4. Commencement and Completion of Work
Contractor will not begin work or order material before the third day of the signing of this agreement, unless specified here in writing.
Contractor will begin the work on or about May 5, 2010. Barring delay caused by circumstances beyond contractors control, the work
Will be completed by May 15, 2010. The owner hereby acknowledges and agrees that the scheduling dates are approximate and that such
Delays that are not avoidable by the contractor shall not be considered as violations of this agreement.
5. NO ACCELERATION OF PAYMENTS BUT ESCROWING ALLOWED
The Contractor may not require payments to be made in advance of the times specified in Section III (Payment) above for the reason that he deems
Himself or the payments to be insecure. If, however, he deems himself to be insecure, he may require, as a prerequisite to continuing the work
described herein, that the balance of the payments under this contract that are in the control of the Owner, shall be placed in a joint escrow account

6. INSURANCE
Contractor will be responsible to Owner or any third party for any property damage or bodily injury caused by himself, his employees or his
Subcontractors in the performance of, or as a result of, the work under this Agreement. Contractor agrees to carry insurance to cover such
Damage or injury.
7. SUBCONTRACTING
Contractor agrees that, notwithstanding any agreement for materials and/or labor between Contractor and a third party, Contractor is responsible to
Owner for completion of all work described in a timely and workmanlike manner.
8. CONSTRUCTION -RELATED PERMITS The following construction -related permits will be necessary in order
to complete the scope of work included in this Agreement:
Building permit to reconstruct side porch only will be supplied by contractor.

Electrical permit may be required and must be obtained by a licensed electrician, it was not known at the writing of this contract
If this service will be needed.
The Contractor under provisions of Chapter 142A of the General Laws is required to apply for and obtain all construction -related permits. The
Contractor shall not be deemed responsible for delays in the work described in this Agreement caused by regulatory, permit granting or
Inspectional agencies, authorities or individuals.
If the homeowner obtains his own construction -related permits for the work described under this agreement, the
homeowner is hereby advised that in the event of a dispute, judgment and nonpayment of the contractor, the
homeowner will not be entitled to make a claim to or collect from the guaranty fund established by Chapter 142A, M.G.L.
9. MODIFICATION
This Agreement, including the provisions relating to price (Section II) and payment schedule (Section III) cannot be changed except by a written
Statement signed by both Contractor and Owner. However, cancellation by Owner is allowed in accordance with the Notice of Cancellation.
10. WARRANTIES
The Contractor warrants that the work famished hereunder shall be free from defects in materials and workmanship for a period of
One (1) year following completion and shall comply with the requirements of this Agreement.
In the event any defect in workmanship or materials, or damage caused by the Contractor, his subcontractors, employees or agents
is discovered within one year after completion of any job, including cleanup, the Contractor
shall, at his own expense, forthwith remedy, repair, correct, replace, or cause to be remedied, repaired, or replaced, such damage or such defect in
Materials or workmanship. The foregoing warranties shall survive any inspection performed in connection with the agreed-upon work.
All warranties for equipment supplied by the Contractor under this Agreement shall be those given by the manufacturers of such equipment, which

11. COMPLETENESS OF AGREEMENT FOR EXECUTION
The Owner is hereby advised that he should not sign this Agreement unless and until all blank sections have been filled in or marked as void,

12. COPY OF AGREEMENT TO BE GIVEN TO OWNER

13. Rights to Cancel
The owner may cancel this agreement if it has been signed by the owner at a place other than an address of the contractor which may be
his main office or branch thereof, provided that the owner notifies the contractor in writing at his main office or branch by
ordinary mail posted, by telegram sent or by delivery,

Massachusetts General Laws chapter 152 requires all employers to provide workers' compensation for their employees.
Pursuant to this statute, an employee is defined as "...every person in the service of another under any contract of hire,
express or implied, oral or written."
An employer is defined as "an individual, partnership, association, corporation or other legal entity, or any two or more
of the foregoing engaged in a joint enterprise, and including tie legal representatives of a deceased employer, or the
receiver or trustee of an individual, partnership, association ox- other legal entity, employing employees. However the
owner of a dwelling house having not more than three apartments and who resides therein, or the occupant of the
dwelling house of another who employs persons to do mainte;3nance, construction or repair work on such dwelling house
or on the grounds or building appurtenant thereto shall not because of such, employment be deemed to be an employer."
MGL chapter 152, §25C(6) also states that "every state or 119,cal licensing agency shall withhold the issuance or
renewal of a license or permit to operate a business or to monstruct buildings in the commonwealth for any
applicant who has not produced acceptable evidence of coarnpliance with the insurance coverage required."
Additionally, MGL chapter 152, §25C(7) states "Neither the commonwealth nor any of its political subdivisions shall
enter into any contract for the performance of public work until acceptable evidence of compliance with the insurance
requirements of this chapter have been presented to the contracting authority:"

Ledger Joist : ( ledger joist supports the deck joist or decking on the bulding ).
2" x 8" preasure treated will be fastenend to the buildngs wood frame with lag screws .
Flashing : To prevent water entry at the point were the new deck meets the house.
Aluminum Flashing will be placed over the legder joist and against house under the siding
Main Joist : 2"x 8" preasure treated will be used as main Joist placed 16" O.C.
Deck frame will be fastened together with pneumatic gun nails 12d common galvanized
Rim or Box Joist : will be single and will be the same size and material as the main joist.
Trimmer Joist outermost joist on the deck will be single and will be the same size and material as the main joist.
Rough Openings in Deck: This deck will have no rough openings cut into it.
Joist Hangers : Joist Hangers will be installed as needed .

Newal Post : Deck will have three( 3 ) newal post built into the deck frame, positioned to receive stair and deck railings.
The Deck Newals will be 4" x 4"x 5' preasure treated post (Square).
The deck newals will be bolted in place with carriage boltes.
In addition to the 4" x 4" post a white vinyl sleeve will be placed over it to completely encase it.
Newal Post Tops: Tops of Deck newal post will be fitted on site with an ornamental cap glued & nailed in place.

In addition to the 4" x 4" post a vinyl sleeve will be placed over it to completely encase it.

Porch Post Headers ( open porches ): This header is used to distribute the weight of the roof and to build up the wall to the prof
Continuous headers will be built from 2 - 2" x 8" SPF lumber nailed together and supported by the 4" x 4" post.
Post and headers will be fastened to each other with Simpson strong tie # HTP37Z hurricane anchors.
An additional 2" x 4" spruce plate will be added to the top of this header to act as nailer for the rafters.
Header Finish Covering: The header will be capped with custom bent aluminum" white" (3 sides )
Deck Railings : This Deck will have four (4 ) railing sections with an opening for the stairs.
Railings will be fastened to existing newals or post.
Vinyl " Deck Railing " System:
The railing system will be made up of the following components.
Certainteed brand, Kingston style Rail Section, Flat, 2" x 2" Square Ballusters
Railing Assembly : Railing will be cut to fit between the 4" x 4" post. And assembled using provided hardware in kit
Stair Railings: This Deck will have one ( 1) Stair railing sections on the right ( as your looking up the stairs ).

Pitch of the roof : 3" rise (14.04° angle ).
Rafter Span : less than ten feet( 10')
Roof Style : Flat with slight pitch to match roof on enclosed porch .
Rafter Size : 2"x 6" lumber will be used to frame roof.
Roof Frame Joist Hangers Note : joist hangers not required this project.
Simpson H 3 style hurricane clips will be installed on each rafter at the plate .
Roof Sheathing: will be 1/2" SYP CDX plywood
Building Roof Trim: Will be aluminum cladding of framing members only three(3)sides.
Soffits/Ceiling ( underside of porch roofs )
Soffit will be Certainteed Vinyl Soffit Value Tech Triple 4" ( "solid " Colonial White ) ( this quote is based on this soffit and color)
Roof Covering
Aluminum drip edge 8" style D ( white ) will be place around the roof perimeter
Roofing underlayment : Bituthane membrane Grace ice & water shield or similar will be applied to entire roof surface
Roof covering and Color: Standing seam 29 gauge galvanized steel prepainted colorfast white.
Looks similar to the existing plastic pannels on the roof now ( eliminates trying to match adjacent asphalt roofing ).
This roof will be treated as a stand alone roof no effort will be made to tie it in with the adjoining roof.
A small flashing will be put between the two roofs to act as a divider strip.
The other alternative would be to re -roof the area over the enclosed porch this quote does not include this work.
Pick -Up & Delivery: All items required to complete this project will be picked up and deliverd by us.
