Andover, MA 01845 * DECISION ********************************** The Board of Appeals held a regular meeting on Tuesday evening, November 14, 1989 upon the application of the North Andover School Committee requesting a variation from the requirements of Seciton 8.1.2 and a Special Permit of Section 10, Paragraph 10.4 of the Zoning Bylaws so as to permit reduction of the parking requirements of 157 parking spaces to 122 spaces on the premises located at (Calzetta) between Johnson Street and Abbot Road. The following members were present and voting: Frank Serio, Jr., Chairman, Walter Soule, Raymond Vivenzio, Anna O'Connor and Louis Rissin. The hearing was advertised in the North Andover Citizen on October 19 and October 26, 1989 and all abutters were notified by regular mail. Upon a motion made by Mr. Rissin and seconded by Mr. Soule, the Board voted, unanimously, to GRANT the variance as requested and allow the petitioner to WITHDRAW WITHOUT PREJUDICE the Special Permit requested. The Board finds that the granting of this variance will not be a detriment to the community and will not nullify or substantially derogate from the intent and purpose of this bylaw. The following estimates are based on my assessment of the manner in which the school would actually function for the proposed enrollment. I also took our current practices at the Franklin School into consideration since that school has a current enrollment of 525 students compared with a regular classroom capacity of 600 for the proposed school. I anticipate the use of 53 parking spaces for staff during the day. Five of those spaces will be used by cafeteria workers a few hours during the day. The projected enrollment for this school indicates that there will be full-time specialists in special education, art, and music, and shared spaces for such limited use professionals as a physical therapist and an occupational therapist. All such spaces are included in the esti- mate of staff parking space needs. (See attached sheet.) As at our other schools, I believe there will be two main evening programs per year and some day performances by children, generally around Thanksgiving and Christmas, which will be attended by some parents. Although the gymnasium will be available for community use, I do not envision a use of more than fifty (50) spaces for that purpose. we will not allow the gymnasium to be used when the major evening events men- tioned above are being held. The requirement is established by the following: 1. The Cafetorium of 3000 5F is assumed to have a capacity of 428 occupants based on the state building code allowance of 7 SF per person. 2. The Gymnasium (which will be used for athletic purposes only) is being designed to accommodate 50 spectators and 50 athletic participants at one time. It is conceivable that for special events (e.g. Gym shows) this total could be doubled. Accordingly, a maximum capacity for the Gym of 200 people is possible. 3. The total of these figures is 628 (Item 1 = 428 plus Item 2 = 200 = 628) 4. 628 divided by 4 (North Andover By-law 8.1) = 157 parking spaces. It should be noted that it is extremely unlikely that Items 1 and 2 would ever take place to the maximum capacity on a simultaneous basis and that most of the occupants of this building, on most occasions, will be elementary aged children. Our appeal is based on the following: The School is being designed for 600 children, grades 1-5 (plus up to 50 in 2 collaborative classrooms). The anticipated daily parking need for staff is 53 (see attached correspondence from Superintendent of Schools). We are actually providing 83 unrestricted parking spaces which would allow 30 for daytime visitors. At off school hours an additional 39 parking spaces are available for parking. These areas are used during the day for bus drop off and pick-up, and parent drop off and pick-up. We believe that the resulting total of 122 cars is adequate based on the needs detailed above and also prior experience by and actual practices of the North Andover School System. It should be noted that the number of cars could be accommodated on site by using additional green space, should conditions in the future dictate that this be in the best interest of the Town. At this time, it is felt that maintenance of this valuable green space represents a public amenity that outweighs the rare benefit that would be gained by providing space for 34 more cars. Furthermore it is felt that maintenance of this green space related to on site wetlands that themselves cannot be altered outweigh the benefits of providing space for these cars. Substitution We believe that the current owners of 483 Johnson Street are Robert F. and Susan A. Burke, not Richard A. and Mary Ellen Foulds.
