insurance and workman's compensation insurance. All other insurances are to be carried by the HOMEOWNERS. The CONTRACTOR and the HOMEOWNERS both agree to the payment schedule and the HOMEOWNERS agree to make the payments no later than 2 days after the payments become due. The HOMEOWNERS agree to move themselves and all of their belongings out of a portion of the existing HOUSE. The CONTRACTOR will not be responsible for any of the HOMEOWNERS belongings, it is the HOMEOWNERS responsibility to move, store, and protect all of their belongings. The project is scheduled to begin on April 1, 2010 and is scheduled to be completed by March 15, 2011. Any blasting, rock splitting, removal of buried waste or boulders, removal of contaminated soil or any type of contaminates, etc. are not included and will be an extra if necessary. • The CONTRACTOR will provide the material and labor for a 10" thick concrete foundation with 2 standard basement windows and a 10" X 20" concrete footing as needed. • The CONTRACTOR will provide an opening through the existing foundation to access the basement of the addition. • The CONTRACTOR will run a 4" interior drain pipe to a sump pump chamber (the HOMEOWNERS are to provide a sump pump, outletpipe, and electrical outlet if desired). • The basement will have a 4" poured concrete floor and will be unfinished. *Please note that the ceiling height of the addition basement will be approx. 8" lower than the existing basement ceiling height. * Please note that all concrete to be used will be 3,000 mix. * Please note that due to construction, some trees/plants/bushes/flowers/grass/etc. may be damaged and it is the HOMEOWNERS responsibility to replace them. For 780 CMR 5602.10.3 Methods 2., 3., 4., 6., 7. and 8., each braced wall panel shall be at least 48 inches (1219 mm) in length, covering a minimum of three stud spaces where studs are spaced 16 inches (406 mm) on center and covering a minimum of two stud spaces-wbere studs are spaced 24 inches (610 nun) on center.
