Initials THINGS TO BE AWARE OF IN A CONSTRUCTION PROJECT Our team his taken great care to set expectations of situations that may arise during a construction project. Please read this section carefully so that you may understand common situations that may occur. PLEASE NOTE: Any work not stated in this agreement is not included in this proposal PROJECT MANAGEMENT & SCHEDULING: The schedule is an ever changing and disciplined activity. There may be times where it appears there is little activity at the site. Due to the nature of construction, we are still constantly planning, ordering materials, calling sub contractors, building officials, and preparing for the next phase. There may be occasional days where we will need to leave the site to attend to a warranty issue, allow personal time for workers on site, or have to deal with material delivery delays. Every effort will be made to eliminate these downtimes, and bring additional help or work Saturdays to make up for lost time. Customer understands the importance of resolving warranty issues for past customers as well as themselves. WORK HOURS, ACCESSIBILITY TO THE HOME, CLEARING OF BELONGINGS: GoodFellas Construction work day is typically Monday -Friday 7am-4pm. Extended work days or Saturdays may be needed to meet customer deadlines. Access to the home for GoodFellas is necessary for completion of this agreement. This includes plowing of driveways and keeping clear other access points to the home for deliveries, etc. GF may offer plowing services upon request. GF requests client to remove belongings and fragile items from the construction areas to avoid unnecessary damage. This includes photos, and artwork on walls that can potentially fall during movement, or demolition of the existing home. GFC will install a secured Realtor's lockbox on the property to ensure project is managed and completed in a timely fashion. UNFORSEEN',CONDITIONS: GoodFellas has not been contracted to fix or resolve unforeseen conditions or issues within the existing property or home: 1. Site conditions, topography/landscape, soil, granite/ledge, or drainage issues. 2. Rotting areas and improperly waterproofed or non -maintained areas of the home. 3. Customer requested changes (See AWO section) or any other changes outside of build agreement specifications. 4. Structural or existing, hidden, or "aging" infrastructure and mechanical systems within the home, topography/landscape. GF will take precaution in the handling of existing mechanical systems in the home. GF is not responsible for any issues that may arise while working with these systems. Design or material changes requested ,by the Customer(s). A.W.O details and price are agreed upon by both Customer(s) and GoodFellas Construction. A.W.O payments are required prior to additional work order being preformed and are not refundable. 2. Unforeseen conditions (see Unforeseen Conditions Section). 3. Your municipality's inspector may interpret or request additional work above and beyond the current state code. This work may trigger an Additional Work Order and schedule delays. Additional work orders are more costly when occurring during the production phase. AWOs will disrupt the flow of production & project management extend project timeline AWOs requiring excessive research and travel time may have a fee of $45 dollars per hour for research and development of order. Fee is due even if additional work order is unapproved. If additional work order is accepted, research fee will be waived. MASSACHUSETTS BUILDING CODE: All work performed in the home will be done so in a professional manner and to the Massachusetts 7th Edition Building Code. Carpentry and Carpentry Supervision will be completed by a MA Construction Supervisor. GF Responsible for all permitting and inspections unless otherwise noted in this agreement. CONCEPTUAL DRAWINGS AND LIGHTING PLACEMENT: Conceptual drawings are meant to help the customer visualize the'finished product. The drawings are in no way the "exact final results". GF will, in the closest possible way, match conceptual drawings presented to customer. Final placement of lighting is determined by structural members of the home and final placement will be determined at the electrical walk-through (after demolition). Drawings may have visual elements that are not included in the agreement. Please verify in the selections schedule any items in question. EXTERIOR WORK AND LANDSCAPING: Every effort will be taken not to disturb landscaping, trees, bushes, and grass. Landscaping and/or root systems of plants may be hurt or damaged during project especially during excavation, etc. During construction some of these areas may need to be disturbed to deliver final project. GF can also not warranty landscaping items will survive a move or transplate. DRIVEWAY NOTICE: GF cannot determine the structural integrity of the driveway. Heavy equipment, dumpster vehicles, and delivery vehicles may leave marks, and even damage driveways that have been not properly maintained, have been improperly installed, or have exceeded their life expectancy. SCHEDULING AND DELAYS: GF will make every attempt to complete project within the time identified. Schedule slippage may occur due to the following: Material selections & deliveries, permitting & building inspection delays, weather, Additional Work Orders, and Unforeseen conditions. Cust. Initials 2GL'� .N 16 LICENSING and INSURANCE: All trades persons will carry the proper license and insurance for the respective task performed. TRASH AND CLEANUP: GoodFellas will leave the job -site broom clean at the end of every work day. GoodFellas is responsible for all job waste removal either by on-site container or to another off-site dumpster. Customer agrees to not use job dumpster for personal debris removal unless contractor provides written change order to be paid by the customer at an agreed sum. Dumpster company may be charged for additional household items, and will bill GoodFellas Construction. Hazardous materials may result in serious fines, and return of du mpster to customer's property. CUSTOMER SUPPLIED ITEMS: GoodFellas cannot assume liability for manufacturer's warranties on customer supplied items. GFC will use customer supplied items to the best of our ability. Same will apply for reusing or installed products. If installed products being reused break during the removal GFC is not responsible for replacement. CONSTRUCTION AREA CAUTION: Construction areas can often be "in -process" and customer should not proceed with caution into potentially dangerous areas without first asking. GFC is not responsible if customer enters construction areas and damages in -process flooring, heating, mechanical, etc. Customer agrees to not carry construction dust / debris into other parts of the home where finished surfaces may be present and could become damaged. SUBCONTRACTOR INFORMATION: Subcontractors hired to work on project, work for GoodFellas Construction during the project. Any additional work needed on house in contracted area or other parts on the house have to be approved by GoodFellas as an additional work order. Customer agrees not to hire subcontractors directly during the project time frame. CONCRETE: It is a normal part of the curing process for concrete to crack. PLASTER: It is common for plaster to develop cracks. Cracks in affected construction area will be addressed at the 1 year walkthrough by GF. FLOORING Prefinished hardwood flooring will have imperfections due to the way it is manufactured and installed. Prefinished hardwood will not be installed in sub level living conditions. Engineered hardwood flooring is recommended in damp and sub -level applications. Throw rugs or other larger items placed on recently installed floors can cause the covered area to discolor or oxidize at a different rate from uncovered areas. This curing period can differ based on site conditions, but is typically within 30 days. Traditional hardwood installations with a 3 coats process could have dust particles in the final finish due to the remodeling process and is normal. Initials and natural stone the will exhibit waviness and flared corners. This complicates consistency in grout lines. Client will seal grout 30 days after tile installation. Carpet: Customer should use caution when moving or dragging furniture across carpeting. Carpet will also be damaged by "beater brushes" on household vacuum cleaners. Client should use extreme caution or they will void carpet warranty and damage the carpet. I BASEMENTS AND WATER ISSUES: Finished basements are recommended to have adequate waterproofing prior to a basement refinishing. Additions on homes have been known to change water movement around the foundation of the home. Customer please take notice to clean and maintain gutters, to prevent any water pooling issues before, during, and after construction. Poor water tables are considered an unforeseen condition and may result in sump pump installation, and is not included unless specified in this agreement. Basement sump -pump drained to the outside may also cause pooling of water where it is discharged. Customer to make landscaping changes if necessary to mitigate such issues. USE OF ELECTRICITY: The customer agrees to provide electricity as part of this project. FINISH LIST, TOUCHING UP, OCCUPANCY: Customer agrees to make (1) final walk through and make a list of painting, flooring, knicks, scuffs, etc and other areas of concern. Once customer has taken use of space, GF cannot assume liability for any future intentional or unintentional damage of these areas. HOW TO DETERMINE REQUIREMENT OF A TOUCH UP: It is an Industry standard to determine if a finished surface area is blemished from a distance of 4' (Feet) away from an area. WARRANTY: GoodFellas Construction Warranty on all projects is to the term of (3) years. GoodFellas will assist customer with manufactures warranties (customer supplied products excluded). After 90 days the customer will receive a 90 day follow up phone call regarding the project. At the one year anniversary GoodFellas will perform a walkthrough of the project to inspect project. Normal customer maintenance is not included in warranty. Warranty is activated at client use of space, and is fully activated at acceptance final payment. CARE FOR FINISH PRODUCTS AND MATERIALS: Customer is expected to properly maintain all products supplied by GF. All finished surfaces should be treated- with extreme care. Sinks, Cabinetry/Furniture, Counter Tops, etc should remain dry and free of potential contaminants. PAYMENTS:I Checks will be made to: GoodFellas Construction Mgt LLC. Payments will be due at agreed upon times stated in the contract. If payments are not paid on scheduled job payment times work will come to a stop until payments are made. Non payments are also subject to an annual interest rate of 18% or 1.5% per month. Insufficient funds for payments being deposited from customer will result in a $35 banking fee to be paid by customer. Client assumes any of GF's costs for accepting wire transfers for payments. ' DISPUTES: The contractor and the customer hereby mutually agree in advance that in the event that the contractor has a dispute concerning this contract, the contractor may submit such dispute to a private arbitration service which has been approved by the Office of Consumer Affairs and Business Regulation and the consumer shall be required to submit to such arbitration as provided in MGL c 142A. If you cancel, you must make available to the seller at your residence, in substantially as good condition as when received, any goods delivered to you under this agreement; or you may if you wish, comply with the instructions of the seller regarding the return shipment of the goods at the seller's expense and risk. If you do make the goods available to the seller and the seller does not pick them up within twenty days of the date of your notice of cancellation, you may retain or dispose of the goods without any further obligation.
