1 Hearing
The BOARD OF APPE~I~ held its regular meeting on Monday evening, July 10,
1972 at 7:30 P.M. in the Town Office Building ~ith the following members present
and voting: J. Philip Arsenault, Chairman; Dr. Eugene A. Beliveau, Clerk;
Arthur R. Drummond, Frank Serio, Jr. and Associate Member Louis DiFruscio who
sat in place of member Kenneth Pickard who was unable to attend.
There were six people present for the meeting.
1. HEARING: philip J. Chiarenza.
Dr. Beliveau read the legal notice in the appeal of Philip J. Chiarenza who
requested a variation of Sections 6.1, 6.2 & 6.3 of the Zoning By-Law so as to
permit the division of la~d into two lots on the premises located at the west side
of Massachusetts Avenue at the corner of Martin Avenue.
Atty. John J. W~l!is represented the petitioner, who was also present. He exp],~ed
that he wanted two lots, one to contain 7,070 sq. ft. having 117.~ ft. frontage on
Martin Ave. and 69.2 ft. frontage on Mass. Ave. a~ the second lot to contain 9,465
sq. ft. and 69.2 ft. frontage on Mass. Ave. The Zoning By-Law now requires 12,500
sq. ft. lots. A variance is needed on frontage, area and sidelines. Sewerage
facilities are available in the area. This is an area of sma1! lots laid out many
years ago. There are some features affecting these lots which do m~t affect others.
The building that is there now w~11 be removed. There have been variances granted
in the immediate neighborhood. The petitioner would like the two lots so that his
sons could possibly build there.
Gabriel DeFillippo, a resident in the area, was recorded in favor.
Mr. Degnan, Mr. Ippolito and Mr. Dufresne, abutters, were recorded as opposed;
they felt the land would be sold for speculation since "For Sale" signs had been
displayed on the premises and then had been recently removed.
Mr. Chiarenza has owned the land since 193~.
Mr. Drummond made a motion to take the petition under advisement; Dr. Beliveau
seconded the motion and the vote was unanimous.
After some discussion, fb~r of the Board members left to view the premises. Mr.
Dm~mond did not go since he was familiar with the area.
Upon their return, Mr. Drummond made a motion to ~r~nt the variance; there was no
second to the motion.
Mr. Serio made a motion to DENY the variance; Mr. DiFruscio seconded the motion
and the vote was ~-1, with Mr. Drummond voting no. The Board found that there
was no hardship involved, financial or otherwise.
The meeting adjourned at 9:30 P.M.
