The Building Department issued a stop work order for constructing a deck, installing windows,
upgrading bathroom fixtures and building a retaining wall in excess of 48"without first obtaining
building permits. Maura Deems gave you a copy of the stop work order. To date, no work has
proceeded since the stop work order was posted.

Massachusetts General Laws chapter 152 requires all employers to provide workers'compensation for their empx ye s.
Pursuant to this statute,an employee is defined as"...every person in the service of another under any contract 61hire,
express or implied,oral or written." `
An employer is defined as"an individual,partnership,association,corporation or other legal entity,or any two or more
of the foregoing engaged in a joint enterprise,and including the legal representatives of a deceased employer,or the
receiver or trustee of an individual,partnership,association or other legal entity,employing employees. However the
owner of a dwelling house having not more than three apartments and who resides therein,or the occupant of the
dwelling house of another who employs persons to do maintenance,construction or repair work on such dwelling house
or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer."
MGL chapter 152,§25C(6)also states that"every state or local licensing agency shall withhold the issuance or
renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any
applicant who has not produced acceptable evidence of compliance with the insurance coverage required."
Additionally,MGL chapter 152,§25C(7)states"Neither the commonwealth nor any of its political subdivisions shall.
enter into any contract for the performance of public work until acceptable evidence of compliance with the insurance
requirements of this chapter have been presented to the contracting authority."

"Premises") approximately 2 months ago, and have engaged in renovations to the
interior and exterior of the Premises.
8. On information and belief Defendant Stephen Bowen the operating manager of
HomeVestors hired Keegan Brooks Demers dba KBD Landscaping&Maintenance
(hereinafter"KBD Landscaping)to do extensive changes to the exterior of the
Premises to enhance the appearance to attract potential buyers.
9.There are no permit(s) or licensing postings for landscaping and/or construction
work visible on or at the Premises.
10.KBD Landscaping has been in the process of extending the backyard usable space
and making other improvements to the exterior Premises for more than one week.
11. KBD Landscaping has removed the Premises'backyard retaining wall that was
12"thick and reinforced with rebar as depicted at Exhibit"C"which is attached and
incorporated herein by reference.
12. On information and belief the retaining wall that was removed was constructed
approximately 25 to 30 years ago at the base of a hill located at the rear on the
Premises to keep earth and rain water from sliding and channeling down onto the
Premises and onto the Plaintiffs'land and home.
13. KBD Landscaping has re-shaped the Premises'backyard topography sloping
towards the Plaintiffs property and home as depicted at Exhibit I,which has
artificially channeled water and earth onto the Plaintiffs property.
14.At the present time KBD Landscaping is constructing a new landscape wall that
is not poured concrete, not reinforced with rebar, and is sloping down towards the
Plaintiffs' property.
15. KBD Landscaping has also altered the topography on the side of the Premises
closest to the Plaintiffs'property.
16. The ground was flat from the Plaintiffs'property populated with grass and
shrubs for approximately 10 feet and then with a gradual rise to the abutting
Premises as depicted at Exhibits A and B attached and incorporated herein by
reference.
17. KBD Landscaping has removed the prior existing grass and shrubs at the side of
the Plaintiffs'property and recently added fill dirt to create a cliff from the Premises'
property to the Plaintiffs' property as depicted in Exhibits D, E, F,and I attached
hereto and incorporated by reference.
18.As a result of HomeVestors and KBD Landscaping's actions,the Plaintiffs has
suffered and will continue to suffer extreme hardship and actual and irreparable
damage to their property,including flooding during heavy rains, and springs snow
melt,both through the replacing of the heavy duty retaining wall that was on the
Premises that was parallel to the ground as depicted in Exhibit C attached herein
and incorporated by reference.
19. KBD Landscaping is presently constructing a landscaping wall that is sloped
directly to the Plaintiffs' property as depicted in Exhibit G which is attached, and
creating a cliff between the Premises and the Plaintiffs' property as depicted at
Exhibits D, E, F, and I, attached,with nothing to hold the earth (dirt) from cascading
into the Plaintiffs'property during heavy rains and spring snow melt.
20. The Plaintiffs allege that the added dirt and rain water cascade may very well
buckle the Plaintiffs'retaining wall that is depicted at Exhibit I,that is between the
Premise and the Plaintiffs'property.
21. Plaintiffs spoke with Defendant Keegan Demers owner of KBD Landscaping
(Defendant Demers) on July 28, 2015,in an attempt to voice their concerns and
seek a resolution to the impending irreparable damage that will occur to their
property, and Defendant Demers stated the following to the Plaintiffs,
To do it right so that we would not have water or dirt sliding problems, he
(Defendant Stephen Bowen operating manger of HomeVestors would need to build
an additional retaining wall between our properties."
22. In response to Defendant Demers statement, Plaintiff Alan Swahn inquired"why
wouldn't he go ahead and do that."
23. Defendant Demers stated, "The Owner (Defendant Stephen Bowen operating
manager of HomeVestors) would not spring for the additional$5000.00 to
$7,000.00 dollar expense,as he plans to flip the house."
24. The Plaintiffs'have no adequate remedy or speedy remedy at law for the above-
mentioned conduct of the Defendants HomeVestors, Stephen Bowen and KBD
Landscaping,and this actin for injunctive relief is Plaintiffs' only means for securing
relief.

WHEREFORE, Plaintiffs Alan Earl Swahn and Marie Swahn request that this Court:
a. Issue a temporary restraining order and preliminary injunction pursuant to
Mass. R. Civ. P. 65, ordering the Defendants: HomeVestors-Constitution
Properties aka Constitutional Properties LLC, Stephen Bowen as principal
and operating manager of HomeVestors-Constitution Properties aka
Constitutional Properties LLC, and Keegan Brooks Demers dba KBD
Landscaping and Maintence,their officers,agents, employees and successors,
and all those in active concert or participation with them
(collectively"Defendants") to refrain immediately and pending the final
hearing and determination of this action from:
(a) doing any type of landscaping and/or excavating and/or the adding of
dirt or any other substance to the rear and side yard of the Premises
closest to the Plaintiffs'property;
(b) from changing and/or altering the Premises'topography at the rear yard
and side yard closest to the Plaintiffs'property;
(c) that the Defendants collectively be enjoined and cease and desist from
doing any further construction and/or building and/or hardscape to the
rear wall being presently erected;
(d)that the Defendants hire a Professional Civil Engineer,at the Defendants
expense,approved and assented to by the Plaintiffs,or the Plaintiffs hire
their own independent Professional Engineer,to professionally prepare
design, and propose a engineering plan, stamped by Professional seal,
before any further work is done by the Defendants to Premises,so as to
protect the Plaintiffs'property and home, along with safeguarding their
health, safety and welfare,from the impeding landside of dirt and water
onto the Plaintiffs' property or cause any impeding flooding by the
redirection or artificially channeling of water caused by the reshaping
and changes to topography at or around the Premises,and that the
landscaping wall construction be enjoined until approved by the
proposed Professional Engineers,or the assent of the independently
hired Professional Engineers.

(e) Issue a permanent injunction perpetually enjoining and restraining the
collective Defendants,their officers,agents,employees,and successors,
and all those in active concert or participation with them from the
conduct complained of herein;
(f) Award the Plaintiffs such other and further relief as this Court may deem
proper.
