SCOTT Director Notice is hereby given that the Board of Appeals will hold a public hearing at the Senior Citizen's Center located at the rear of Town Hall Building, 120 Main Street, North Andover, MA. on Tuesday the 10 th day of September 1996 at 7:30 o'clock P.M. to all parties interested in the appeal of Son/Sun Trust & Jeanne Woelfel for a Variance from the requirements of Section 8 Paragraph 8.1(7) of the Zoning Bylaws for the purpose of off street parking and for a Special Permit under Section 4 Paragraph 4.11(3) of the Zoning Bylaw for the purpose to have the zoning boundary line moved in order that all buildings on the lot will be in a general business district. SCOTT Director Town of North Andover RECE1V'ED OFFICE OF JOYCE BRA 'S H W COMMUNITY DEVELOPMENT AND SEVOWpvER 146 Main Street North Andover, Massachusetts 01845 SEP I Z 3 08 P Any Appeal shall be filed within (20) days after the date of filing of this notice in the office of the Town Clerk BOARD OF APPEALS NOTICE OF DECISION Property: 10A Main Street The Board of Appeals held a regular meeting on Tuesday evening, September 10 1996 upon the petition of Son/Sun Trust & Jeanne Woelfel requesting a variance from the requirements of Section 8, Paragraph 8.1 (7) for the purpose of off Street parking and for a Special Permit under Section 4, Paragraph 4.11 (3) Zoning By Laws for the purpose of having the zoning boundary line moved in order that all buildings on the lot will be in a general business district presently in the GB/IS Zoning District. The following members were present and voting: William Sullivan, Walter Soule, Raymond Vivenzio, John Pallone, and Ellen McIntyre. The hearing was advertised in the North Andover Citizen on 8.27.96 & 9.3.96 and all abutters were notified my regular mail. Upon a- motion by John Pallone, seconded by Ellen McIntyre, the Board voted to accept a letter to withdraw the variance pursuant to Section 8, Paragraph 8.1 (7) without prejudice from off street parking. Upon a motion by John Pallone, seconded by Ellen McIntyre the Board voted to GRANT the Special Permit as requested to move a zoning district boundary line to the General Business District for the use of the Stone Building on the lot. This Special Permit for moving of boundary line was granted '_n 1988, petition 138-88 lapsing the time frame necessary for action of use. Voting members in favor of the petition were: William Sullivan, Walter Soule, John Pallone, and Ellen McIntyre. Note: The granting of the Variance and/or Special Permit as requested by the applicant does not necessarily ensure the granting of a Building permit as the applicant must abide by all applicable local, state and federal building codes and regulations, prior to the issuance of a building permit as required by the Building Commissioner.
