October 8, 2008.
Dear Attorney Smolak,
You have requested that I provide you with a determination of whether the Applicant,Stevens
Corner LP, has complied with all the preconditions to the issuance of certificate of compliance as
described in the Zoning Board of Appeals' Comprehensive Permit Decision, dated October 8,2008.
In reviewing the Comprehensive Permit Decision,there are several conditions that must be
satisfied prior to the issuance of a certificate of compliance for the Project, including the following:
(a)approval of Monitoring Agreement (Para.6);
(b)approval of an Operation & Maintenance Plan, or Management Plan (Para.12);
(c)provide as-built plans to the Board of Appeals and Department of Public Works(Para.17);
(d)completion of the construction of infrastructure, common facilities and common
improvements (Para.22);
(e)cessation of the use of any temporary construction or marketing trailer(Para.30);and,
(f)approval of Management Company once the Project is constructed and rent
stabilized (Para. 31).
Based upon my review of these conditions as well as my records for this Project in February,
2012, 1 determined that Stevens Corner had complied with all the listed preconditions for the issuance
of a Certificate of Occupancy for the building, including all 42 rental units.Accordingly, a final Certificate
of Occupancy for the project (for Building Permit No.055-2011)was issued by me on February 3, 2012.

Hello Maura-
As discussed a few moments ago, it appears that water is being discharged from the dewatering operation at the
construction site above us. The water is traveling from the construction site through the fence, across the lawn,
into the dry well, across the lot, down the sidewalk to the back right corner of the building. Please find attached
photos of the current conditions. We would greatly appreciate the prompt attention of your building inspector
addressing this situation.
