WETLAND RESTORATION PLAN
120 HOLT ROAD
NORTH ANDOVER, MA
SITE DESCRIPTION
The property located at 120 Holt Road consists of an existing concrete block structure
and gravel parking areas which are currently used as a contractors yard and a storage area
for towed vehicles. The site was created many years ago by filling both upland and
wetland areas. The site is located on the south side of Holt Road and is bordered by the
Lawrence municipal airport on the south and east sides. The site borders a vegetated
wetland associated with an intermittent stream that flows on the west side of the property.
Bordering vegetated wetlands abut the filling on the west and most of the south sides of
the parking areas.
In the area of recent filling the wetlands vegetation consists primarily of a Red Maple tree
layer with Cinnamon Fern, Sensitive Fern and wetlands grasses as ground cover. The
wetlands in the area of the filling lacks a shrub and sapling layer.
Currently the fill at the rear of the property in the area of the violation is approximately 8
feet higher than the wetlands at the base of the fill.
VIOLATION DESCRIPTION
According to the property owner the filling occurred in conjunction with cleaning and
squaring off the parking area at the rear of the building. The existing slope was cleaned of
debris that had been stored along the top off and on the slope. Small saplings and
underbrush were also removed. The parking area was then extended approximately ten
feet into the wetlands. None of the wetland soil was removed before the filling occurred.
PROPOSED RESTORATION PLAN
PHASE 1:
Phase 1 would consist of removing the new fill in an area of approximately 300 square
feet in size. The fill would be removed with an excavator in a manner that would leave
the old wetland soil in place. New loam would be added to areas where the depth of the
wetlands soil was insufficient for supporting wetland vegetation. This phase would be
supervised at all times by BAG land consultants. BAG land consultants is a full service
environmental firm from Concord New Hampshire. The staff of BAG land consultants
consists of botanists and biologists whose specialty is working as environmental monitors
and overseers monitoring creation of wetlands- ,- s. Towns that BAG Land
Consulting has done work in include Wellesley, Bedford, and Lexington.

Phase 2 would consist of coustrAction_a boulder retaining wall to stabilize the slope
around the restored area. Also a guard rail would be installed along the top of the slope to
prevent further intrusion into the area in the future.
PHASE 3:
Phase three would consist of restoring the vegetation to the restored area. The addition of
the following plant material will be planted under the supervision of BAG Land
Consulting.

Plant material would be obtained from available nursery stock or from upland areas on
the site. Plant material selection would be done by BAG Land Consultants. The wetland
seed mix specification would be done by BAG Land Consultants.

This Department is in receipt of the Wetland Restoration Plan dated December 1, 1999
and hereby approves the document with the following instructions:
• Install trenched silt fence, remove existing haybales to prevent a berm from forming
and schedule a pre -construction inspection with this Department prior to commencing
any work.
• Complete the restoration work approved in the Restoration Report dated December 1,
1999 by no later than June 1, 2000.
• A Replication/Restoration As -Built plan prepared by a Registered Professional Land
Surveyor must be submitted to this Department within 30 days upon completion of
the approved referenced work. The plan shall including one -foot contours, spot
elevations, surface area and plant locations.
• Erosion control shall not be removed and shall remain fully intact until the area is
fully stabilized as determined by the North Andover Conservation Commission
(NACC) or an Agent thereof during a post construction inspection.
Attached you will find an Enforcement Order as a mechanism to perform the above
referenced work.

Order
The Issuing Authority hereby orders the following (check all
that apply):
❑ The property owner, his agents, permittees, and all
others shall immediately cease and desist from the further
activity affecting the Buffer Zone and/or wetland resource
areas on this property.
Wetland alterations resulting from said activity shall be
orrected and the site returned to its original condition.
❑ Complete the attached Notice of Intent. The completed
application and plans for all proposed work as required by
the Act and regulations shall be filed with the Issuing.
Authority on or before (date).
No further work shall be performed until a public hearing
has been held and an Order of Conditions has been issued
to regulate said work.
0 Appeals/Signatures
An Enforcement Order issued by a conservation commission
cannot be appealed to the Department of Environmental
Protection, but may be filed in Superior Court.

Conservation Commission
In a situation requiring immediate action, an Enforcement
Order may be signed by a single member or agent of the
commission and ratified by a majority of the members at the
next scheduled meeting of the commission.

Failure to comply with this Order may constitute grounds
for additional legal action. Massachusetts General Laws
Chapter 131, Section 40 provides: "Whoever violates any
provisions of this section shall be punished by a fine of not
more than twenty-five thousand dollars or by imprisonment
for not more than two years or both Each day or portion
thereof of continuing violation shall constitute a separate
offense."
