One Hearing
The BOARD OF APPEALS held its regular meeting on Monday evening, Sept. 18,
1972 in the Town Office Building with the following members present and voting:
J. Philip Arsenault, Esq., Chairman; Dr. Eugene A. Beliveau, Clerk; Arthur R.
Drummond; Frank Serio, Jr. and Associate Member Louis DiFruscio who sat in place
of Kenneth Pickard who was unable to attend due to illness.
There were l0 people present for the meeting.
1. HEARI~D: Daniel Morency.
Dr. Beliveau read the legal notice in the appeal of DANIEL F. MORENCY who
requested a variation of Sections 6.1, 6.2, 6.3 and Table 2 of the Zoning By-Law
so as to permit the division of land and the formation of a lot that does not meet
the area requirements; on the premises located at Browns Court and the east side
of Garden Street.
Mr. Morency appeared on his own behalf. He did not have complete plans but will
submit them at a later date. He said he purchased the property about two months
ago and was not aware at that time that a variance was necessary; he was under the
impression that he had a buildable lot in addition to the two houses and barn
presently there. He said there is a hardship because the price of the land was
such that it would be for a buildable lot; he purchased the land with the intention
of building a house and living in it. He said there are other lots in the area as
small as this and smaller, which the Board granted to Davis & Furber Machine Co.
The Board noted that the lot line would be right up against the existing house.
John Willis asked where he would have access to the vacant lot since Garden St. is
a paper street and the area is a large field. Mr. Morency said it would be by way
of Browns Ct.
Mr. John Cronin, Merrimack St., an immediate abutter, objected because he doesn't
want to see Garden Street extended. Mr. Morency said he has no intention of doing
anything to Garden Street, that he will use Browns Court. Several other abutters
were present but did not speak.
Mr. Drummond made a motion to take the petition under advisement; Dr. Beliveau
seconded the motion and the vote was unanimous.
WATSON GRAVEL PIT:
The Board had viewed the area and talked with Mr. Watson. He will stay away
from Cohen's wall 25 feet and slope 50 feet to the water. He will have this done
by October lOth. He will submit a plan showing the area to be covered by the lake.
The Board discussed whether the bond should be increased because there is a larger
area involved. Before the next meeting the Board and the Building Inspector should
probably view the area again. When the Building Inspector arrived, he informed the
Board that the area next to Cohen's has been done and that he had suggested to
Watson that he get an engineer to draw up the plans.
CHRIS ADAMS EARTH REMOVAL:
The Building Inspector will report on this earth removal operation next month.

NORENREALTYEARTHREMOVAL:
The secretary had contacted Noren Realty relative to renewalof their earth
removal permit on Holt Road; no answer has been received. The Building Inspector
will be requested to submit a report to the Board at the next meeting.
STEVENS MILLS CONVERSION:
Atty. John Willis and John Gaffny appeared before the Board to request a pubIic
hearing at the October meeting for a special permit to convert the Stevens Mills
buildings to 200 apartments. Atty. Willis explained that Mr. Gaffny has a purchase
and sales agreement with Vincent Landers~ who owns the property. They showed pre-
liminary plans to the Board. The conversion will be to the existing mills on an
area containing approx. 12~ acres. The entire parcel is adequately sewered. There
would be access and egress in three places. There will be 100 - i bedroom apts.;
70 - 2 bedroom apts. and 30 - 3 bedroom apts.
DANIEL MORENCY:
The Board had further discussion on the Morency petition. Mr. Drummond made
a motion to DENY the variance; Dr. Beliveau seconded the motion and the vote was
unanimous. The Board found that there was no hardship.
The meeting adjourned at 9:30 P.M.
