CALL TO ORDER: James Xenakis called the meeting to order at 7:00 PM at Town Hall Meeting Room.
ATTENDANCE: The following were present: James Xenakis, Chairman;Thomas Licciardello;Rosemary
Connelly Smedile;Daniel P.Lanen;Mark J.T. Caggiano;Mark Rees, Town Manager;Ray Santilli, Assistant Town
Manager.
EXECUTIVE SESSION:
Thomas Licciardello made a MOTION, seconded by Rosemary Smedile,to move into Executive Session to discuss
Collective Bargaining. Vote approved 5-0.
The Board of Selectmen was individually polled and each voted to move into Executive Session. Daniel P.Lanen,
yes;Mark Caggiano yes;Rosemary Smedile,yes, and Thomas Licciardello yes; James Xenakis yes. Vote approved
5-0.
COMMUNICATIONS,ANNOUNCEMENTS,AND PUBLIC COMMENT:
Commendations for Exemplary Service
The Board of Selectmen presented the following Police Officers a Commendation for Exemplary Service:
Sergeant Charles Gray, Officer Daniel Quinlan,Officer Mark Wilson and Inspector Daniel Cronin received a letter
of commendation for their participation in the apprehension of an armed assailant on
November 14, 2007.
Communication Officers Joan Lundquist and John Burke received a letter of commendation for their actions in the
communications center on November 14, 2007.
Officer Joseph Kamal and Officer Kate Knab received a letter of commendation for their actions in saving a life
using a defibrillator to resuscitate a victim.
Department of Public Works employee Philip Long received a letter of commendation for his actions in helping a
co-worker until EMT's came onto the scene.
The Board expressed their gratitude and pride for these men and women who serve this community and an
appreciation for a job well done.
New Business Recognition
A Certificate of Appreciation was presented to Fulfillment,Print and Mail Solutions for locating their business in
the Town of North Andover

The Selectmen's sub-committee appointed the following people to serve on boards or committees:

Rosemary Smedile made a MOTION, seconded by Mark Caggiano,to approve the appointments.
Vote approved 5-0.
Financial Report from the Town Accountant
Town Accountant Lyric Savage gave an update budget status report for revenue and expenses ending October 31,
2007. Revenue: Tax Revenue collections are at 41.2%,which is in line as expected for this point in the fiscal year.
Motor Vehicle Excise Tax bills will go out in February and expected revenue to be collected in March and April.
Payment in Lieu of Taxes is received in the month of March from the Housing Authority. Over all,total revenue
collected is 38.9%.

Expenses: All departmental budgets are running either below or slightly above 33%due to normal operations.
Enterprise Funds Water/Sewer: Percentage of revenue collected is showing a profit as of October 31, 2007.
Enterprise Funds Stevens Estate: Percentage of revenue collected is showing a profit as of October 31,2007.
CONSENT ITEMS:
Approval of Designer/Architect for Senior Center
The Designer Selection Committee interviewed finalists and unanimously recommended to hire the firm of Knight,
Bagge and Anderson Inc for renovation of the Senior Center. The Board was requested to approve the selection of
the designer chosen in accordance with the Designer Selection Procedures.
Mark Caggiano made a MOTION, seconded by Thomas Licciardello,to approve the Selection of Knight,Bagge and
Anderson Inc.for the renovation project at the Senior Center. Vote approved 5-0.
Designer Selection Approval—Four Historical Projects
The Designer Selection Committee interviewed finalists and unanimously recommended to hire the firm of Lerner,
Ladds&Bartel for the four historical projects which include renovation of the Gate House at the Stevens Estate;
renovation of the Plant House at the Stevens Estate;restoration of brickwork and roof repairs a the Main Street Fire
Station;and replacement of windows and roof restoration at the Stevens Memorial Library. The Board was
requested to approve the selection of the designer chosen in accordance with the Designer Selection Procedures.
Mark Caggiano made a MOTION, seconded by Thomas Licciardello,to approve the Selection of Lerner,Ladds&

LICENSING COMMISSIONERS:
Rosemary Smedile made a MOTION, seconded by Thomas Licciardello,to move into Licensing.
Vote approved 5-0.
Stevens Estate Licensing Fees
Licensing Chairman Caggiano said that currently there is no fee being charged to the Stevens Estate. Caggiano
suggested charging the Estate a fee of$3,075 that is similar to a function facility.
Daniel Lanen made a MOTION, seconded by James Xenakis,to charge a fee of$3,075 for a function facility all
alcohol club licenses on premises.
Town Manager Mark Rees said that this was not in the FY08 budget and asked the Board to defer payment until July
1,2008 and make the payment retroactive as of January 1, 2008.
Daniel Lanen AMENDED the MOTION, seconded by James Xenakis,to charge the Stevens Estate a fee of$3,075
for a function facility all alcohol club licenses on premises and to defer payment until July 1, 2008 and make the
payment retroactive as of January 1, 2008. Vote approved 5-0.
Note: James Xenakis recused
License and Permit Renewals for 2008
Licensing Chairman Mark Caggiano recommended that the Board of Selectmen approve the renewal licenses.
Mark Caggiano requested the Board to authorize the Chair of Licensing to withhold issuance of a license until such
time as a few businesses come into compliance with town regulations.
Rosemary Smedile made a MOTION, seconded by Thomas Licciardello,to authorize the Licensing Chairman to
grant the licenses subject to the businesses making payment by December 31,2007 or agreeing to setup a payment
plan with the Town Treasurer/Collector. Vote approved 4-0.
The following establishments not renewing their licenses: Crumpets Tea Room not renewing their Wine and Malt
Beverages,but will maintain Common Victualler License. Eatz Restaurant not renewing their Wine and Malt
Beverages,but will maintain Common Victualler License. Mary's Pasta& Sandwiches are not renewing their
Common Victualler License.

There are three businesses that have not responded to the renewal of their Common Victualler License for 2008.
DeFusco& Son Bakery,Dream Dinners and Val's Restaurant.
Rosemary Smedile made a MOTION, seconded by Daniel Lanen,to give these businesses until December 31,2007,
subject to their applications and payment. Vote approved 4-0.
Daniel Lanen made a MOTION, seconded by Rosemary Smedile,to approve the following License Renewals. Vote

The North Andover Police Department alerted the Licensing Chairman that North Andover Getty and J&T Auto
Sales have more vehicles on their property than the maximum licensed number. This information was brought to the
attention of the businesses.
North Andover Getty Auto Sales,785 Turnpike Street(Class II License)
Roger G.Feghali,proprietor said that his license did not state how many vehicles were allowed on the property. Mr.
Feghali said he would contact the Town Clerk's office to comply with the number of vehicles allowed on the
property for his license.
Rosemary Smedile made a MOTION, seconded by Daniel Lanen,to approve the license for North Andover Getty
Auto Sales subject to compliance with town regulations. Vote approved 5-0.
J&T Auto Service and Sales,77 Main Street(Class II License)
John McElhiney, Jr,proprietor requested an increase of the amount of vehicles on his property from seven to twelve
because the business has grown since his license was first issued.
James Xenakis made a MOTION, seconded by Rosemary Smedile,to approve the request for increasing the vehicles
on the property for J&T Auto Service and Sales. Vote approved 5-0.
Change of Premises Request: Camelot
Harold Johnson President of the Camelot Building Association the Knights of Columbus requested the Board's
approval for alterations to the premises at 505 Sutton Street.
James Xenakis made a MOTION, seconded by Rosemary Smedile,to approve the request of the Camelot Building
Association for alterations to the premises at 505 Sutton Street. Vote approved 5-0.
Change of Manager Request: Fresh City
The Board of Directors of Fresh City Restaurant, 93 Turnpike Street requested the approval for change of manager.
Thomas Licciardello made a MOTION, seconded by Rosemary Smedile,to approve the request for change of
manger at Fresh City Restaurant, 93 Turnpike Street. Vote approved 5-0.
James Xenakis made a MOTION, seconded by Thomas Licciardello,to move out of licensing. Vote approved 5-0.
PUBLIC HEARINGS:
Rosemary Smedile made a MOTION, seconded by Thomas Licciardello,to open a Public Hearing for Tax
Classification. Vote approved 5-0.
Property Tax Classification
The Board of Selectmen conducted a workshop at their December 3rd meeting where the Board of Assessors
provided some preliminary information on the various options and impacts regarding property tax classification.
The Board is requested to vote on this matter at this meeting to allow sufficient time for tax bill production.
Merrimack Valley Chamber of Commerce President Joseph Bevilacqua requested that the Board consider reducing
the business and industry tax rate from the current rate. The property tax cost is the one area where a reduction can,
and will,assist companies in remaining competitive and assist their continued operation.
Robert Ercolini of Bridle Path Road presented spreadsheets with his own calculations of how the Board should be
setting the tax rate for residents and businesses in town.

Mark Caggiano made a MOTION, seconded by Thomas Licciardello,to close the Public Hearing.
Vote approved 5-0.
Thomas Licciardello made a MOTION, seconded by Mark Caggiano,to keep the 2008 tax rate split at 1.18.
Residential tax rate would be$11.40 per$1,000 of valuation and the business tax rate would be$13.78 per$1,000.
Vote approved 4-1. Rosemary Smedile opposed.
OLD BUSINESS:
Winter Parking Ban,Revision
The Town Manager Mark Rees met with Police Chief Stanley and Fire Chief Martineau to addressed the Winter
Parking Ban with revisions to insure public safety. The two factors considered where the following: 1. Will
emergency vehicles be able to pass on the roadway when it is constricted by having cars parked on one side of the
road and snow accumulated on both sides? 2. Is there inadequate off street parking to accommodate a reasonable
number of residents'vehicles. A revised plan was presented to the Board and the public for discussion. The Streets
in question were Beverly Street,Annis Street and Thorndike Street.
Residents came forward to request that they be allowed to park on sidewalks adjacent to their homes. They asked
the Board of make exceptions for their particular streets.
Parking on sidewalks at any time during the year,including the period of this order is not permitted.
During the period of this order,parking is allowed so that two tires are within 12 inches of the curb or sidewalk and
a minimum of twenty feet away from an intersection or fire hydrant,on the following streets as indicated below.
Stonington Street Parking on even side only
Saunders Street Parking on odd side only
Lincoln Street Parking on even side only
Perry Street Parking on even side only
Church Street Parking on odd side only
Ashland Street Parking on odd side only
Annis Street Parking on even side only

During the period of this Order the sidewalk on the odd side of Beverly Street between Middlesex Street and Union
Street is closed to pedestrian use.
Mark Caggiano made a MOTION, seconded by Thomas Licciardello,to amend the parking so that residents can
park on both sides of the Beverly Street. On the odd side residents can park on the sidewalks and on the even side
residents can park on the street,but the sidewalk must stay clear. Vote approved 5-0.
Mark Caggiano made a MOTION, seconded by Rosemary Smedile,to amend the parking on Thorndike Street so to
allow parking on odd side from Sutton Street to Troy Road. Vote approved 5-0.
Rosemary Smedile made a MOTION, seconded by Daniel Lanen,to amend the parking on Annis Street so to allow
parking on the even side of Annis Street. Vote approved 5-0.

TOWN MANAGER'S REPORT:
The Greenery/Police Station Task force met on December 3rd to begin their discussion on the future of these two
interrelated parcels of land.
On December 4d',the Committee working on the transfer of recycling collection from the Town to TBI met to put
the final revisions on a proposed agreement with TBL This proposed agreement will be sent to TBI this week.
On December 6,2007 the Cable TV Advisory Committee with Special Counsel Bill August to begin the process of
negotiating a franchise agreement with Verizon Cable.
