CALL TO ORDER: Wendy D. Wakeman called the meeting to order at 7:00 PM at the Steven's Memorial
Library.
ATTENDANCE: The following were present: Wendy Wakeman, Chairman; Rosemary Smedile; James Xenakis;
Donald B. Stewart; Mark J.T. Caggiano; Mark Rees, Town Manager; Ray Santilli, Assistant Town Manager; and
Fire Chief Dolan.
EXECUTIVE SESSION:
Rosemary Smedile made a MOTION, seconded by Mark Caggiano, to move into Executive Session to discuss
Pending Litigation with GLSD, Collective Bargaining with Fire Union and a Real Estate Matter. Vote approved
5-0. The Board will be returning to Open Session.
APPROVAL OF MINUTES:
Rosemary Smedile made a MOTION, seconded by Mark Caggiano, to approve the minutes of October 20, 2003,
Open Session and Executive Session as written; October 27, 2003, Open Session as written; November 10, 2003
Open Session as written; and November 17, 2003, Open Session as written. Vote approved 5-0.
COMMUNICATIONS,ANNOUNCEMENTS, AND PUBLIC COMMENT:
The Town Manager thanked the Department of Public Works for a job well done in their efforts of the snow
removal and a water main break over the weekend.
Selectman Smedile said that the North Andover Improvement Society is proposing a Town Sign Project and will
come before the Board in the future.
Selectman Wakeman thanked the Festival Committee for a great Holiday parade.
Selectman Wakeman thanked Rosemary Smedile for her contributions for decorating the downtown.
Recognition of Retired Town Employees.
The Board of Selectmen presented certificates of recognition to the following for their dedicated service to the
Town of North Andover: Barbara Philbrick Assistant Librarian more than 42 years of service, Leonard White
Firefighter for 32 years of service, and James Zahoruiko police officer for 17 years of service.
Certificate of Appreciation.
The Board of Selectmen presented certificates of appreciation to the following volunteer organizations for their
donations and assistance to the Town during difficult economic times: The Veterans of Foreign Wars North
Andover Post 2104, The North Andover Rotary Club, Troop 81 Boy Scouts of America, and the North Andover
Women's Club.
Board of Selectmen Appointments.
James Xenakis made a MOTION, seconded by Rosemary Smedile, to appoint Richard A. Catino, Jr. to the
Commission on Disability Issues; Margaret Shaheen, to the Council on Aging; and David W. Greer to the
Emergency Management Agency as Operations Officer. Vote approved 5-0.
CONSENT ITEMS:
Fire Chief Dolan requested the Board to establish a donation account for money received on behalf of retired fire
fighter Ray MacLean's volunteer effort to paint residential house numbers and street signs.
Rosemary Smedile made a MOTION, seconded by Donald Stewart, to establish a donation account for the Ray
MacLean's volunteer services. Vote approved 5-0.

James Xenakis made a MOTION, seconded by Rosemary Smedile, to move into Licensing. Vote approved 5-0.
Wendy Wakeman made a MOTION, seconded by Mark Caggiano, to approve the following one-day liquor license
for Merrimack College. Vote approved 5-0.
Merrimack College, 315 Turnpike Street—One-Day Liquor License.
The Friends of Merrimack College Annual Christmas Party at Cascia Hall on December 11, 2003 from 6:00 PM —

2004 License Renewals.
Selectman Stewart said that this year the annual licensing process was considerable more complex and time
consuming due to the recent adoption of entertainment license regulations and state mandates for worker's
compensation certificates and bonds for class II auto licenses. Selectman Stewart commended the Town Clerk's
office, especially noting, Assistant Town Clerk Janet Eaton, as well as the Police, Fire, Building, Tax Collector and
Health Departments.
Wendy Wakeman made a MOTION, seconded by Rosemary Smedile to approve the following annual license
renewals for liquor, common victuallers, automatic amusement device, entertainment, livery/limo, class II, and
class III. Vote approved 4-0-1. James Xenakis abstained.

PUBLIC HEARINGS:
Tax Classification Hearing.
Chief Assessor Garrett Boles gave a report on tax classification. He provided a spreadsheet with estimated
values for FY2004.

Due to a backlog, The Commonwealth's Department of Revenue did not certify the Town's valuation in time for
the meeting. As such, it was recommended that the Board open the hearing and vote to continue it to the next
meeting scheduled for December 22, 2003.
Diane Huster asked the Board to consider average tax bills, rather than relying solely on rate information.
Mr. Carpenter of the Merrimack Valley Chamber of Commerce spoke on behalf of the many businesses in town
and asked the Board to consider a commercial rate reduction if possible.
Rosemary Smedile made a MOTION, seconded by Mark Caggiano, to continue the Tax Classification Public
Hearing at the next meeting on December 22, 2003. Vote approved 5-0.
Massachusetts Electric Pole Petition.
David English, a representative of Massachusetts Electric addressed the Board and requested the approval of the
following petition.
Plan #S53/474—Second Street— Remove P67 because it is blocking entrance to parking lot and relocate.
Rosemary Smedile made a MOTION, seconded by Donald Stewart, to approve the request. Vote approved 5-0.
NEW BUSINESS:
Smolak Farms Realty LLC.
The Town Manager said that he recently received notice that the owners of Smolak Farms desired to sell a
portion of their land that is currently classified as agricultural or 61A land for tax purposes. Under the state law
that governs the tax treatment for this type of land, whenever the owners wish to transfer 61A land, the town has
a right of first refusal, but must exercise that right within 120 days notice. The Town Manager requested written
recommendations from the Planning Board, Conservation Commission and Community Preservation Committee
regarding the town's interest in acquiring this land.
FY05— 10 Capital Budgets.
The Town Manager said that he did not produce a draft of the FY05—10 Capital Budget due to the Snow Storm.
This will be on the next meeting's agenda on December 22, 2003.

The Town Manager suggested the following dates for the Board of Selectmen Meetings for the first half of 2004:
January 12 and 26; February 2 and 17; March 8 and 22; April 5 and 20; May 3, 10 and 24; June 7 and 21. At the
discretion of the Chair additional meetings may be scheduled. All meetings are held at the Stevens Library
beginning at 7:00 PM, unless otherwise posted.
Mark Caggiano made a MOTION, seconded by Rosemary Smedile, to accept the 2004 meeting schedule. Vote
approved 5-0.
TOWN MANAGER'S REPORT:
The Police Chief has is in receipt of a $6,500 traffic enforcement grant from the Governor's Highway Safety
Bureau. As a level 1 recipient, the town received the highest amount of grant funds available under this project.
The Board of Selectmen/Division Director Holiday Breakfast for Town employees and vendors is scheduled for
Wednesday morning, December 10th at the Senior Center from 7:30 AM —9:30 AM.
