Nevertheless, the applicant still maintains that the subject property is not affected by the 2004 amendment to Section 4.122 of the North Andover Zoning By -Law, changing 2 - family dwelling use in the applicable zoning district from allowed as of right to allowable by special permit. The basis for this position is that the subject property is benefited by a definitive plan freeze under G.L, c. 40A, s. 6, fifth para., that will remain in effect until at least August 1, 2008. I do not necessarily disagree with your application of the holding in Arenstam v. Planning Bd. of'Tyngsborough, 29 Mass.App.Ct. 314 (1990), to this matter. In summary, you maintain that under the holding in Arenstam, in order to claim a definitive plan freeze under G.L. c. 40A, s. 6, fifth para., that relates back to the date of the prior filing of a preliminary subdivision plan, the definitive plan ultimately approved by the planning board must have been filed with the Board Thomas J. Urbelis, Esquire December 7, 2007 Page 2 within 7 months of the submission of the preliminary plan. However, where the plan ultimately approved by the planning board is one submitted outside of the seven month period, the Arenstam Court went on to clarify that the definitive plan freeze is not lost in its entirety, the "freeze date" simply becomes the date on which the later submitted plan was filed. "[A]ny definitive plan, filed more than seven months after a preceding preliminary plan, is to be treated as a new plan, which gains protection under [G.L. c. 40AJ s. 7A [the predecessor of today's s. 6,1 only from the date when it is filed and not as of the date of the filing of the preliminary plan." Arenstam v. Planning Bd. of Tyngsborough, 29 Mass. App. Ct. 314, 317 (1990), noting Green v. Bd. of Appl. of Norwood, 358 Mass. 253, 257 n. 4. Fortunately, in the present circumstance, the zoning change at issue did not take effect until May 10, 2004. A copy of the amendment section of the Zoning Bylaw is attached hereto. Thus, where the applicant filed its definitive plan with the Planning Board on February 8, 2000, a revised version of that plan was filed and ultimately approved by the Board on June 30, 2000, and the Board endorsed the plan on August 1, 2000, clearly any zoning change that did not become effective until 2004 is not presently applicable to the land shown on the plan. Further, the definitive plan freeze applicable in this circumstance "freezes" the zoning that was in effect as of a date no later than June 20001, and will remain in place until at least August 1, 2008, 8 years from the Board's endorsement of the plan. By your letter, you also requested confirmation of the notices filed with the Town Clerk. Attached you will find a copy of the notice of submission of the definitive plan, filed with the Town Clerk on February 8, 2000, and a copy of the Notice of Decision approving the definitive plan, filed with the Town Clerk on June 30, 2000. ' The "freeze date" in this circumstance would appear to be February 8, 2000, the date on which the applicant's definitive plan was first filed. However, the precise "freeze date" is not relevant to an analysis of the zoning change at issue, where the effective date of the change came nearly 4 years after the approval of the definitive plan.
