Dear Ms. Sawyer:
have enclosed a copy of the Pest End Exterminator's service slip
which documents that upon inspection of 10 Adams Avenue, one
dead mouse was found with a few droppings in the attic. There was
no evidence of any other animal being present. The problem Mr.
Kalloch described to me was represented differently to the inspector
as he told me that David Kalloch reported that he sometimes heard
mice in the attic and it woke him up a few times. I do not feel that this
was a serious enough issue that justified threatening calling the
Board of Health if the problem was not fixed within 48 hours.
This incident is representative of the continuing problems I have
with Mr. David Kalloch as tenant. In addition, on August 8, 2008 Mr.
Kalloch recorded a conversation with my husband who happened to
be at the property cutting the lawn. Mr. Kalloch did not inform my
husband of this recording until it was over, pulling out a tape recorder
from his shirt pocket. I have also enclosed a copy of a letter
documenting my observations that Mr. Kalloch could be running a
repair business out of the basement. ,
Mr. Kalloch also continues to leave offensive voice mails on my
cell phone even though he has been ordered by my lawyer not to call
me. His response was: "that means nothing to me." I am not trying to
involve you in my personal problems but I feel you should be aware
of all issues when Mr. Kalloch threatens to contact you in retaliation.

Dear Attorney Gerstein:
would like to document that on Monday, August 18 at 2:45p.m., I
drove by my mother's house at 10 Adams Avenue, North Andover,
and observed a trailer which belongs to David Kalloch, parked in the
driveway. On the trailer was a large washing machine. The following
day on August 19, at 11:00 a.m. I was driving by again and saw the
same trailer with a machine on it parked in the driveway. My husband
drove by later, at 11:30 a.m. the same day, and observed the same.
These machines are the same units I saw in the basement in May
when Lapans Waterproofing was working there. Jim Lapans himself
had commented to me that it looked like Mr. Kalloch was repairing
washing machines in the basement. At that time, there were five large
machines in the basement along with a large compressor. I find it
upsetting that Mr. Kalloch could be using the basement for such
purposes as this would be against the law and against my knowledge
or consent. I also question how Mr. Kalloch could complain about
mold, stink, water leakage still being present in the basement if he is
indeed using it to run a repair business.
This only adds to the continuing problems I have with the tenancy
of Mr. Kalloch and Ms. Forbes. I do not expect any response from
you. I simply wanted to document this activity.

A Health Department ORDER LETTER dated April 7, 2008 was issued to the owner of record of
the property listed above citing violations of the State Sanitary Code, 105 CMR 410.000,
Minimum Standards of Fitness for Human Habitation. The Health Department was unable to
perform a re -inspection of the property. In cases where the Health Department is unsuccessful
in re -inspecting a property and unless other wise indicated by the tenant. The Health
Department will determine through other means (such as back up documentation provided by
the Home Owner) that all of the violations noted on the Order Letter have been corrected. The
Health Department would like to thank you for your cooperation.

Today Lapans Waterproofing completed the following work at 10
Adams Avenue: repaired the cracks in the wall,sealed the areas with
tie rod leaks, installed a sump pump and a French drain at the base
of the bulkhead. They could not repair the bulkhead so I have
instructed them to replace it. It was ordered yesterday at Home
Depot but due to its age, it is an odd size and is not a stock item. This
special order may take up to 14 days to come in. Lapans will return
to install it and this will complete the work ordered in your letter dated
April 7,2008. 1 will contact you when all is complete.

Dear Ms. Grant:
I hired Lapans Basement Waterproofing to complete the work at
10 Adams Avenue as of 5:00p. m. yesterday, May 5,2008. Mr. Lapans
will seal all cracks in the foundation, fill and seal areas with tie rod
leaks, install a French drain at the base of the bulkhead and repair,
not replace, the bulkhead. The estimate for this work is $3255. The
next step is for Mr. Lapans to schedule the work with Felicia Forbes.
This plan of completion replaces any other faxed to your
department.

Dear Ms. Grant:
faxed you a plan of completion this morning for the property at
10 Adams Avenue. The contractor who I hired recommended I call
basement weatherproof companies to sea! the cracks in the
foundation. This afternoon I did call several companies to obtain
estimates and told them to contact Felicia Forbes directly so that they
could schedule an appointment at a time convenient for her and her
husband. At 4:10 p.m. I received a threatening voice mail from David
Kalloch on my cell phone stating that I need to contact my attorney as
they would not allow any contractors to access the property to obtain
estimates, especially if it is during working hours. He also threatened
to come after me with other issues if I did not comply with his
demands. All the companies I contacted are only available during the
day and it is my understanding that Mr. Kalloch works second shift for
the US Postal Service.
am trying to get the bulkhead door repaired and the foundation
cracks sealed in a timely manner to respond to the Board of Health's
demands. At this point, I can not proceed with this plan of completion
as Mr. Kalloch is refusing entry to the property. I have not even begun
to schedule a time to do the work.
Please advise as to what I should do next as I can not proceed

Following an inspection of the property at 10 Adam Avenue, North
Andover by a professional builder on Saturday, April 26,2008, the
following is a plan of completion to fix the violations:
1. Replace the bulkhead door
2. Seal cracks in basement foundation in 2 locations: one in front
of house and one on the left side of the house.
will need to hire two separate professionals to complete this
work and I will need to contact at least two basement foundation
repair services to arrange for an estimate prior to hiring one.
The person I sent in to inspect is not available to do this work.
am asking for six weeks time to complete this work as I have no
control over contractor's schedules and must schedule work at the
convenience of the tenants, Dave Kalloch and Felicia Forbes. My
goal is to have the repairs completed by June 9,2008. 1 will continue
to update you on the progress of this task. Please advise if this is
satisfactory with your department.

Dear Ms. Grant:
Per our phone conversation yesterday, I am writing to request an
extension of the time required to respond to the order letter
concerning the property at 10 Adams Avenue. The reason for this
request is due to the problems I have with the current tenant, David
Kalloch. As I explained to you on the phone, Mr. Kalloch has been
hostile, aggressive, intimidating, offensive and insulting to me in
recent conversations which I have recorded on my cell phone. At this
point, I do not feel safe entering the premises at 10 Adams Avenue
without a police escort due to the threats made by Mr. Kalloch to me.
Nor does my brother, who is part owner, feel safe as Mr. Kalloch has
threatened to have him arrested if he sets foot on the property. It
could take some time to arrange a police escort, and I have no
guarantee that Mr. Kalloch will allow anyone in without a hassle which
could only delay action. Mr. Kalloch wants me to go in alone, but after
his threatening demeanor, I no longer feel safe doing this, and am
fearful that he could turn violent. I would have to schedule an
inspection when the police are available to assist. I also do not know
if I will encounter any problems hiring someone to go into the house
to physically see the issues you have cited me on, as I do not intend
to withhold any information regarding Mr. Kalloch's nature. I feel
obligated to tell anyone that I ask to enter the premises that I can not
guarantee that Mr. Kalloch will be cooperative. This could also delay
response to your letter.

believe that the action of contacting your office to inspect my
mother's house was vindictive and retaliatory in nature on the part of
Mr. Kalloch. He did threaten on two occasions that he was going to
call your department to have the house condemned. I do not believe
that the house is a threat to anyone's health as my mother resided
there for over twenty years and never had ANY problem. I find it hard
to believe that in the eight months Mr. Kalloch has occupied the
premises that things have changed drastically to the point where the
house is unfit for human habitation. In fact,Mr. Kalloch's wife, Felicia
Forbes, told me in January that she liked the house and she liked
living there but that Mr. Kalloch wanted to move due to the dampness
in the basement. At this time, I offered to allow Mr. Kalloch the option
to move out without fulfilling the terms of the tenancy at will
agreement and without giving any notice. Mr. Kalloch's response was
that he was not moving before June. Yet he considers the house to
be condemnable and is unhappy with it.
On February 10, 2008 my brother did inspect the premises at 10
Adams Avenue after Mr. Kalloch and Ms. Forbes complained of mold
both upstairs and downstairs in the basement. Mr. Forbes
complained that he had to run a de -humidifier constantly and I offered
to pay the excess cost of electricity incurred by Mr. Kalloch.
requested copies of the electric bill be sent to me but to date have not
received any. My brother did not find any evidence of mold either
upstairs or downstairs in the basement and did not find any evidence
of alleged mold in the rug in the living room after he got down on his
hands and knees and inspected the area. He also did not find any
evidence of alleged mold in the basement. My brother did observe an
old mattress on the basement floor and some old furniture on the
floor as well. Earlier in February, when Mr. Kalloch complained of
water in the basement, my brother offered to replace the sump pump
but needed to physically see the one in operation at 10 Adams Ave.
When I called to arrange this, I was told that no one would be home
until 9p.m. which was after the time the stores were open. The next
day, I offered again to have my brother go over to see if the sump
pump was adequate but Mr. Kalloch told me that he had adusted the
level on it as it had been set wrong and it was working fine.
Mr. Kalloch withheld the rent for the month of March. I gave him
the benefit of the doubt and politely called on March 9,2008. 1 left
several messages on Ms. Forbes's cell phone asking if they had any
problems with water, and also asking about the unpaid rent for
r
March. I did not receive a call back until two days later when Mr.
Kalloch informed me that he would not be paying the rent due to
issues with mold. During this phone conversation, Mr. Kalloch
screamed at me in a very aggressive manner, would not listen to
anything I had to say, was totally unreasonable, was accusatory and
insulting. I had to terminate the conversation as my blood pressure
elevated to medically unsafe levels. In fact my husband made my
hang up after he heard the manner in which Mr. Kalloch was
speaking to me. Mr. Kalloch also informed me that he would not be
paying the rent and that he would eventually be moving out.
Following this conversation, I arranged for a home inspector to
be brought in to 10 Adams Avenue on March 14, 2008 along with
myself, my brother, and a representative from GMAC real estate who
is a personal friend who also was a former resident of Adams Avenue
and owned a similar style house. This was in response to accusations
from Mr. Kalloch that there was mold in the house. My intent was to
inspect the house to see if there was a problem and fix it so Mr.
Kalloch would be happy. Mr. Kalloch reacted in this way:
1. He told me that "no one would be coming into the house" and
would have to schedule an appointment with him for a later date and
only I could enter the house.
2. He threatened to have my brother arrested and anyone else
who showed up. "If you think I am kidding, just try me, " was his
response. He threatened to sue me for harassment if anyone showed
up.
3. He threatened to have me arrested for harassment if I spoke to
his wife again. In addition, I am also not allowed to call him and I can
only converse with him through certified mail.
4. He threatened to sue me for $8,000 to cover the damaged
property left on the basement floor and that he fully expected to have
me pay his moving costs.
5. Mr. Kalloch left three abusive, offensive, calls on my cell phone
within the same time frame and told me he was going to charge me
for the time he spent waiting for me even after he told me not to have
anyone show up. "Next time you rent, learn how to treat people
better," was another one of his comments.
6. He threatened to call the Board of Health and have the house
condemned.
Mr. Kalloch moved into the property on August 1, 2008. Since that
time, I have spent $2560.90 in repairs to the property. I have
attached a list and have been extremely responsive to any
complaints/issues Mr. Kalloch has had as a tenant. Again,my mother
lived in the house for twenty years until her death, and never had
ANY problems with the property. Mr. Kalloch chose to store
belongings on the basement floor after he saw the sump pump in
July 2007 when he was interested in renting the house. I personally
told Mr. Kalloch that if there were heavy rains my mother would get
water in the basement. At no time did I guarantee the basement floor
to be free of water and appropriate for storage. There are numerous
shelves in the basement for storage, and there also is a garage.
Unfortunately, any damages due to seepage are not covered under a
homeowner's policy. Mr. Kalloch was served a notice to quit on
March 21,2008, due to nonpayment of rent after he informed me that
he would not be paying the rent.
You have informed me that there is no mold in the house and this
has been Mr. Kalloch's main complaint. He also has stated that the
house is unfit for human habitation due to mold. My question is why is
he still living there if conditions are so poor? As stated before,
believe Mr. Kalloch has used your office as a vindictive gesture.
I will contact a builder to repair the bulkhead and to look at the
basement water leaks seen by a professional, as directed in your
letter. I will need more time beyond seven days due to the
circumstances I have outlined. In addition, I also was told by Mr.
Kalloch that I am not to call him, and that the only way we can
communicate was by registered mail or he would have me arrested.
In the past I have spoken regularly with Felicia Forbes because Mr.
Kalloch is frequently out of town for weeks. In fact Mr. Kalloch had
informed me in January that he would not be in North Andover except
for one week from January through June 2008. This appears to have
been inaccurate. The other major problem I have is that I can no
longer call Ms. Forbes as Mr. Kalloch threatened to sue me for
harassment if I did. I also will not call Mr. Kalloch as he is abusive,
insulting, accusatory, beligerent, threatening, and aggressive when
he talks with me. All of these issues are not caused by any
negligence on my part but they will serve to delay my response to
your order as at this point I will have to seek advice from a lawyer as
to the best way to communicate with Mr. Kalloch. I gave Mr. Kalloch
24 hours notice last time I attempted to enter the house. This was not
acceptable to him and he keeps referencing he needs " reasonable
notice" for anyone to access the property but he does not specify how
long a notice he would like. Perhaps you could call him and ask him
how much notice would be acceptable to him seeing that the
problems he has with the house are so urgent that they require the
Board of Health to be involved. I would like either you or a member of
your department to accompany any person I hire to enter the house.
I have also hired a lawyer to find out how quickly I can get Mr.
Kalloch to move out of my mother's house. At this point in time, my
elderly aunt has a fractured spine and needs to move into the house
so that I may care for her as she has no children and her sister
passed away in February 2008.
Please advise as to how much more time I have to respond to
your letter. I appreciate your understanding in this matter.

Dear Ms.Forbes,
This communication is in regards to your rental unit at 10 Adams Avenue, North Andover, MA.
On April 7, 2008, an Order Letter was sent to the owner of the property, Gail & Tom Robinson,
regarding violations to the Housing Code. This letter set deadline dates for completion of the
corrections as detailed. A six week extension has been granted to the homeowner due to the lack
of cooperation in gaining access to the property.
Ms. Robinson is addressing my concerns immediately and has contacted a several contractors
who then contacted you so as to receive multiple estimates. I have since been informed that there
has been no call back to a 3rd contractor to do an estmate.
Your failure to provide access to effect repairs is a violation of the State Sanitary Code. There
have been at least 2 instances that you have interfered in the Health Department's efforts to
address items in need of repair. This is an official Order Letter. You are hereby ordered to
comply with the State Code regarding providing access to the owner by May 1, 2008. Failure to
do so will result in a complaint filed against you in the Housing Court.
You have the right to request a hearing before the Board of Health if you feel this order should
be modified or withdrawn. A request for said hearing must be made in writing and received by
the Health Department within seven (7) days from the receipt of this order. At said hearing you
