The North Andover Board of Appeals held a public hearing at its regular meeting on Tuesday,
August 13, 2002 at 7:30 PM upon the application of New England Power Company, 55
Bearfoot Row, Northborough, MA for premises at: 0 Foster Street, North Andover, MA
requesting a Special Permit under Section 4, Paragraph 4.12 (10) and Section 2, Paragraph 2.65
to allow for a Public Service Corporation in a residential district, said premises affected is
property with frontage on the North side of Foster Street within the R-1 zoning district.
The following members were present: William J. Sullivan, Walter F. Soule, John M. Pallone,
Ellen P. McIntyre, George M. Earley, and Joseph D. LaGrasse.
Upon a motion by William J. Sullivan and 2nd by George M. Earley, the Board voted to
GRANT the Special Permit for relief from Section 4, Paragraph 4.121(10) under Section 2,
Paragraph 2.65 to allow for a Public Service Corporation to build Woodchuck Hill Substation
No. 56 in a residential district according to plans: 1. Property plan / Existing conditions, 2. Site
plan, 3. Erosion control plan, 4. Landscape / Mitigation plan, 5. Construction details, 6.
Electrical arrangement, 7. Control house details, and 8. Abutting property plan, prepared by
National Grid USA Service Company, hic., 55 Bearfoot Road, Northboro, MA 015312 for New
England Power Company, Foster Street, North Andover, Massachusetts Assessors Map: 104B —
Parcel 28/29 dated March 21, 2002. [#1&2=mylar] The Special Permit has the following
conditions: 1. A continuous chain link fence (at least 6' high) with triangle barbed wire on top
of the chain link fence along both sides of the entrance/exit roadway. 2. Chain link entrance/exit
gating (at least 6' high) with triangle barbed wire on top of chain link gating. 3. The gating must
be designed to overlap, leaving no openings, and must be locked at all times (except when
authorized personnel are entering or leaving the driveway). 4. The fence and gating must
surround the entrance, the driveway, and the substation. 5. Fence and gating inspection and, if
necessary, repair must be part of the monthly substation inspection. 6. Lights, if necessary, only
during monthly inspection. 7. Reflecting signs and/or warning discs every 10', and 4' high on
outside of fence to prevent the installation (fence & substation) from creating a hazard for All
Terrain Vehicles, snowmobiles, etc. that may use the area. The Board finds that the petitioner
has satisfied the Board under Section 2, paragraph 2.65 of the Zoning Bylaw and that the
granting of this Special Permit will not adversely affect the neighborhood or derogate from the
intent and purpose of the Zoning Bylaw. Voting in favor: William J. Sullivan, Walter F. Soule,
Ellen P. McIntyre, and George M. Earley. Voting against: John M. Pallone.

Furthermore, if the rights authorized by the Variance are not exercised within one (1) year of the
date of the grant, it shall lapse, and may be re-established only after notice, and a new hearing.
Furthermore, if a Special Permit granted under the provisions contained herein shall be deemed
to have lapsed after a two (2) year period from the date on which the Special Permit was granted
unless substantial use or construction has commenced, it shall lapse and may be re-established
only after notice, and a new hearing.
