The Water Neater Rental Program offers you the opportunity to rent high quality, well -insulated, energy efficient electric water heaters. With the rentals, you receive a low cost, energy-efficient hot water service for minimal monthly rental fees. Service and/or replacement of the water heaters are provided when necessary at no charge assuring you of continued excellent hot water service. On March 25, 1998, Cranny Electric Company, our service contractor, was requested to do a service call for a complaint of "no hot" and "running out" of hot water on the rental tanks at Walker Road in North Andover. They sent their service person out to go over the problems and try to find a solution with you. Please note that they have gone out several times for the same type of complaints and never found any problems with the rental water heaters, Cranny's service person looked at all the tanks in building 3, 10 and 11. Property location — Unit 6 of building 10 on Walker Road, North Andover It is an established fact that the 345 gallon hot water capacity calculates out to 28 3/4 gallons per unit in the 12 unit building. I have informally surveyed residents or property management individuals for approximately 5 condominium complexes and 5 apartment complexes in the Greater Boston area. My question to these individuals was what is the capacity in gallons per unit being served by the hot water tank(s). The consistent response is that a unit receives at minimum of 40 gallons of hot water when the capacity is calculated for the units served The majority of the units are 2 bedroom units. Recommendation I am recommending that the Board of Trustees approve the immediate installation of a fourth hot water tank in building #10 (leased from Massachusetts Electric) Problem It has been brought to my attention that the hot water temperature in unit # 6 of building #10 is below the required minimum as stipulated by state law. This notification came from the current residents of the unit in December of 1997. I requested exact temperature readings from varying times during the day and on both weekday and weekend periods. The current residents (rental tenants) provided me with a listing which I forwarded to Tom in early February. Note: enclosed is an additional copy of the temperature readings. The listing documents times where the water temperature is below the required minimum of 110 degrees (specifically evening hours). Facts December 1997 - problem first reported to myself and communicated to Tom at 688-3400. Tom informed me of required temperature reductions performed by Mass Electric (their local service agent) in December where the existing temperature of 140 degrees was lowered to 125 degrees for all tanks. This action is required for compliance with State regulations designed to prevent "scalding" incidents. Tom placed two service calls to Mass Electric to determine if a problem may exist with any of the 3 water heaters. January 1998 - Tenants followed up with documented readings. In addition - the tenants communicated with the North Andover Board of Health and were informed that the minimum temperature required by law is 110 degrees and the maximum temperature allowed by law is 130 degrees. (2) February 1998 - I discussed the problem with Atty. Carmen Cassaro who suggested this be an agenda item for discussion at the neat Board meeting and relayed information concerning a similar problem in another building that may be caused by illegal washers in individual units. Miscellaneous Analysis Conclusion On the I Ph of February I discussed this problem with Mass Electric Customer service and a local business that services Meadowview for Mass Electric via a conference call. Mass Electric suggested a signed waiver by Meadowview after which they would adjust the maximum temperature up to 130 degrees. The waiver was signed by Tom and the adjustment to 130 occurred on 2/15/98. The tenants were asked to wait 48 hours and then provide feedback to me concerning any improvement. The feedback was positive in that the temperatures appeared to rise 5 degrees. But the evening problem time still had measured temperatures below 110 degrees. State Law 105 CMR 410.190 Hot Water was made effective in 1986. Building #10 hot water tanks were set at 140 degrees from 1986 to 1997. Mass Electric lowered the maximum temperature to 125 degrees in 12/97. The loss of 15 degrees has become noticable to residents who require hot water for showering in the evening apparently after heavy use for laundering from the same tanks. Tank recovery is not sufficient to guarantee minimum temperatures for residents during heavy use periods. Building capacity of 345 gallons ( three 115 gallon tanks) is likely not sufficient for the twelve units (individuals count - ???) A fourth tank (115 gallons or possibly less) is required to lessen the recovery time of the cluster of tanks during heavy use periods in order to guarantee meeting minimum temperature needs of the residents. Request: Please notify me of 1) your receipt of this correspondence 2) the next available Board meeting date (open or closed) 3) the placement of this issue on the next meetings agenda list 4) any feedback helpful in the near term which could help solve this problem and prevent the need for Health Code Violation complaint filings. The gauge was turned so that only hot water was flowing. Comments: TO: Meadowview Condominium Board of Trustees FROM: Stephen Devaney (Bldg 10 / Unit 6 owner) DATE: February 28',1998 RE: Complaint concerning lack of hot water in Building 10 during evening hours. 2' Letter On Thursday evening February 26h the residents of unit #6 in building #10 called to inform me that the hot water temperature was only 80 degrees. I left a phone -mail message on 688-3400 asking if a service call could be made to determine if any of the tanks was not functioning. I have not received a response yet to this inquiry. I spoke with the North Andover Board of Health on February 27`h (Susan Ford) who described the mimmum/maximum requirements for hot water under the State Human Habitation code. Given the problem being experienced by unit #6 in building #10 I sent inquiry letters to all other units of building #10 asking the individuals in residence if they are also experiencing below minimum hot water delivery. I would like to obtain from you the following 1) responses to my letter to you dated February 18 2) the names of all owners of units in building #10 ( with home address & phone numbers) 3) the names of the current Board members. I wish to be in contact with a point person from the Board who can assist me in resolving this problem for the current residents of building #10. No Trustee has contacted me as yet though a request was made in mid-January via Tom to ask a member to please contact me to work on this problem. It is apparent that more individuals than those occupying unit #6 are experiencing the problem of insufficient hot water. The response from unit # 9 describes a notification to Tom in December of 1997 similar to the notification I made at the same time. I draw your attention to this because I have been told by several board members that no one from building #10 has reported a problem. I will forward any additional responses from residents of building #10, if and when I receive them. The residents of building 10 / unit 6 have notified me that they are planning a Health Code violation filing to the North Andover Board of Health. The Board of Health has given the residents a beeper number to call so they may be contacted off hours to come by to take a water temperature reading. These residents are upset that I cannot give them a finite answer to when the problem can be resolved by the Meadowview Board of Trustees. It took 6 weeks for me to get a response from a Board member after first requesting a member to contact me. The telephone number 688-3400 is not working as a communication avenue to reach out to the Board when a high priority issue is being identified and requires discussion and solution. The residents of building 10 / unit 6 have not had a visit by anyone from Meadowview to discuss the problem first hand nor has an inquiry letter been received by them yet from the Board of Trustees. I wish to receive (ASAP) a copy of the Meadowview Condominium Master deed. I wish to receive documentation from Meadowview on what the exact hot water delivery requirements ,they are responsible for, are to each unit. In addition - I would like to know what portion of my monthly condo fee is utilized for hot water delivery. Please stay in constant contact with me through the duration of solving this problem. Please a to your inquiry into possible illegal laundry washers in building #10. Please identify any interim steps we may take to guarantee sufficient hot water delivery now. Please forward to me the expected monthly lease cost, in dollars, of a 4`h 115 gallon hot water heater. Please forward to me an approximate monthly energy cost to heat a 115 gallon hot water heater. The loss of 15 degrees has become noticeable to residents who require hot water for showering in the evening apparently after heavy use for laundering from the same tanks. Tank recovery is not sufficient to guarantee minimum temperatures for residents during heavy use periods. Building capacity of 345 gallons ( three 115 gallon tanks) is likely not sufficient for the twelve units (individuals count - ???) A fourth tank (115 gallons or possibly less) is required to lessen the recovery time of the cluster. of tanks during heavy use periods in order to guarantee meeting minimum temperature needs of the residents. In talking with Attorney Carmen Cassaro on Friday March 13"', 1998 — Carmen stated that nowhere in prior written letters from myself to the Board of Trustees have I specified that residents of building 10 have been forced to shower at a) health clubs, b) family homes, or c) homes of friends due to the lack of hot water. I have communicated this in phone messages left at 688-3400 and with two Board members during phone conversations. But to insure this is communicated in writing - I wish to state that the residents of building 10 / unit 6 are leaving the Meadowview grounds to seek a place to shower where they may have hot water and that this has been a necessity for the past 10 weeks. 2. I forwarded another response from a resident of building 10 to Mark Richard identifying a lack of sufficient hot water 5 units report a problem (inclusive of my representing unit #6) 1 unit states no problem being encountered 6 units have not yet responded to my survey letter I informed Bill S. on Friday (via phonemail message) that he is not to call me again (lack of professionalism, maturity, or grasp of the problem at hand) as he did during the early part of last week. He can communicate any substantive material to me concerning this hot water problem via written response through the Boards Attorney (Carmen Cassano) if he so desires and at his or the Boards expense. I communicated this also to Attorney Cassaro during a phone conversation we had on Friday. This request has apparently not been taken seriously as I received a late night call from Bill S. on Friday March 13th (apparently from a bar given the background noise) to inform me the runs as a democracy and I can make suggestions but he is laughing at my directive that he is not to personally call me. I am an individual who has experienced a series of heart attacks in my later thirties and now into my early forties and may face a transplant down the road — thus I will not tolerate the unprofessional behavior and harrassing phone communications I have received the last week which have no focus on problem resolution.. I will discuss facts concerning the problem at hand and possible resolutions to the same problem ONLY - with Board members or Property Management in future telephone conversations. 4. I facilitated the Mass Electric waiver to raise tank temperatures from 125 degrees to 130 degrees, though a member of the Board opposed this when approached by Tom. A point made to me is that the Board accomplished this and is thus in communication with me and responding to the problem. I am aware of the waiver since I initiated it and the waiver helped but has not resolved the issue. 5. I would like to see a resolution in place by the end of this week. It has been 10 weeks since being communicated to Property Management and the Board of Trustees. Carmen stated a letter to residents of building 10 will be out by Monday March 16"'. This letter will notify residents of the need to inspect the units for water leak problems and illegal laundry washers. This is good -but- I first heard this was to occur on March 3rd and three different authors of the letter have been identified to me. 6. Everyone benefits from an efficient, timely resolution to this problem. The residents of building 10, the unit owners of building 10, Property Management, Board of Trustees, owners of units in other Meadowview buildings. 7. If we cannot make progress — I will write to the other owners of units in building 10 and to all other owners in the Meadowview complex. 8. I have been given two conflicts dates as to the next open Board meeting, March 24`s and March 26th Please contact me to notify me of the accurate date.
