Eric and Brenda Faulkner, the principle owners of the property are inquiring about a special waiver permit for building a replacement deck on the back of our house. We have hired and are working directly with the contractor, TPM Construction, L.L.C. Specifically, we are planning on doing the following: 1. Building a 112 square foot (8X14) replacement deck that will extend off the back of the house from our sliding glass door. The deck will be in a new position from the old deck. While it is slightly bigger then the old deck, it will reside further away from the wet lands. It also does not extend out beyond the structure of our home. 2. Creating a 294 square foot stone patio . It consists of a 250 square foot circle and a 44 square foot rectangular section. The stone patio is being built with pavers. 3. Replacing a walk way with stone paver steps. The design will consist of a series of granite steps followed by a landing area. The walk way was formerly made out of asphalt. 4. The distance from the start of the walk way to the wet land area is 61 feet. The walk way is the closest point of contact between the back patio area and the wet lands. Furthermore,the walk way and the wetlands are divided by 2 driveways, an upward slope and a stone wall. I believe that we qualify for this waver because the new deck is further away from the wet land than the old deck and because it does not extend beyond the foot print of our home. The back side of our house has an L shape. The deck will be fitted into part of the L shaped area. The work consists of the construction 112 square foot(8' x 14') deck, a 294 square foot stone patio and stairs (partially pervious) and associated grading. All work is within the 100-foot buffer zone to a Bordering Vegetated Wetland (BVW) associated with an intermittent stream which is located approximately 61 feet to the west of the proposed work at its closest point. Soil disturbance for the work is limited to minor grading by a small bobcat. A berm/stonewall and two driveways separate the proposed work from the wetland resource area. The Conservation Department conducted a field inspection of the property and agreed with the location of the wetland boundary. During the July 22,2009 public meeting,the North Andover Conservation Commission(NACC) voted unanimously to approve this project as described above.
