The construction of the substation is in close proximity of the existing electric transmission lines. At the present time the Power Company has not applied for a building permit. I performed a site visit this morning and believe the substation structure will not be seen from Foster Street as it will be down gradient of a knoll. In addition the closest corner to the cleared area for the proposed structure is approximately 290 L.F. from the center line of Forest Street. The cleared area of approximately 240 feet x 145 feet (34,800 square feet), as shown on the site plan is fenced in. The 528 square foot pre-engineered metal structure for the "High Voltage Transformer Equipment' is located in this fenced in area. There will be a curved driveway of approximately 740 linear feet from Foster Street servicing the substation. The driveway is to be fenced in on both sides with a gate at the entrance to prevent accessibility of the general public. The site will have to be built as per the approved Site Plan, an as -built plan will be submitted to ensure that all conditions of the Special Permit have been met. My site visit this morning revealed massive excavation and clearing being performed by the contractor for the installation of the Maritime Gas Transmission line. Perhaps Mr. Harris has mistaken this activity for the construction of the substation. The construction of the substation is in close proximity of the existing electric transmission lines. At the present time the Power Company has not applied for a building permit. I performed a site visit this moming and believe the substation structure will not be seen from Foster Street as it will be down gradient of a knoll. In addition the closest comer to the Geared area for the proposed structure is approximately 290 L.F. from the center line of Forest Street. The cleared area of approximately 240 feet x 145 feet (34,800 square feet), as shown on the site plan is fenced in. The 528 square foot pre-engineered metal structure for the "High Voltage Transformer Equipment" is located in this fenced in area. There will be a curved driveway of approximately 740 linear feet from Foster Street servicing the substation. The driveway is to be fenced in on both sides with a gate at the entrance to prevent accessibility of the general public. The site will have to be built as per the approved Site Plan, an as -built plan will be submitted to ensure that all conditions of the Special Permit have been met. My site visit this morning revealed massive excavation and clearing being performed by the contractor for the installation of the Maritime Gas Transmission line. Perhaps Mr. Haris has mistaken this activity for the construction of the substation. The gentlemen's concern is not the actual construction of the substation; rather he was "allegedly" told at the Planning Board hearing that the equipment enclosure would be out of viewfrom Foster Street, due to the terrain of the property (slopes downward). Evidently, the gentlemen contacted Kathy McKenna back in late November of 2002 because he has submitted pictures demonstrating a fenced in area which he feels indicates the project is actually larger than it is. Kathy subsequently gave her notice and did not respond to the abutter. The gentlemen then contacted and spoke with a Mr. John Upham of NE power who indicated to Mr. Harris that there is going to be a fenced in area of 300' x 300'. The gentlemens' concem is that (1) the hill he thought was going to stay has been removed; and (2) why is there an approximately 90,000 LT='' Page 2 of 2 square foot fenced in area and what, if anything is being constructed inside of it? If I recall, (vaguely) this project required both an NOI and some variances from the ZBA. I believe the ZBA requiring some fencing around the equipment shelter; I'm assuming, hopefully, that the fenced in area the gentlemen is referring to is simply silt fence as a result of an NOl (the pictures appear to indicate silt fence). I would like to ask that you each do the following: (1) conduct a drive-by of the site and research your decisions for comparisons to ensure what is being built is actually permitted, and then submit me a quick email with your findings. Keep in mind that the abutter wants to know (1) if he was informed property of what was going to occur on site (the Planning Board hearing notice only states permission of a 528 square foot enclosure) so if you have an abutters` notice and/or decision by your respective boards) that is reflective of this fenced in area, I would appreciate a copy of that notice being given to Donna Mae and (2) NB power is currently applying for a building permit; if either or you could please also take a copy of the PB approved site plans and see if the plans depict that the "hill" was going to stay and get back to me on that issue also I would appreciate it. He was notified of the Conservation meeting through certified mail and signed for the green card in May of 2002. The legal notice did not state a specific size for the substation. After review of my files and review of the Planning Board decision, it is my opinion that the Planning Board decision may have been misleading. The decision does state construction of a 528 s.f. equipment enclosure. This 528 s.f. only pertains to the proposed small utility building, not the entire substation network. The- Notice of Intent application proposes a 35,670 s.f electric substation which includes the utility building and substation infrastructure. Also included under the filing is the clearing for the tap lines and driveway construction. This is a pretty extensive project with a significant amount of clearing. The project does propose grading and leveling of hills. During the ZBA process, the Board required the driveway up to the substation be enclosed by a fence. The driveway and the entire substation infrastructure will be enclosed with permanent fencing. I am unaware if this gentlemen attended the Conservation meetings to inquire about the project. I suggest he come into the office to review our files. To date, I am unaware of any major problems or deviations from our approved plans. I have been on site several times and this Department continues to review the weekly monitoring reports. Keep in mind, prior to this project being filed with Conservation, an extensive third party review was conducted by Seekamp Environmental to review the project for compliance with state and local regulation. Upon my employment with the Town, I worked with the applicants and suggested they file the design which was presented to and approved by all the Town Boards. Another development option was proposed but resulted in greater alterations to wetland resource areas. NEP proposes to construct an electric power substation and ancillary facilities on property located off Foster Street, adjacent to the existing electric transmission lines (the "Site"). The Site is located in the Residential -1 zoning district. Pursuant to Section 4.121 (10), Building and Uses, and Section 2.65, Definitions, the proposed substation requires a Special Permit from the Zoning Board of Appeals because it is a "Public Service Corporation" in a residential zone. Description of the Site The Site contains approximately 41 acres off of Foster Street in North Andover. The majority of the Site is currently undeveloped woodland; however, two high voltage transmission lines traverse a portion of the Site. Mosquito Brook bisects the lot and several wetland resource areas have been identified on the Site. Proposed Proiect NEP proposes to construct an electrical substation located between Mosquito Brook and Foster Street. The purpose of the proposed substation is required to maintain reliable electric power service to the Town of North Andover by providing electric capacity to serve recent and projected load growths in the area. The proposed substation will be set back from Foster Street by approximately 290 feet. The proposed substation will involve construction of a perimeter fence measuring approximately 140' x 220'. The substation equipment will be installed within the fenced area; some equipment will be installed on concrete foundations and the remainder of the substation yard will be crushed stone. A control house measuring 22' x 24' (and 12' tall) will be constructed within the fenced area. A driveway to access the proposed substation will be constructed off Foster street at an existing gravel cart path that enters the property. Wooden pole structures will be installed at the Site to connect tap lines from the existing 115 kV transmission lines to the substation. NEP will re -vegetate disturbed areas and other areas of the Site with landscaping and screening. The Proiect Satisfies the Criteria for Use Special Permit Decision The Site is zoned Residence 1. Pursuant to Section 4.121 (10) of the Zoning Bylaw a Public Service Corporation is an allowed use by Special Permit. Section 10.31 (1) defines the Special Permit approval criteria as follows: a. The specific site is an appropriate location for such use The land is owned by New England Power Company and encompasses part of the existing electric transmission line corridor through North Andover. The substation must be located adjacent to the transmission lines, as these lines are the supply source to meet the needs of North Andover. b. The Use as developed will not adversely affect the neighborhood The substation will be set back over 200' from Foster Street within a heavily wooded area. The existing vegetation will be preserved around the outer perimeter of the property to screen the substation. Landscaping has been proposed along the driveway entrance at Foster Street and at the northern substation fence to supplement screening provided by the natural vegetated buffer. c. There will be no nuisance or serious hazard to vehicles or pedestrians The proposed substation will not be manned and will generate very minimal traffic consisting of approximately one service vehicle per week performing inspection and maintenance at the Site. d Adequate and appropriate facilities will be provided for the proper operation of the facility As the Site will be unmanned, the Use does not require the disposal of solid waste on a regular basis. All waste will be disposed of properly. No public or private water and sewer utilities are needed for the Site. e. The Use is in harmony with the general purpose and intent of this bylaw The proposed substation is in harmony with the intent of the Town's bylaw. Specifically, the substation will assist in providing economical electric services to the Town's inhabitants. In addition the proposed substation will effectively commit 41 acres to a use other than high density development. The proposed substation will also increase electric reliability in the Town, creating a positive benefit for the Town. Conclusion For the reasons stated above, the Board should grant the requested Special Permit.
