This letter is in regards to the property at 45 Woodberry Lane, North Andover, MA, 01845. Eric and Brenda Faulkner, the
principle owners of the property are inquiring about a special waiver permit for building a replacement deck on the back of
our house. We have hired and are working directly with the contractor, TPM Construction, L.L.C.
Specifically, we are planning on doing the following:
1. Building a 112 square foot (8X14) replacement deck that will extend off the back of the house from our
sliding glass door. The deck will be in a new position from the old deck. While it is slightly bigger then the old
deck, it will reside further away from the wet lands. It also does not extend out beyond the structure of our
home.
2. Creating a 294 square foot stone patio . It consists of a 250 square foot circle and a 44 square foot
rectangular section. The stone patio is being built with pavers.
3. Replacing a walk way with stone paver steps. The design will consist of a series of granite steps followed by
a landing area. The walk way was formerly made out of asphalt.
4. The distance from the start of the walk way to the wet land area is 61 feet. The walk way is the closest point
of contact between the back patio area and the wet lands. Furthermore,the walk way and the wetlands are
divided by 2 driveways, an upward slope and a stone wall.
I believe that we qualify for this waver because the new deck is further away from the wet land than the old
deck and because it does not extend beyond the foot print of our home. The back side of our house has an L
shape. The deck will be fitted into part of the L shaped area. Furthermore, as stated in#4 in the above list, the

new deck area and the wet lands area is divided by 2 driveways, an upward slope and a stone wall.

HISTORY AND BACKGROUND
On July 28, 2009, the applicant requested a waiver of the Watershed Protection District Special
Permit, in accordance with the North Andover Zoning Bylaw section 4.136.8, so as to allow the
construction of a 112 sq. ft. (8 X 14) replacement deck. The deck will replace an existing deck
and will be located further from the wetlands than the existing deck. The new deck will be
located within the 100-foot buffer zone to a Bordering Vegetated Wetland (BVW), within the
Non-Disturbance buffer zone of the Watershed Protection District.
The applicant is also creating a 294 sq. ft. stone patio, as well as replacing an existing walkway
with stone paver steps. The distance from the start of the walkway to the existing wetlands is
approximately 61 ft. There are two existing driveways, an upward slope and a stone wall that
divide the newly constructed walkway from the delineated wetlands.
The applicant was approved by the Conservation Commission as a Small Project on July 22,
2009.
DECISION
After a Planning Board meeting on the above date, and upon a motion by M. Walsh and 2nd by R.
Rowen, a vote was taken with regard to a waiver of the Watershed Special Permit. The vote was
unanimous in favor of the waiver.
FINDING OF FACT
The Planning Board has made its decision based on the following findings:
• The deck will replace an existing deck that was located closer to the wetland area.
• The new patio and walkway are separated from the wetlands by 2 driveways, and upward
slope and a stone wall.
• The plan has been approved by the Town of North Andover Conservation Commission.
• The proposed changes will not create a more detrimental impact on the wetlands that
exist on the property.
CONDITIONS
1. The applicant has agreed to have the Town Planner perform a minimum of two
inspections of the site during the construction process
2. Proper erosion control will be constructed and will remain throughout the project,
according to the conditions approved by the Conservation Commission.

Expansion of an Existing Deck,New Patio and Associated Grading
Conservation Conditions of Approval, NACC #57
Pursuant to section 4.4.2 A,F and J of the North Andover Wetlands Protection Regulations,Brenda
and Eric Faulkner,applicants/ homeowners,filed for a small project for work proposed at 45
Woodbury Lane, North Andover. The work consists of the construction 112 square foot(8' x 14') deck,
a 294 square foot stone patio and stairs (partially pervious) and associated grading. All work is
within the 100-foot buffer zone to a Bordering Vegetated Wetland (BVW) associated with an
intermittent stream which is located approximately 61 feet to the west of the proposed work at its
closest point. Soil disturbance for the work is limited to minor grading by a small bobcat. A
berm/stonewall and two driveways separate the proposed work from the wetland resource area. The
Conservation Department conducted a field inspection of the property and agreed with the location
of the wetland boundary.
During the July 22,2009 public meeting,the North Andover Conservation Commission(NACC)
voted unanimously to approve this project as described above. The following conditions were hereby
mandated for the proposed work:

3. Per section 4.4.5 of the Town of North Andover Wetland Protection Bylaw Regulations, hay bales
shall be placed at the drainage outlet located on the west side of the driveway to prevent the
erosion of stockpiled materials into the wetland resource area.
