-Any plumbing over 25ft from pool. Additional runs are not recommended but would beat a cist o per foot per line.
Machine time in excess of that specified above. APtional machine time to be billed at including machine, operator, and laborer, due with second pool payment.

RE: VIOLATION of the Massachusetts Wetland Protection Act (M.G.L. C.131 § 40) and
the North Andover Wetland Protection Bylaw (C. 178 of the Code of North
Andover) at 172 Summer Street
Dear Mr. & Mrs. D'Angelo,
During a site inspection for a proposed fence installation on your property, I observed
unauthorized land clearing in the buffer zone to a Bordering Vegetated Wetland (BVW) and an
associated Vernal Pool (VP). According to C. 178.2 of the North Andover Wetland Protection
Bylaw, "No person shall engage in the following activities: removal, filling, dredging,
discharging into, building upon, or otherwise altering or degrading the wetland resource areas..."
including any I 00 -foot buffer zone (see also Wetland Protection Act Regulations 3 10 CMR
10.55). Work within 100 -feet of a wetland resource area requires a filing with the North Andover
Conservation Commission (NACC) under both the Massachusetts Wetland Protection Act and
the North Andover Wetland Protection Bylaw (more information is available at the Town of
North Andover website under the Conservation Department link).
On August 26, 2009, the NACC issued a small project permit to allow you to install fencing
along the perimeter of your property up gradient of the 25 -foot No -Disturbance Zone. In
addition, the NACC agreed an Enforcement Order should be issued requiring you to restore the
25 -foot No -Disturb Zone to BVW and the 50-footNo-Disturb Zone to the Ve mal Pool, on, the
southeastern portion of your lot along an existing path. Attached photos show that the existing
path was widened and now encroaches on these buffer zone areas.
In addition, the applicant shall file a Request for Determination (RDA) by October 15, 2009 to
properly permit the land clearing which occurred in the buffer zone. This RDA shall address any
additional work you wish to do in the I 00 -foot buffer zone including grading, landscaping and
brush storage. A proposal which includes additional work such as excavation or structures within
the I 00 -foot buffer zone may require the filing of a Notice of Intent (NOI).

Failure to comply with this Order and the deadlines referenced herein will result in the issuance
of additional penalties. MGL C.131 S.40 and the North Andover Wetland Bylaw, C.178
authorizes the Conservation Commission to seek injunctive relief and civil penalties per day of
violation. In addition, a violation of the Massachusetts Wetland Protection Act and the North
Andover Wetland Bylaw constitutes a criminal act, which is subject to prosecution and the
imposition of criminal fmes, also per day.
This tnforcement Order shall become effective upon receipt. Your anticipated cooperation is

voted to issue a Negative Determination of Applicability for site grading associated with the
construction of an in -ground swimming pool and cabana within the Buffer Zone to a Bordering
Vegetated Wetland (BVV)). All pool and cabana construction is located outside of thelOO-foot
Buffer Zone.

Erosion control barriers shall be properly mistalled and shall remain intact until all disturbed
areas have been permanently stabilized to prevent erosion. Erosion controls shall be inspected
by the Conservation Department prior to the start of construction. All erosion prevention and
sedimentation protection measures found necessary during construction shall be implemented at
the direction of the NACC. Should additional measures be required by the NACC, they shall be
installed within 48 hours of the Commission's request.
Excess material and construction debris shall be properly disposed of off site and all stockpile
areas shall be located beyond the 50 -foot No -Build Line shown on the plan referenced herein.

Accepted engineering and construction standards and procedures shall be followed in the
completion of the project.
4* The applicant shall install a rock wall/border at the edge of tree line (completing a partial rock
border already established in this area) on the southern portion of the property. Wetland
Markets have already been established in this area.
Post Construction
Immediately following completion of the work, any disturbed areas shall be permanently
stabilized against erosion. Grading behind the proposed cabana shall be the limit of the
proposed lawn area. South of this grading line shall remain in a natural state due to the sensitivity
of the adjacent wetland and vernal pool.

conduct a final site inspection.

Pursuant to section 4.4.2 H of the North Andover Wetlands Protection Regulations, James and Linda
UAngelo, applicants/ owners, filed a small. project request for work proposed at 172 Summer Street,
