GENERAL INFORMATION
1. Only Certified Soil Evaluators may perform deep hole inspections.
2. Only Mass. Registered Sanitarians and Professional Engineers can design
septic plans.
3. At least two deep holes and two percolation tests are required for each septic
system.
4. Repairs require at least two deep holes and at least one percolation test, at
the discretion of the BOH representative.
5. Full payment will be required for all additional tests within two weeks of
testing.
6. Within 45 days of testing, a scaled plan (no smaller than 1"-100') shall be
submitted to the Board of Health showing the location of all tests (including
aborted tests).
7. Within 60 days of testing soil evaluation forms shall be submitted.

Gentlemen:
I am writing to protest the acceptance of a septic system design for Lot 2 / Johnnycake Street /
Carlton Farms. I am concerned that the design is not in compliance with appropriate
regulations, and acceptance of the design by your Board may have been under false
assumptions.
This development has a long history, going back through the early 80's when the development
was the subject of a lengthy and costly legal battle revolving around the location and extent of
wetlands, and the resulting restrictions placed on both the town and the developer regarding
individual lots. Enclosed is a photocopy of the accepted delineation of wetlands as it affects Lot
2, copied from a drawing by Frank Gelinas and Associates of North Andover; a copy of the title
block is also enclosed. This drawing clearly shows the extent of wetlands on Lot 2, and also
delineates a stream at the boundary of lots 2 and 3. The resulting 100 -foot limit is also clearly
shown.
Recently, the developer has been attempting to get a new permit to build on Lot 2, having
allowed the prior permit to lapse. The plan presented to your Board for approval somehow
manages to show an entirely different 100 -foot limit, and conveniently manages to have the
necessary setbacks. However, based on the original plans, this submittal would clearly be in
violation. Clearly, the developer cannot contend that the present set of conditions should
determine the acceptability of his proposal, because the lot does not include sufficient non -
wetlands area to build. Thus, any claim that the lot should be judged on its present condition is
untenable. On the other hand, there is no justification for a "grandfathering" process either,
since the town is not at fault for the developer allowing a permit to expire.
Judging from the turnout at Conservation Committee meetings, the neighborhood is actively
opposed to allowing this project to continue without following the rules. I don't believe that it
constitutes following the rules to obtain a septic system permit given the nature of the lot and
the proposed design. I urge you to reconsider this permit, with a full understanding of the facts
surrounding the situation. It is truly unfortunate that the process of applying for permits does not
require input from abutters to avoid these situations; hopefully, a misapplication of the process
can be corrected in this case.
I look forward to seeing a reasonable resolution of this issue.

Board of Health granted a conditional waiver to North Andover
Regulation 2.14 of the Minimum Requirements for the Subsurface
Disposal of Sanitary Sewage provided the following conditions are
met:
1) Floor plans of the proposed dwelling must be reviewed by the
Health Agent and verified that there are only three bedrooms.
2) The three-bedroom maximum restriction must be recorded on
the deed and a copy must be filed with the Board of Health.

I have reviewed the proposed septic plans for Lot 2
Johnnycake Lane dated 9/1/93. Everything appears to be in order
except for the design flow, which, as you know in North Andover
is a minimum of 660 gallons per day. I recommend requesting a
variance from the Board of Health to North Andover regulation
2.14(4), minimum size subsurface sewage disposal system for new
construction. The variance should be for the number of bedrooms
- from 4 per dwelling to three. If granted, a statement must be
recorded on the deed that there can be a maximum of three
bedrooms in this house.
If this is what your client would like to do, I will need a
letter requesting the variance as soon as possible for the
September 16th meeting. Because this is a local regulation a
hearing will not be required.
I shall expect to hear from you shortly.

I have reviewed the proposed plans for Lot 2 Johnnycake Lane
and found some problems as itemized in the attached design review
sheet. Most of items could be subject to waivers granted by the
Board of Health if it can be shown that the same level of
environmental protection can be achieved one way or another.
Item 4, however, is another story. According to the state, there
can be no interpolation between rates on the chart for leaching
area requirements; so in this case a 15 minute per inch design
rate must be used. Of course, a variance can be requested from
DEP if the North Andover Board of Health grants a waiver to this
first.
The next Board of Health meeting date is September 16th.
For variances to be considered at this meeting we would have to
have a written request into the office almost immediately. Let
me know what you intend to do.

RE : Crossing Wetlands to Conduct Perc Test
Please be advised that if any perc tests or deep hole tests
require crossing wetlands, a permit from the Conservation
Commission will be required prior to the testing. I received a
number of complaints last week from residents of Carlton Farms
subdivision who witnessed heavy equipment crossing wetlands to
conduct perc tests. Any alteration of land within 100' of a
wetland, such as crossing a wetland for a perc test, requires a
permit. Protection measures must be installed under the
direction of the Conservation Commission in such cases. Please
inform any landowners of this requirement in the future.
