The Board of Selectmen and the Highway Surveyor respectfully
request that the Zoning Board of Appeals schedule
consideration at its next meeting on Tuesday, May 27, 1986 at
7:30 p.m. of the plan for an Old Center Parking lot
previously approved by your Board.
The concerns of the Highway Surveyor have recently come to
our attention on several aspects of this plan; and we would
wish to reapproach the Zoning Board of Appeals in an
appropriate context. In general, the two attached plans tell
the story ---insofar as your Board has approved the plan shown
as Attachment A, and the Highway Surveyor and the Board of
Selectmen would wish for you to consider_ the amendments to
this plan shown as Attachment B.
By copy of this letter to Town Counsel, we are asking for
their assistance in determining what will be the appropriate
route for the Town of North Andover to follow in seeking to
resolve these concerns before the Board of Appeals. Thank

North Andover Center. This work will be done in anticipation
of the construction of the new parking facility that is

This department plans on starting all street and side-

Dear Mr. Serio:
I have watched the construction of the Old Center parking area with
a sequence of reactions: pleasure, disturbance and finally, with
great disappointment.
First, pleasure - that work was beginning, after working with so many
organizations and individuals to help embody their thoughts and
wishes in this project of civic importance in the Old Center. Then,
disturbed, as no contact was ever made to this office as work
progressed - on a project put together here. Lastly, with considerable
disappointment, to find that the layout, embodying the wishes and
thought of many groups and individuals was not followed.
Mr. Cyr was involved in the development of the layout and all of his
suggestions were included.
I am very embarassed for the many individuals who participated and
helped with the plan which was approved but then ignored - and
disappointed to find instead a layout which would appear not to work
very well, waste spaces and, frankly, is an intrusion in the Old Center.
I think these problems could be largely solved with ammendments to the
Johnson Street end of the area.
Shouldn't the wishes and concerns of the community be considered?

Subject: Parking Lot in the Old Center
Last fall the Selectmen authorized a site survey of the Town -
owned property on Johnson Street between the Cochichewick Lodge and the
Community Center. (See attached news article.) Using the results of
this site survey, the Old Center Study Committee engaged Peter Hornbeck,
a professional landscape architect, to determine the optimum layout of
a parking lot on the property, as well as associated street improvements,
and to draw a detailed plan for the Town to consider.
Such a plan was first circulated among the Town Departments and
received approval except for minor changes suggested to facilitate snow-
plowing and pedestrian access. This plan also was submitted to the Board
of Appeals to obtain a special permit. This permit was granted based
on the submitted plan. (See attached Notice of Decision.)
The Old Center Study Committee met on December 3, 1985 and approved
the final version of the plan, which was then forwarded to the Selectmen..
(See attached minutes.) Buddy Cyr attended this meeting, voted to approve
the plan, and did not mention any disagreement with any feature of the plan.
He received copies of the plan at that meeting.
Karen Nelson forwarded the plan to James D. D'Angelo, who had
offered to provide additional engineering specifications, but Mr. D'Angelo
never responded. Thus, nothing was done over the winter to prepare for
construction.
Several weeks ago, Mr. Cyr began the street work indicated on the
plan associated with the parking lot (relocation of street drains and
telephone poles, and installation of granite curbing). Two weeks ago,
Karen asked Buddy if he would also construct the parking lot, and she
told me that Buddy said "No". Karen and I then called Keith Bergman to
suggest that he speak to Buddy on behalf of the Selectmen to see if the
Highway Department would construct the parking lot according to the
approved plan in return for a transfer of the funds for this purpose
voted at the 1985 Town Meeting.
Last week, the granite curbing for the parking lot was installed,
but it was not installed according to the plan (copy attached). Four
basic features are wrong: 1) The plan calls for two double -width entrances
from the street centered on each of the two parking bays. Only one
entrance has been installed, in the middle, which presents an awkward
circulation pattern. 2) The curb near the Cochichewick Lodge was supposed
to be located 5 feet away from the property boundary,which is 20 feet
from the Lodge building. Thus this curb was to be 25 feet from the
building. This curb has been installed 18 feet from the building, and
therefore is located on Lodge property. The reason for the location of
this curb was to allow the row of tall evergreen trees along the Lodge
property to remain undisturbed. Instead, all of these trees have been
removed (from property not owned by the Town) by the North Andover Tree
Department. 3) The plan showed no curbing separating the two double
Parking bays. Painted lines were specified instead. Contrary to the plan,
a four foot wide granite curbed strip has been installed, which is too
narrow for any tree planting, The curb near the Lodge may have been
moved over to make room for this unnecessary dividing strip. 4) The
plan has a 45-50 foot setback for lawn and trees between the street
and the parking lot. The curbing that has been installed reduces this
to about 20 feet. There are other miscellaneous problems: so much fill
has been brought in that the grade near Johnson Street is higher than
the street rather than lower as specified in the plan; the base and the
underground wiring for a light near the rear of the parking lot has
not been installed; there are large rocks and other debris at the rear
of the lot that probably should be removed.
It seems to me that the Selectmen should require that the approved
plan be followed. The changes listed below might be considered.
a) Lower grade to drain away from street.
b) Remove the present middle entrance and install two entrances
alligned with the two parking bays according to the plan, and maintain the
45-50 foot setback specified in the plan.
c) Remove center strip. Install underground wiring and post
for light.
d) Relocate curb near Lodge as shown on plan (25 feet from building
instead of 18 feet).
e)Plant new row of trees to replace those removed contrary to plan.
f) Remove large rocks and debris as necessary at rear of site.

MINUTES:
A meeting of the Old Center Study Committee, in response to notice sent November 22,
1985 by Karen Nelson, was held on Tuesday, December 3, 1985 at 3:30 p.m. in the
Selectmen's Meeting Room at Town Hall in North Andover, Massachusetts. The meeting
was attended by David M. Blanchard, Peter L Hornbeck, William J. Sullivan and
committee members, Mrs. Hayden Clark, William A. Cyr, Thomas W. Leavitt, Karen Nelson,
Howard M. -Thomson and Eugene H. Avrett.
Mr. Hornbeck presented a plan for the parking lot in the Old Center and for associated
changes in the west side of Johnson Street between the Brick Store and the Community
Center. He indicated that a number of adjustments had been made in the earlier park-
ing lot plan presented to and approved by the North Andover Board of Appeals, in
order to facilitate snow plowing and pedestrian access.
Mr. Avrett reported that the Cochichewick Lodge had agreed to the suggestion that
their two driveway openings on Johnson Street be closed off and that, instead, a
connection be provided between their back parking area and the new parking lot.
Consequently, the new plans include such a connection to their back parking area and
a continuous curb along Johnson Street between the Brick Store and the new parking lot.
•
Mr. Sullivan asked for further study of the street boundary between the Brick Store
and the new parking lot to see if a number of diagonal parking spaces might be
provided.
Mr. Thomson asked whether one entrance to the parking lot might be better than two
and whether, diagonal pakring within the lot might be better than perpendicular park-
ing. Mr. Hornbeck explained that both alternatives would reduce the number of avail-
able parking spaces, and efficency for circulation -and that the landscaped setback from
the street that is in the plan would avoid the appearance of excessive paving.
It was moved, seconded, and unanimously VOTED to ACCEPT the parking lot and street
plans and to recommend to the .Selectmen that these plans be used for the construction
of the parking lot and for related street improvements.
Ms. Nelson agreed to forward copies of the plans to the Selectmen and to James D.
D'Angelo, who has offered to prepare engineering specifications.
Mr. Cyr agreed to review the proposed street changes, including curbing,'relocation
of catch basins, and relocation of•two telephone poles.
Mr. Leavitt announced that the Museum of American Textile History plans to donate a
tree.to be planted on Johnson Street at the entrance to the parking lot, in honor of
the late Raymond Ryan who lived and worked in the Old Center for many years.
The meeting was adjourned at 4:30 p.m.

The Board of. Appeals held a public hearing on Tuesday.evening, October
15, 1985 upon the application of the Town of North Andover. The hear-
ing was advertised in the North Andover Citizen on September 26, and
October 3, 1985 and all abutters were notified by regular mail. The
following members were present and voting: Frank Serio, Jr., Chairman,
Alfred E. Frizelle, Esq., Vice Chariman, William J. Sullivan, Walter F.
Soule and John Simon.
The petitioners seek a Special Permit from the requirements of the
Zoning ByLaws Section 4,"Paragraph 1G and 16 so as to permit the con-
struction of a municipal parking lot with associated.structures.
Upon a motion made by Mr. Frizelle and seconded by Mr. Simons, the Board
unanimously voted to GRANT the Special Permit for a parking lot for the
municipal building and other existing facilities in the old center area
as shown ona plan prepared by Peter Hornbeck, received by the Zoning
Board of Appeals on October 11, 1985.

Every application for action the Board shall made on a form approved
by the Board. These forms shall be furnished y the Clerk upon request.
Any communication purporting to be an application shall be treated as mere
notice of intention to seek relief until such time,as it is made on the
official application form. All information called for by the form shall
be furnished by the applicant in the manner therein prescribed.
Every application shall be submitted with a list of "Parties In Interest"
which list shall include the petitioner, abutters, owners of~land directly
opposite on any public or private street or way, and abutters to the
abutters within three hundred feet (300') of the property line of the
petitioner as they appear on the most recent applicable tax list,
notwithstanding that the land of any such owner is located in another city
or town, the Planning Board of the city or town, and the Planning Board of
every abutting city or town.
*Every application shall be submitted with an application charge cost in
the amount of $25.00. In addition, the petitioner shall be responsible
for any and all costs involved in bringing the petition befor? the Board.
Such costs shall include mailing and publication, but are not necessarily
limited to these.
Every application shall be submitted with a plan of land approved by the
Board. No petition will be brought before the Board unless said plan has
been submitted. Copies of the Board's requirements regarding plans are

PLAN OF LAND TO ACCOMPANY PETITION
Each application and petition to the Board shall be accompanied by
five (5) copies of the following described plan:
The size of the plan shall be 11 x 17, drawn to scale, 1 inch
equals 40 feet; it shall have a north point, names of streets,
zoning districts, names and addresses of owners of properties
within a minimum of 200 feet of the subject property, property
lines and location of buildings on surrounding properties. The
location of buildings or use of the property where a variance is
requested and distances from adjacent buildings and property lines
shall be verified in the field and shown on the plan. The
dimensions of the lot and the percentage of the lot covered by the
principal and accessory buildings and the required parking spaces
shall be shown. Entrances, exits, driveways, etc. that are
pertinent to the granting of the variance shall be shown. All
proposed data shall be shown in red.
Any topographical feature of the parcel of land relied upon for a
variance, such as ledge, rock peat, or natural condition of water,
brook, or river, shall be shown on the engineering plan. When a
variance is requested to subdivide a parcel of land, the dimen-
sions and area of the surrounding,lots may be taken from the deed
or lotting plan for comparison of the size of the lots in the
neighborhood, noted on the plan as such, and marked "approximate".
The plan shall be signed., and bear the seal of a registered'
surveyor or engineer. Any plans presented with the petition shall
remain a part of the records o -f the Board of Appeals.
If living quarters are to be remodeled, or areas are to be
converted into living quarters, in addition to the plot plan, five
(5) conies of the following described plans shall be furnished:
1. A floor plan of each floor on which remodeling is to be done
or areas converted into living quarters;
2. A floor plan showing the stairways, halls, doors opining into
the halls, and exit doors of each floor or floors where no re-
modeling or converting is to be done;
3. The plans and elevations shall show all existing work. All
proposed work shall be shown in red. The size of each plan
shall be 11 x 17 or 17 x 22; it shall be drawn to scale, 1/4
inch equals one foot.
All plans and elevations presented with the petition shall remain
a part of the records of the Board of Appeals.
For petitions requesting variation(s) from the provisions of
Section 7, Paragrpahs 7.1, 7.2, 7.3, and 7.4 and Table 2 of the
_ Zoning By Law for conveyance purposes only, a plot plan, certified
by a registered engineer or land surveyor, of the parcel of land
with a structure thereon being conveyed, will be acceptable to the
Board of Appeals provided:
1. The dwelling(s), structure(s), or building(s) were constructed
prior to March 14, 1977.
2. The petition is not to allow construction or alteration to
,the dwelling(s), structure(s), or building(s) which will re-
sult in the need for the issuance of a building permit.
3. The size of the plan shall be no smaller than 8 1/2 x 11
inches and must show the existing area of the parcel, the
existing frontage, and the existing setbacks of the
dwelling(s), structure(s), or building(s) being conveyed.
4. Proper space is provided on the plot plan for the Board's
signatures, as well as adequate space for the following
information: date of filing, date of public hearing, and
date of approval.
