This letter addresses Section 9 of the Zoning Board of Appeals Variance Application Form. A. The proposed use of this site is a car wash and the sign shall act as an advertising element for said car wash. B. There are no special circumstances related to soil conditions, shape or topography of such land or structures especially affecting the property for which the Variance is sought which do not affect generally the zoning district in which the property is located. C. The required setbacks do not allow the proposed sign to be seen from a reasonable distance. The proposed setbacks which would be 23.9' from Commerce Way and 15.5' from Osgood Street would allow the sign to be more visible to traffic and would also fall in line with all other existing signs on Osgood Street D. All signs along Osgood Street are not in compliance with the zoning setback requirements. The proposed sign location would be in a similar location to all neighboring signs. E. Granting this zoning variance would not nullify the intent of the zoning Ordinance because of the location of neighboring signs and the area in which the proposed sign would be located is actually 24' from the road as setbacks are taken from the property line, not the actual street location F.
