Project Qualifications: • This proposal assumes access around the building for loading and roof access. • This proposal does not include ATM roof. • Building permit is not included in cost. Building permit may be obtained by Tecta and billed at cost. • If the owner requires Tecta to obtain the building permit,city of Andover may require that an engineering study be done to ensure the existing building structure is capable of handling the new roof system per current state and local building codes. Should a General contractor or Owner require a performance bond than 1%of the contract shall be added to final contract price . Not covered under the warranty are unusual weather conditions,including but not limited to,ice and snow build-up,high winds and original building structural problems. Snow,Ice,water,mud and other debris removal,if necessary,is an additional charge at our standard hourly rate. . Single-ply membranes are susceptible to puncture by individuals. Care must be taken to protect the membrane. Owner/ General Contractor will be invoiced for callbacks due to damage to the roof system. Tecta America estimate/proposal is valid for up to 30 days and does not constitute a contract until signed by both parties. If it is determined that the existing roof contains asbestos,additional removal and disposal costs will be incurred and billed to the Owner or General Contractor. • Billings unpaid over 30 days shall be subject to 1.5%per month financing charge.The customer will be held responsible for any fees or costs Tecta incurs in relation to collecting outstanding invoices,This includes,but is not limited to,attomey or accountant fees,court fees,arbitration or mediation fees,or any other fee associated with collecting unpaid invoices. . When existing roofs are being removed,dirt and debris may enter the building through cracks,seams and/or holes in the decking. Shall not be responsible for any cleaning or repairs that may be necessary. . Once both parties have signed this proposal,a schedule for commencement of work will be established based on present weather conditions and Tecta's present workload. . If the owner requires Tecta to obtain the building permit,Tecta may require that an engineering study be done to ensure the existing building structure is capable of handling the new roof system per current state and local building codes. The costs for the building permit and the engineering study will be passed on to the owner. . Tecta will not take the responsibility for covering roof penetrations or unit curbs unless arrangements have been made prior to the commencement of the work, • Temporary waterproofing will be billed at Tecta's current standard hourly rate plus materials. • Roof penetrations and/or curbs have been carried per the roof drawing. All additional penetrations/curbs will be billed at Tecta's standard hourly rate plus materials. • Tecta has allotted for two mobilizations per project. If additional mobilizations are required,a charge of$500 per additional mobilization will be charged. A mobilization is defined as consecutive days worked. • The proposal price assumes all walls and wood blocking will be in place prior to Tecta starting. Starting before will be an additional charge. • Tecta and/or the manufacturer will not be held responsible for roof delamination due to foot traffic. It will be the owner's responsibility to notify other trades of potential damage to the roofing system and to provide protection for the roofing system when trades are required to work on the roof. • Upon execution of this contract,Customer agrees to compensate Tecta America for industry-wide material price increases that may be imposed after the execution of this contract and concurrent with Tecta's work. • The contract shall define a start date that includes the right to bring in all the materials for the project on that date.If this date slips the customer shall be responsible for any additional costs Tecta America incurs due to the delay of the project(such as material price increases or shipment delays).If the customer asks for Tecta America to bring the material as scheduled and store it off site,the customer agrees to pay for additional storage,handling,trucking and other associated costs related to the delay.Tecta also have the right to invoice for the materials brought in and stored off site. 3 a Tecta America New England 12 Sterling Road I North Billerica, MA 01862 T:978.436.9990 F:978.436.9997 tectaamerica.com I I I i TEcTAAMERICA • Owner shall defend,indemnify and hold harmless Tecta America and their officers,directors,employees,agents from and against any and all claims,damages,liability,losses and expenses arising from any interior damage that may occur as a result of this work. • To prevent possible air quality problems in occupied and non-occupied areas,Tecta requires that all HVAC and make-up air equipment is turned off while working and the owner notify tenants of the work prior to commencement. Should this not be feasible,the Owner shall furnish Tecta a waiver and release for all the claims that may occur as a result of this work, Tecta will not be held responsible for substrates,which are not supplied and installed by Tecta. This applies to pressure treated wood blocking for perimeter fascias,parapet walls,vertical walls and/or any substrate(Masonry,Wall Board,etc.) which accepts fabricated metal either Flashings or systems. • Tecta America proposals are based on a 40-hour work week. If Over-Time is needed to escalate a project job schedule,at no fault of Tecta America,all additional man hours above the 40 hour work week will be billed to the customer at Tecta America current Over-Time rate. • Tecta America will not take responsibility for project time delays related to weather sensitive products specified by the Project Architects,Consultants or Owners Project Representatives. • All new Tecta America customers are required to fill out the Tecta New Customer Application and obtain credit approval prior to Tecta America signing a contract. The owner is responsible for having all electrical powers lines properly booted by the Electrical Company,which pose a safety concern to Tecta Employees during the new Application.
