From: Chad Clark, P.E Land Development Manager ERS Design Build Toll Brothers, Inc.,New England Division 134 Flanders Road, Suite 275 Westborough, MA 01581 Ph 508.616.8113 direct Ph 508.366.1440 main Ph 508.320.5174 mobile Fax 508.366.7778 smiccilektollbrothersinc.com Bid Documents: This proposal is based on the following references: ERS visual observations and discussion with Toll Brothers Scope of Work ERS Design Build will provide labor, equipment and supervision to design and reconstruct the segmental block retaining walls. The upper tier will be constructed 4 to 5 feet in front of the existing wall and the upper existing wall will remain in place. This will minimize disturbance to existing landscaping on top of the wall. The lower tier will be dismantled and reconstructed with geogrid using the existing block units. This proposal is based on Non union and non-prevailing rates. Schedule of Prices ERS Design Build proposes to perform the work described in this proposal for the 2 retaining walls for the price $44,600 Included within the price stated above for the Segmental Block Walls, ERS Design Build shall provide the following items: • Demolition of lower tier and re-use blocks for reconstruction of lower tier • Removal of shrubs in front of the upper tier. The shrubs will be bagged and set aside for reinstallation by the landscaper or discarded offsite. • Furnish and Install a 6" gravel leveling pad using dense graded aggregate • Furnish and install new segmental block units for the upper tier Earth Retention Sytems,LLC Page l of 4 662 Upper Maple St.Danielson,CT 06239 P :(860)333-6575 F:(860)333-6590 o The new wall units will be chosen to match the existing units as close as possible, however due to the age and style of the existing units, the new units will be noticeably different in appearance. • Furnish and install 3/4" clean crushed drainage stone behind wall • Furnish and install a minimum 4"drain pipe as detailed per ERS drawings • Furnish and install geogrid as detailed per the ERS drawings • Furnish and install the required backfill between the face of the new upper tier and face of the existing upper tier • Sod is to be installed by Toll's landscaper at no cost to ERS • Labor • Machinery • Engineer Certification Letter upon completion of the work Assumed Soil Conditions and Desi2n Assumptions � A Friction angle of reinforced and retained soil =32 degrees (minimum) Friction angle of foundation soil= 32 degrees (minimum) Groundwater If groundwater is found to be at varying elevations or previous unknown locations additional costs may be incurred. Any increases due to unknown groundwater elevations or locations will require an increase to this proposal amount. Excluded from the ERS Design Build proposal are the following items and/or work to be performed by others: • INSTALLATION OF LANDSCAPING Furnishing and installing any landscaping other than sod is excluded. The shrubs in front of the upper tier will be removed and set aside for reinstallation by the landscaper or discard offsite. • EXCAVATION Any over-excavation of rock and or unsuitable materials within the foundation soils shall not be covered within this proposal. Furthermore any remediation to the foundation soils is excluded from this proposal. • TESTING AND INSPECTIONS No third party field inspection or construction quality control testing is included in this proposal. The third party inspection and testing will be performed by the owner or general contractor and the reports forwarded to ERS Design Build weekly during construction. ERS can assist in acquiring the permit however the cost of the permit is excluded. • WINTER CONDITIONS No winter conditions or cold weather protection is included in this proposal. Terms • SEQUENCE ERS Design Build's proposal is based upon carrying out the work described above in an unobstructed manner during regular working hours (no overtime) Monday thru Friday, in a single uninterrupted visit to the site excluding weather related shut downs. ERS Design Build reserves the right to work overtime or weekends at ERS Design Build's own discretion without incurring charges for testing and or other services provided by others i.e. backfill supply, testing, etc. In the event that ERS Design Build's work is interrupted for any reason beyond our control, ERS Design Build shall be compensated at the rate of $6,500 per shift, or$700 per hour for standby of the crew and equipment. If for any reason ERS Design Build is required to pull off the site and remobilize equipment and crews the cost for each additional remobilization shall be $10,000 minimum or 3.5%of the total contract price. • PAYMENT TERMS Two-week payment terms with no retention held. • LIMITATION OF LIABILITY We will perform the work in a professional manner in compliance with the contract documents. However, ERS Design Build cannot accept liability for damage due to conditions unknown to ERS Design Build and not depicted in the contract documents or any consequential damages that may result from the normal performance of the work. All utilities and other conditions shall be located by others, identified, and brought to the attention of ERS Design Build prior to commencement of work. • EXHIBIT TO THE SUB CONTRACTA GREEMENT This proposal and any agreed upon subsequent articles shall be included within the sub contract agreement between customer and ERS Design Build,LLC.
