HomeMy WebLinkAbout2003-04-22 Board of Selectmen Minutes BOARD OF SELECTMEN MINUTES APRIL 22, 2003 CALL TO ORDER: Rosemary Smedile called the meeting to order at 7:00 PM at the Steven's Memorial Library. ATTENDANCE: The following were present: Rosemary Smedile, Chairman; James Xenakis; Donald B. Stewart; Mark J.T. Caggiano; Wendy Wakeman; Mark Rees, Town Manager; Ray Santilli, Assistant Town Manager. COMMUNICATIONS,ANNOUNCEMENTS, AND PUBLIC COMMENT: Chairman Smedile congratulated Selectman Xenakis for his accomplishment in running the Boston Marathon to benefit the National Multiple Sclerosis Foundation. Board of Selectmen -Appointments. Wendy Wakeman made a MOTION, seconded by James Xenakis, to appoint Mark Caggiano as liaison to the Solid Waste Advisory Committee. Vote approved 5-0. Selectman Caggiano praised the work of North Andover's Police and Fire Departments. He witnessed an accident and watched them in action. PUBLIC HEARINGS: As the notice to abutters stated hearings were to start at 7:30 PM, they were taken out of order at the end of the meeting. LICENSING COMMISSIONERS: Wendy Wakeman made a MOTION, seconded by Donald Stewart, to move into Licensing. Vote approved 5-0. Wendy Wakeman made a MOTION, seconded by Mark Caggiano, to approve the following one-day licenses. Vote approved 5-0. Stevens Estate, 723 Osgood Street. Julia Stitson, Stevens Estate, 723 Osgood Street requests the following one-day Liquor Licenses. 1. Carol Muldoon, City Solicitors Dinner Meeting —April 30, 2003—5:00 PM —9:30 PM —All Alcohol. 2. William Cunningham, North Andover Youth Hockey— May 3, 2003—7:00 PM — 11:30 PM All Alcohol. 3. Beth Dimitruk, Merrimack Valley Hospice Fundraiser— May 4, 2003— 1:30 PM —5:30 PM Beer&Wine. Merrimack College, 315 Turnpike Street. 4. John H. Obert, Manager of Conference Events at Merrimack College, 315 Turnpike Street, requests a one-day Liquor License for Junior-Senior Barbecue, Friday evening, April 25, 2003 at the Sakowich Campus Center. Museum of Printing, 800 Massachusetts Avenue. 5. Gardner LePoer of the Museum of Printing, 800 Massachusetts Avenue, requests a one-day liquor license for the Printing Publishing Council Scholarship Dinner on Thursday, April 24, 2003, 5:00 PM —8:00 PM—All Alcohol. Wendy Wakeman made a MOTION, seconded by James Xenakis, to approve the change of manger at 64 Main Street Liquors, Inc. to Joanne A. Melillo. Vote approved 5-0. Wendy Wakeman made a MOTION, seconded by Rosemary Smedile, to move out of licensing until 7:30 PM. Vote approved 5-0. TOWN MANAGER'S REPORT: Given the hard work the Board has been involved with regarding budget matters and Town Meeting preparation, this meeting agenda is welcomingly brief. This brevity also provides the opportunity for those who so wish to attend the Planning Board Meeting at the DPW conference room scheduled for this same evening. The Planning Board will be conducting public hearings on the various zoning articles contained in the Annual Town Meeting Warrant including rezoning to allow for the commercial development on Rt. 114, an ice rink facility at Sharpener's Pond Road and the property next to Treadwell's Ice Cream. Selectmen Smedile and the Town Manager attended a meeting of the Lawrence Airport Commission on Thursday evening, April 17, 2003 at which, the matter of requesting the FAA to release land to the Lawrence Airport Economic Development Commission for the development of an industrial park was taken up. During the past two weeks, municipal supervisors and support staff have participated in training sessions on customer service and working with the public. Board of Selectmen Minutes April 22, 2003 2 On April 9, 2003, Rosemary and the Town Manager attended a meeting of the North Andover Lions Club where Mark Rees spoke on the budget problems impacting the Town and provided an overview of the upcoming Town Meeting. The first meeting of the Reconstituted Technical Review Committee, consisting of representatives of various town departments involved in land use matters, was held on April 10, 2002. The potential development projects were reviewed and draft minutes from that meeting were distributed to Board members. On Tuesday, April 15, 2003, the Town Manager represented the Town at a Merrimack Valley Chamber of Commerce mixerjointly sponsored by the Stevens Estate and Minco Development Corporation. Wheelebrator North Andover Waste to Energy Facility the 4th quarter 2002 air emission test results "were well below the applicable standard." The Town Manager said that the House Ways & Means Budget would be sent out to cities and towns tomorrow. Health Insurance cost is a major concern for fiscal years 03 and 04. The Town Manager will put together a package for the Board of Selectmen and the Finance Committee for review. There may be a need to schedule another meeting before the next scheduled meeting on May 5, 2003. The Town Manager's recommendation is to stay with the budget numbers that were voted on and recommended for Town Meeting and make additional cuts in the fall as additional information comes forward. Wendy Wakeman made a MOTION, seconded by James Xenakis, to break for a short recess until 7:30 PM to hold the Public Hearings. Vote approved 5-0. PUBLIC HEARINGS: Joseph Plentzas representative of Massachusetts Electric Company, requested the approval of the following petition: Plan #F53/467 Foster Street— Place 2 (two) poles 23/2461, 3393, Remove 2 poles. Wendy Wakeman made a MOTION, seconded by James Xenakis, to approve the request. Vote approved 5-0. LICENSING COMMISSIONERS: Donald Stewart made a MOTION, seconded by Wendy Wakeman, to go back into licensing. Vote approved 5-0. Selectman Xenakis excused himself from the following discussion. Public Hearing &Application for Common Victuallers License for J&M Pizza, 707 Salem Street. Attorney Mary McCabe represented abutters John and Nancy Christostano of Salem Street who could not attend. There were some logistical concerns about lighting, trees, traffic and closing times. After discussion, the Board agreed that these issues did not have bearing on the Victuallers License. The attorney agreed to work out differences with her clients and the owner, John Xenakis of J&M Pizza. Wendy Wakeman made a MOTION, seconded by Mark Caggiano, to approve Victuallers License for J&M Pizza, 707 Salem Street. Vote approved 4-0. Wendy Wakeman made a MOTION, seconded by Mark Caggiano, to move out of licensing. Vote approved 4-0. Selectman Xenakis returned to the meeting.
