CONTRACT This Contract effective on 8 day June in 2006 by and between Kathleen Borys (Owners) residing 76 Boxford Street North Andover, Massachusetts and Great Northern Building and Design (Builder) located at 128 Hampshire Road, Massachusetts for the project to be constructed 76 Boxford Street (Premise) in accordance with the terms of this contract. This Agreement contains: 1. Contract Details 2. Project Details 3. Working Drawings 4. Payment Schedule Project: This proposal is for 5 separate projects; 1. Adding Weatherbest railings to the front family room stairs. 2. Adding Weatherbest railings to the Main front stairs 3. Build a 12'0" x 12'-0" deck from the kitchen slider 4. Build a 6'-0 x 8'-0 with stairs for the in-law sliding door to the back yard. 5. Build stairs from the rear Family Room sliding door The owners agree to pay as consideration the sum of $ 11,340.00 to the Builder to be disbursed in progress payments as scheduled. (See Payment Schedule) CONTRACT DETAILS STARTING AND COMPLETION PROVISIONS Assuming all conditions precedent are satisfied and weather permits, the work shall commence on or about July 10, 2006, and will be completed by July 30, 2006. Builder is not responsible or liable for delays in the commencement or the completion of the Project that are the results of conditions beyond the Builders control (such as weather and back order of materials). Delays caused by such events do not constitute abandonment and are not included in time frames for payment and performance. BUILDING PERMIT Permits required by the Town or City are the responsibility of the Builder and or Subcontractor designated to perform the work requiring the permit. In obtaining the permit the Builder will provide plans and specifications detailing the proposed Project. In addition the Builder will submit proof of Builder's Supervisor License, Home Improvement License, Worker's Compensation and General Liability Insurance. The Town or City may require additional documents such as Plot plan, Septic design, as built or others. These documents pertain to the property and are the responsibility of the Owner to provide. Review by the Planning Board, Conservation or by any other department would not involve the Builder. The Town or City may require structural changes not normally required or not included in the scope of the work set forth in the Contact Plans and Specification which may add additional cost. This cost would be The Owner acknowledges unused materials on his property, even upon completion remain the sole property of the Builder. LIVE LOAD CAPICITY This project has been design with a load capacity exceed applicable building code requirements. The installation or addition of items to the project area can exceed this capacity and lead to structural failure. Owner must request approval from local building officials or contact Great Northern Construction to review efforts to add a spa or building on Great Northern decks etc. LANDSCAPE AND OUTSIDE PROPERTY During construction damage to the lawn is usually unavoidable. Around the work area the lawn will brown and may wear thin. Construction materials will have to be temporally stored on the lawn which will further cause browning. There are no provisions in this agreement for lawn recovery. Lawn damage is temporary and in 3 to 6 months the lawn will return with proper watering and care. The Owner must notify the Builder of a lawn sprinkler system and assisted in locating the sprinkler heads in the area affected by construction. Removing or moving sprinkler is not included it is the responsibly of the Owner to make arrangements with the sprinkler system installer for sprinkler changes. CLEANUP During construction daily cleanup will be performed at the end of the day. The work area will be broom sweepted and debris will be disposed in the dumpster. Upon completion of the project, your new addition will be cleaned for use and windows washed. Sawdust may be visible in your lawn which will turn to mulch in time. During construction dust barriers will be in place to minimize dust from entering the home, yet some dust may find its way into the house. Clean and dusting the existing house is not included unless otherwise specified. RIGHTS OF RECESSION The Owner and Builder shall each have until midnight of the third business day after the effective day, the right to cancel this contract without penalty or obligation. Notification must be in writing. Any consideration paid as part of the terms of this Agreement shall be returned within 10 days of written notification of cancellation. Build stairs from the rear Family Room sliding door Project Details is a summary of the work included in this project. • Obtaining a building permit • All materials and labor to complete the project • Clean-up Add white Weatherbest railings to the Front door stairs and the Front Family Room door stairs. Kitchen Deck (refer to drawing) 12 feet by 12 feet The deck would be secured to the house by bolting to the rim joist and supported by concrete pier. The decking would be grey Weatherbest decking secured with grey colored screws. The outside of the deck would have azek maintenance free covering the rim joist. Railings not included. Family Room (refer to drawing) 3 extended treads from the family room will beset on concrete footingand trim in azek and with decking. Deck from the In-law sliding door (refer to drawing) 6 feet by 8 feet with a privacy lattice apron trimmed in azek with Weatherbest railings and decking. NOT INCLUDED IN THIS PROPOSAL 1. Landscape changes Warranty Great Northern warranties all workmanship for 4 years. The manufacturer Weatherbest provides for a Limited Warranty for up to ten years on the materials presented to the Owners in writing and added to the Contract as part of the Total Cost of Construction if agreed to or the contract would be void. ❖ The Town Building Department has the right to require additional work to be done which is not included in this contract. The most common issues are to upgrade heat, smoke or monoxide detection, but septic systems, additional handrails, larger attic scuttle holes or anything they would consider a safety or fire hazard may be included.. ❖ This project has been design to comply with Massachusetts Build Code however the Building or Fire Dept. of each town has the right add additional requirements not included in the design/ details and specifications. These unforeseen requirements or any requirements not included in the Agreement may add additional expense. We (the contractor) should be notified in applying for the Building Permit of any non-compliance issues. Prior to the start of construction the issues must be resolved or the Agreement to be void with all deposit money return with no recourse to either party. INSURANCE AND LICENSE The builder will maintain and keep current at all times during construction: a. General liability Insurance policy for 1 million dollars for all covered property b. Workerman's Compensation on all employees and subcontractors c. Vehicle Insurance on or parked in front of the construction property d. Construction Supervisor License e. Maintain Home Improvement License CONTRACT MODIFICATIONS AND CHANGE ORDERS Except for written modifications signed by both parties the Builder must follow the detail and specifications set forth in this agreement. If changes are agreed to by both parties a Change Order must be completed signed by both parties before modifications can be made. If there is an addition cost for the change order, payment must be made before modifications can be executed. WATER AND ELETRICITY The Owners' agree to provide electricity for the operation of the Builder's equipment. Standard 15 amps. /110 service is all that is required also the use of outside water source if available. UNFORESEEN CONDITIONS The Owner's agrees that if during construction, should the Builder encounter unforeseen site conditions on the premises (for example buried storage tanks, solid ledge rock, high water table, rotted or unsound house framing, poor soil conditions, etc) which would interfere with a satisfactory completion of the project, an addendum may be required detailing the work involved, with an added cost for the additional required work. In the Builders judgement, if the addendum were not executed, continuing work without the modifications would result in substandard results the Builder will not be obligated to continue. If a disagreement did arise the Town or City Building Inspector would be asked to present judgement on the condition. ON SITE MATERIALS
