Contractor will begin the work or order the materials before the third day following the signing of this agreement, unless specified here in
writing contractor will begin work on or about 3/1/06.
Barring Delay caused by circumstances beyond Contactors control, the work will be completed by 7/30/06. The owner hereby acknowledges
and agrees that the scheduling dates are approximate and that such delays that are not avoidable by the Contractor shall no be considered as
violations of this agreement.
Section 11- Warranty
The Contractor warrants that the work furnished hereunder shall be free from defects in materials and workmanship for a period of 1 year
following completion and shall comply with the requirements of this Agreement. In the event any defect in workmanship or materials, or
damage caused by the Contractor, his subcontractors, employees or agents, is discovered within one year after completion of any job,
including cleanup, the Contractor shall, at his own expense, forthwith remedy, repair comet, replace, or cause to be remedied, repaired, or
replaced, such damage or such defect in materials or workmanship. The foregoing warranties shall survive any inspection performed in
connection with the agreed-upon work.

General
Building permit will be provided by contractor. No allowance has been made for variance approvals if required
by town.
Demolition
Entire second floor will be completely gutted by owner. No allowance has been made for any interior demolition
on second floor by contractor. Existing roof on main section of house will be completely removed.
Building
All frame, roof, and siding materials will be provided to match existing / meet building code. All floor, wall and
roof sheathing will be fir plywood . ( 3/4 on floor, 1/2 on walls, 5/8 on roofs ) Exterior walls will be 2x4, ceiling
joists will be 2x8, rafters will be 2x10. Entire shed dormer will have ice& water sheild roofing undedayment
installed. Roof shingles to match existing. Exterior walls will be wrapped with Tyvek or equivalent. Siding will be
vinyl ( to match existing ). No allowance has been made to provide windows, (windows will be provided by
owner).
Plumbing
Plumbing required to add three fixture full bath on second floor will be provided. Copper pan will be provided for
Ul,tile shower, Simmons shower valve, and Kohler toilet have been included. An allowance of $150 has been
included for bath faucet.
Electrical
Electrical work required to wire second floor to meet code will be provided. Each bedroom will be wired for
overhead lights. Bath fan / light will be provided. Surface mounted fixtures to be supplied by owner. Cable /
phone / computer lines will be roughed -in by electrician, to be connected by their service provider at owner's
expense. General layout to be approved by owner prior to rough. No allowance has been made for any
recessed lights. Electrical work required on first floor to remove walls will be provided. No allowance has been
made to upgrade existing electric service.
Heating/Air Conditioning
Existing second floor zone of heat will be relocated as required to properly heat new bedrooms / bath . All new
baseboard will be provided. No allowance has been made for any air conditioning.
Insulation
Entire second floor will be insulated to meet code. (R-13 in walls, R-30 in ceilings)
Plaster
All areas on second floor will be blueboarded and skimcoat plastered. Walls will be smooth, closets will be
textured, ceilings to match existing.
Interior Trim/Doors
Pre -primed interior trim and doors will be provided to match existing. Six -panel solid core door units will be
provided as shown on plan.

SECTION 9 NON-CONFIORMIlVG USES
,a
9.1 Non -Conforming Uses A
Any non -conforming building, structure, or use as defined herein, which lawfully existed at the time of passage of {
the applicable provision of this or any prior by Law or any amendment thereto may be continued subject to the
provisions, of this Bylaw. Any lawfully non -conforming building or structure and any lawfully non-confomling 4 Y
use of building or land may be continued in the same kind and manner and to the same extent as at the time it t
became lawfully non -conforming, but such building or use shall not at any time be changed„ extended or enlarged
except for a purpose permitted in the zoning district in which such building or use is situated, or except as may be
permitted by a Special Permit or otherwise by the North Andover Board of Appeals. . Pre-existing
non -conforming structures or uses, however, may be extended or altered, provided that no such extension or
alteration shall be permitted unless there is a finding by the Board of Appeals that such change, extension, or
alteration shall not be substantially more detrimental than the existing non- conforming use to the neighborhood.
When a pre-existing structure has been made non -conforming due to changes in the lot size required by this
bylaw, such structure may be extended or altered based on a finding by the Zoning Enforcement Officer that such
structure after the change meets all current zoning requirements except for lot size. (1995/43)
9.2 Alliteration or Extension
A use or structure housing a use, which does not conform to the regulations of this Bylaw but which did conform
to all applicable regulations when inmally established shall not be changed, extended or enlarged except in
accordance with the following provisions:
I . Such change shall be approved by a Special Permit or otherwise by the Board of Appeals.
2. Such change shall be permitted only upon the same lot occupied by the non -conforming use on the date
that it became non -conforming.
3. Any increase in volume, area, or extant of the non- conforming use shall not exceed an aggregate of more
than twenty five percent (25%) of the original use.

single family residential structures in the R1, R2, R3, R4 and R6 Districts, may be changed,
extended or altered, provided that there is a finding by the Zoning Enforcement Officer (Building
Commissioner) that such change, extension, or alteration shall not render the structure more non-
conforming than the existing structure. Upon such determination, a building permit may be issued
where applicable. The following circumstances shall be deemed not to increase the nonconforming
nature of said structure:
1 Alteration of a structure which complies with all current yard setbacks, building coverage,
and building height requirements but is located on a lot with insufficient area, where the
structure after alteration will comply with all of current Bylaw requirements except for lot
area.
2. Alteration to a structure which complies will all current yard setbacks, building coverage,
and building height requirements but is located. on a lot with insufficient frontage, where the
structure after alteration will comply with all of current Bylaw requirements except for 4
