104.11 Alternative materials, design and methods of con-
struction and equipment. The provisions of this code are not
intended to prevent the installation of any material or to pro-
hibit any design or method of construction not specifically pre-
scribed by this code, provided that any such alternative has
been approved. An alternative material, design or method of
construction shall be approved where the building official fmds
that the proposed design is satisfactory and complies with the
intent of the provisions of this code, and that the material,
method or work offered is, for the purpose intended, at least the
equivalent of that prescribed in this code in quality, strength,
effectiveness, fire resistance, durability and safety.
104.11.1 Research reports. Supporting data, where neces-
sary to assist in the approval of -materials or assemblies not
specifically provided for in this code, shall consist of valid
research reports from approved sources.
104.11.2 Tests. Whenever there is insufficient evidence of
compliance. with the provisions of this code, or evidence
that a material or method does not conform to the require-
ments of this code, or in order to substantiate claims for
alternative materials or methods, the building official shall
have the authority to require tests as evidence of compliance
to be made at no expense to the jurisdiction. Test methods
shall be as specified in this code or by other recognized test
'standards. In the absence of recognized and accepted test
methods, the building official shall, approve the testing pro-
cedures. Tests shall be performed by an'approved agency.
Reports of such tests shall be retained.by.the building offi-
cial for the period required for retention of public records.

PERMITS

05.1 Required. Any_owner or authorized agent who intends
construct, enlarge, alter, repair, move, demolish, or change
e occupancy of a building or structure, or to erect, install,
alter, repair, remove, convertor replace any electrical,
as, mechanical or plumbing system, the installation of which
regulated by this code, or to cause any such work to be done,
all first make application to the building offand obtain
e .recuirermit.
U 105.1.1 Annual permit. In lieu of an individual permit for
each alteration `to an already approved electrical, gas,
mechanical or plumbing installation, the building official is
authorized to issue an annual permit upon application there-
for to any person, firm or corporation regularly employing
one or more qualified tradepersons in the building, structure
or on the premises owned or operated by the applicant for
the Permit.

05:1:2 Annual permit records. The person to whom an
annual permit is issued shall keep a detailed record of alter-
ations made under such annual permit. The building official
shall have access to such records at all times or such records
shall be filed with the building official as designated.
105.2 Work exempt from permit., Exemptions from permit
requirements of this code.shall not be deemed to grant alitho 1i' -
zation f'or any work to be done in any manner in violation of to

provisions of this code or any other laws or ordinances of this
jurisdiction. Permits shall not be required for the following:
Building:
1. One-story detached accessory structures used as
tool and storage sheds, playhouses and similar uses,
provided the floor area does not exceed 120 square
feet (11 m2).
2. Fences not over 6 feet (1829 mm) high.
3. Oil derricks.
4. Retaining walls that are not over 4 feet. (1219 mm) in
height measured from the bottom of the footing to
the top of the wall, unless supporting a surcharge or
impounding Class I, H or IIIA liquids.
5. Water tanks supported directly on grade if the
capacity does not,exceed 5,000 gallons ('18 925 Q
and the ratio of height to diameter or width does not
exceed 2:1.
6. Sidewalks and driveways not more ihan 30 inches
(762 mm) above adjacent grade; and not over any
basement 'or story, below, and are not part of an
accessible route.
7. Painting, papering, tiling, carpeting; cabinets, coun-
ter tops and similar finish work.
8. Temporarymotion picture, ' television and theater
stage sets and scenery:

R-3 occupancy that are less than 24 inches (6 10 mm)

setbacks (the provisions of this clause shall apply regardless of whether the lot complies with
current area and frontage requirements).
4. Alteration of a structure which encroaches upon one or more required yard setbacks, where the
altered part of the structure will comply with all current yard setbacks, or the alteration is to
the side or face of the structure which encroaches upon a required yard setback, and the
alteration does not further encroach upon the required yard setback. In either case, the altered
structure must comply with current building coverage and building height requirements (the
provisions of this clause shall apply regardless of whether the lot complies with current area
and frontage requirements).
5. Alteration to a nonconforming structure which will not increase the footprint of the existing
structure provided that existing height restrictions shall not be exceeded. In the event that the
Zoning Enforcement Officer (Building Commissioner) determines that the nonconforming
nature of such structure would be increased by the proposed extension, alteration, or change,
the Zoning Board of Appeals may, by special permit, allow such extension; alteration, or
change where it determines that the proposed modification will not be substantially more
detrimental than the existing nonconforming structure to the neighborhood.
b. Pre-existing Nonconforming Single Family Structures: No portion of this Section 9.3, Pre -
Existing Non -Conforming Single Family Residential Structures and Uses in the Residential 1,
Residential 2; Residential 3, Residential 4 and Residential 6 Zoning Districts shall be construed to
allow for any uses other than those expressly allowed as defined in each above listed zoning
district of the Zoning Bylaw. (2004/41)
9.4 Building After Catastrophe
Any non -conforming building or structure destroyed or damaged by fire, flood, lightning, earthquake
or wind to the extent of sixty-five percent (65%) or more of its reproduction cost at the time of such
damage shall not be rebuilt, repaired, reconstructed nor altered except for a purpose permitted in that
zoning district in which such building is located, or except as may be permitted by a Special Permit or
otherwise by the Board of Appeals acting under Massachusetts General Laws Chapter 40A.
9.5 Abandonment
If any lawfully non -conforming building or use of a building or land be at any time discontinued for a
period of two years or more, or if such use or building be changed to one conforming with the North
Andover Zoning Bylaw in the district in which it is located, it shall thereafter continue to conform; or
take any other action relative thereto
