Section 2 Contract Amount 2.1 The Owner shall pay KCCI in current funds for the performance of the Work , the Contract Sum of Twenty Three Thousand Three Hundred Thirty Seven Dollars and 00/100 ***************($23,337.00) subject to additions and deductions as noted in Section 5 below; 2.2 Payments shall be made with in thirty(30) days of receipt of an Application of Payment, submitted by KCCI. 2.3 Unit Prices, if any are as follows: N/A 2.4 Payments due and unpaid under this Agreement shall bear interest from the date payment is due at the prevailing prime rate, plus four percent(4%). 2.5 Final Payment: Final payment, constituting the entire unpaid balance shall be made by the Owner to KCCI when the Work has been completed. Section 3 Enumeration of Contract Documents 3.1 The Contract Plans are as follows: Original Proposal dated October 3, 2012 based on plans supplied by Levi +Wong Architects 3.2 The Project Specifications are as follows: As outlined by Levi + Wong Architects 3.3 The Addenda, if any, are as follows: N/A 2 3.4 Other documents, if any, which form part of this Agreement are as follows: None Section 4 Date of Commencement and Substantial Completion 4.1 The date of commencement is the date of this executed agreement, unless a different date is stated below: 4.2 KCCI shall achieve Substantial Completion of the entire Work, not later than 60 days from actual start, subject to adjustments of the Contract Time as provided in section 5 below. Section 5 Changes in The Work 5.1 The Owner may request changes in the Work consisting of any additions, deletions or modifications. Any changes in the Work shall be agreed to in writing between KCCI and the Owner prior to any such changes taking place. KCCI shall prepare a formal Change Order to be executed by both parties. The Contract Sum and Contract Time shall be changed only by this formal Change Order. Section 6 Miscellaneous Conditions 1) Unless noted otherwise, Owner shall: a) Furnish legal description of the site, including surveys if needed. b) Secure and pay for all necessary approvals, easements and charges required for construction. c) Provide adequate instructions, documentation, plans, diagrams and direction to allow KCCI to carry out the Work. 2) Unless noted otherwise, KCCI shall: a) Maintain general liability insurance and workman's compensation insurance and provide verification of same to Owner upon request. b) Provide a warranty for work performed for a period of one (1) year from the date of substantial completion for defects in product or workmanship. This warranty excludes damage or defects caused by abuse, work or changes not performed by KCCI, insufficient maintenance or normal wear and tear. c) Pay related sales and consumer taxes for the Work. d) Comply with and give notices required by governing authorities, including local code enforcement offices. Section 2 Contract Amount 2.1 The Owner shall pay KCCI in current funds for the performance of the Work , the Contract Sum of ThirtySix Thousand Five Hundred Nine One Ninety Dollars and 00/100 ***************($36,591.00) subject to additions and deductions as noted in Section 5 below; 2.2 Payments shall be made with in thirty (30) days of receipt of an Application of Payment, submitted by KCCI. 2.3 Unit Prices, if any are as follows: N/A 2.4 Payments due and unpaid under this Agreement shall bear interest from the date payment is due at the prevailing prime rate, plus four percent(4%). 2.5 Final Payment: Final payment, constituting the entire unpaid balance shall be made by the Owner to KCCI when the Work has been completed. Section 5 Changes in The Work 5.1 The Owner may request changes in the Work consisting of any additions, deletions or modifications. Section 6 Miscellaneous Conditions 1) Unless noted otherwise, Owner shall: a) Furnish legal description of the site, including surveys if needed. b) Secure and pay for all necessary approvals, easements and charges required for construction. c) Provide adequate instructions, documentation, plans, diagrams and direction to allow KCCI to carry out the Work. 2) Unless noted otherwise, KCCI shall: a) Maintain general liability insurance and workman's compensation insurance and provide verification of same to Owner upon request. b) Provide a warranty for work performed for a period of one (1) year from the date of substantial completion for defects in product or workmanship.
