Legal notices were sent to all names on the abutter's list and were published in the Eagle -Tribune, a newspaper of general circulation in the Town of North Andover, on March 26 & April 2, 2007. The following voting members were present: Ellen P. McIntyre, Joseph D. LaGrasse, Albert P. Manzi, III, Thomas D. Ippolito, and Daniel S. Braese. The following non-voting members were present: David R. Webster and Richard M. Vaillancourt. Upon a motion by Ellen P. McIntyre and 2nd by Daniel S. Chairman North Andover Board of Appeals 1600 Osgood Street North Andover, MA 01845 RE: May Street Dear Atty. Albert P Manzi III On September 11, 2007, May Street is going to be on the agenda. My question is can the board vote on a permit that states vacant premises? I have found Annual Town Reports and North Andover Housing Authority Reports that call it a park on May Street adjacent to McCabe Court Community Development gave Block Grant money to develop a park at May Street and the North Andover Housing accepted the money to develope a park on May Street. Now is it a park or was the use of the money misrepresented I have talked with HUD agents in Washington, DC and Boston, MA. They told me that both the Town and Housing have to have records, because Community Grants come with guide lines that have to be followed. They suggested that I start with Community Development Curt Bellovance said he would try to find anything on the subject. At this time it seems like the only information are letters of intent to Violet Kondrat, Annual Town Reports 1980 thru 1984 and a letter from Mr. Malcom Norwood Jr. Mr. Norwood Jr was on the Board of Directors for North Andover Housing. How can you vote on a vacant premise without proof it isn't McCabe Park? Everything points to a park which means you need to know the Government guide lines attached to that 2.4 million dollar Block Grant. He asked if I remember if the land was sold with the stipulation that it be a park. I was the one of the housing authority directors at the time the land was sold. I recall that Joe's sister sold the land to the housing authority to be a park and not a housing project. After looking at the May Street land again, I have to wonder how North Andover Housing Authority Corp. received money for a park and can now ask HUD to give them money again this time for a house. North Andover Town Report 1982 has it as a new park adjacent to McCabe Court. Now I realize it isn't the Board of Appeals job to vote on how the North Andover Housing Authority wants to close the park. Your job is to hear there request for a waver and look at all the facts before you grant a waver. The zoning is residential but the lot is undersized for even a single family home. Then there is the issue of safety. They plan to build a two family home, with each having three bedrooms. Two homes with three bedrooms each have the potential of four adults and eight children there. They also may need four or more parking spaces, all on that undersized lot. Under public housing laws, some of the people may be challenged in a manner that they wouldn't realize the danger of the trains only a few feet away in back or the blind corner in front. The trains are so close one set fire to McCabe's Community Room. Also, consider on any given day eight children pias friends might spill into the street because of the very small yard. That corner isn't safe 24/7 then you add fire trucks and EMT's that are responding to McCabe's on a regular basis. I realize 40B is set up to keep towns from stopping low income housing but I don't think HUD would want safety overlooked. Denial would only mean the need for a larger safer lot on a street that isn't already congested to the point that many days it narrows to one lane. I'm sure neither HUD nor North Andover Housing Authority would challenge the Board of Appeals for wanting public safety as their first concern. A low income family should have the same consideration as anyone in town. We shouldn't just grant a waver to the laws so we can send them to any little corner. Morkeski, the Authority's 34th Annual Report for fiscal year ending September 30, 1982. The. report has been prepared in accordance with Chapter 121B of the General Laws of Massachusetts, which governs housing authorities. During the year, the Authority has assisted and provided low -rent subsidized units for approximately 350 citizens of our Town. These low -rent units are 24 distributed in five developments, which consist of 239 units of elderly and the units of veteran's housing. As well as our publicly -owned apartments, Authority also administers, through the use of Federal funds, a rental subsidy C program. The program subsidizes tenants in existing housing that is funded pursuant to Section 8 of the United States Housing Act of 1937. An Annual Contribution Contract has been executed with the Federal Department of Housing and Urban Development (HUD). This program is designed to provide a Federal subsidy for housing to eligible moderate- and low-income families, as well as to elderly individuals. The goal of the program is to coordinate both the private and public sector for the purpose of meeting the housing needs of our k` community. It offers North Andover resident families in need of housing or housing assistance a choice of residence among virtually every apartment that t Rental guidelines. qualifies within the Housing Code Guidelines and Fair Market The success of this program is greatly dependent upon the support of our local -_..landlords, which I am pleased to report have been very cooperative. The Authority is further committed to aid in remedying the financial burden of housing for our residents. As of the publication of this report, the Authority has a pending application with HUD for the financial resources to fund an additional 36 units of Section S. This fall the Authority completed construction of its fifth elderly housing complex, 60.units awarded by HUD totalling $3,539,565, with an appropriate loan authority of $250,000 over a forty -year period. Construction of this development began on September 9, 1981, and the completion date was October 1, 1982. The specific housing objective of this development was founded on our basic philosphy that the overall housing development would achieve innovative and creative architectural treatment, with high quality construction techniques, to be located so as to enhance a particular neighborhood and provide a catalyst for neighborhood stabilazation. The 3.3 acre site, located at the corner of Greene Street and Waverly Road, chosen for this development allowed for an effective integration of location, site layout, and achitecture which provided for an innovative design solution, fulfilling the Authority's program requirements in terms of maintenance facilities, office facilities, open space, and most importantly, providing sixty successfully attractive apartments. The scale of this development is complimentary to the neighborhood and provides for the preservation of an 18th - century farmhouse. The recycling of this older building is visually a factor for the architectural theme. The building -was restored and serves as the Authority's central office facility. Presently, the farmhouse is in the final stages of being nominated for the National Register of Historic Places, a 4. future asset to our community. The record to date of the Authority has been substantial, both by the number of housing units constructed, as well as the high caliber of the developments. To ure this continued high standard, the Housing Authority has actively pursued to and federal modernization funding. The Authority has been successful in aining $123,154 from the Executive Offices of Communities and Development ! neriy'�improvements. Violet Kondrat agreed to the sale thinking it would save the last small piece of open green space on May Street. North Andover Housing Authority had already purchased the open field bordered by May Street and Belmont Street for McCabe Court Housing. Please record this packet and her objection to any change that would remove the park. Her reason for the objection is the change is for an oversize house on an undersize lot at a blind coroner. Federal Community Development is meant to help and enhance an area. All letters and documents from North Andover Housing Authority clearly indicated to Violet Kondrat and HUD their intent was to establish a park on lots fifty (50) fifty-one (51) fifth -two (52) and fifty-three(53). Violet Kondrat agreed to the sale thinking it would save the last small piece of open green space on May Street. North Andover Housing Authority had already purchased the open field bordered by May Street and Belmont Street for McCabe Court Housing. Please record this packet and her objection to any change that would remove the park. Her reason for the objection is the change is for an oversize house on an undersize lot at a blind coroner. Federal Community Development is meant to help and enhance an area. She can not see where the change will enhance or improve May Street If the North Andover Housing Authority Corporation wishes to expand their holdings she is quite sure they can find a suitable size lot in North Andover on a less congested street.
