Workmanship Builder agrees to provide certain construction, remodeling and/or repair work according to the terms of this Agreement. Builder shall perform, and make sure any subcontractor,employee, or independent contractor performs all of the work in a good sound, workmanlike manner. 2. Permits Builder shall make owner aware of all necessary construction related permits and will obtain such permits as the Owner's agent. The contract price is forth is subject to approval by the Local Building Department. The Department may require changes that affect the price. If this should occur, the owner and/or Contractor have the right to modify the agreement and Owner shall only be responsible for payment of actual work performance, if any, as of the date this Agreement is terminated. 3. Compliance with Law Builder represents that it complies with all federal,state and local laws and regulations applicable to providing construction services in Massachusetts including, but not limited to, any license or proficiency requirements. Builder will comply with all applicable federal, state and local laws and regulations related to the Agreement and the work to be performed including, but not limited to building codes, disposal of waste and the safety of persons and property. 4. Change Orders Owner may, from time to time, without invalidating this Agreement, request changes, additions, alterations,or other.modifications in the work to be performed. Also, Owner understands that there may be unforeseen conditions that may atter the written Scope of Work and that the Builder will promptly notify the owner of any such conditions. Owner agrees to pay any increased charge owed according to Builder's response if Owner elects to order the changes. Neither Builder nor Owner shall be responsible for any changes unless such change is agreed to in advance and is set forth in writing and signed by Owner and Builder. 5. Time for Completion White Builder does no gu tee a completion date, Builder will use Builder's best efforts to start the work on-�and complete the work in weeks. Limited Warranty Builder warrants that for a period of 1-year following final acceptance of the work or final payment by Owner,the work performed by Builder shall be free from any material damage or defect caused by any defective, negligent or improper work by Builder. Builder shall repair or replace, at Builder's sole expense,any damage,defect or problem resulting from defective work preformed by Builder that is discovered during the warranty period. Owner shall promptly notify Builder of any such warranty claim within 10 days of its discovery or sooner if reasonably practical. 8. Termination Either Owner or Builder may terminate this agreement by giving written notice of termination to the other. Termination will be with out prejudice to the rights and obligations accred to the date of termination. in the event of any such termination, Owner shall be responsible for the payment of all work performed and cost of materials purchased,in compliance with Builder's obligations hereunder, as of the date of any such termination. If termination requested by Owner for reasons other than negligence on the part of the Builder,Owner shall also subsidize any costs involved with Builder moving off site. Notwithstanding termination, Builder may not leave house in dangerous condition or in a condition likely to cause damage to the House. 9. Entire Agreement This Agreement and the design drawings, if any,form the contract and terminates and supersedes all prior understandings or agreements on the subject matter hereof. This Agreement may be modified only by a further writing that is duly executed by both parties or as otherwise expressly provided herein. This Agreement shall be construed and enforced according to the laws of Commonwealth of Massachusetts.
