2.40 Home Occupation (1989/32)
An accessory use conducted within a dwelling by a resident who resides in the dwelling as his principal
address, which is clearly secondary to the use of the building for living purposes. Home occupations shall
include, but not limited to the following uses; personal services such as furnished by and artist or
instructor but not occupation involved with motor vehicle repairs, beauty parlors, animal kennels, or the
conduct of retail business,or the manufacturing of goods, which impacts the residential nature of the
neighborhood.
4. For use of a dwelling in any residential district or multi-family district for a home occupation,the
following conditions shall apply:
a. Not more than a total of three (3) people may be employed in the home occupation, one of
whom shall be the owner of the home occupation and residing in said dwelling.
b. The use is carried on strictly within the principal building;
c. There shall be no exterior alterations, accessory buildings, or display which are not customary
with residential buildings;
d. Not more than twenty five (25) percent of the existing gross floor area of the dwelling unit so
used, not to exceed one thousand (1000)square feet, is devoted to such use. In connection with
such use, there is to be kept no stock in trade, commodities or products which occupy space
beyond these limits;
e. There will be no display of goods or wares visible from the street;
f. The building or premises occupied shall not be rendered objectionable or detrimental to the
residential character of the neighborhood due to the exterior appearance, omission of odor, gas,
smoke, dust, noise, disturbance, or in any other way become objectionable or detrimental to
any residential use within the neighborhood;
g. Any such building shall include no featt res of design not customarily in buildings for residential
use.

LEASE
THIS LEASE made as of the YL day of June,2016,between North Andover CrossRoads
Limited Partnership, a Massachusetts Limited Partnership,having an address at 820A Turnpike
Street,North Andover,MA 01845 ("Landlord") and Dawg City,Inc., a Massachusetts corporation
with a principal place of business at 38 Pearson Street,Andover,MA 01810 hereinafter referred to
as"Tenant").
WITNESSETH:
1.Definitions. As used herein,the following terms shall have the meanings set forth below unless
the context otherwise requires:
(a)Landlord:North Andover CrossRoads Limited Partnership
(b)Tenant: Dawg City, Inc.
(c)Premises: The approximately 1,662 square feet store premises shown on Exhibit A attached
hereto.
(d) Shopping Center: The Shopping Center,together with the land and all improvements
thereon,now known as CrossRoads Plaza.on Route 114,in North Andover,Massachusetts
(e)Term: The period commencing on the Commencement Date(as hereinafter defined)and
ending 36 Months thereafter.
(f)Commencement Date: Earlier of sixty days from delivery or the first day open for business.
Tenant shall have early access from the date this Lease is signed until the Commencement
Date, free of any rental payment obligations(fixed rent or NNN,ie,CAM or Taxes)during
which period the Tenant may complete Tenant improvements and pre to open for business.
Provided tenant pays$1000.00 the security deposit.
(g) Intentionally deleted
(h)Lease Interest Rate:The lesser of(i)four(40/6)above the prime rate of interest as quoted by
Bank of America,or(ii)the maximum rate permissible under
p applicable law.
(i)Extension Periods: one period of five(5)years.

(j)CAM charges: estimated at$4.60 per square foot. Taxes estimated at$3.81per square foot.
(k)Permitted Use: Retail pet supply store. No live animals to be sold,boarded or groomed on

(1)Common Areas:The parking and common area or areas located adjacent to the Premises

waiving any claim of breach or for damages), at any time thereafter may make such payment
or cure such default for the account of the Landlord, and any amount paid or any contractual
liability incurred by Tenant in so doing shall be deemed paid or incurred for the account of
Landlord and Landlord agrees to reimburse Tenant therefor or save Tenant harmless
therefrom. Anything herein to the contrary notwithstanding, in the event of an emergency,
Tenant may, after giving Landlord such notice as is reasonable under the circumstances,
exercise its self help rights as aforesaid
(F)Rules and Regulations. Any Rules and Regulations will be established and applied by
Landlord in a non-discriminatory fashion, such that all Rules and Regulations shall be
generally applicable to other tenants of the Shopping Center in addition to the Tenant named
herein. Landlord agrees to use reasonable efforts to insure that any such Rules and
Regulations are uniformly enforced,but Landlord shall not be liable to Tenant for violation
of the same by any other tenant or occupant of the Shopping Center, or persons having
business with them. In the event that there shall be a conflict between such Rules and
Regulations and the provisions of this Lease,the provisions of this Lease shall control.
